RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
WEST COVINA CERTIFYING THAT THE FINAL
is THE
ENVIRONMENTAL IMPACT REPORT FOR
THE PROPOSED THIRD AMENDMENT TO THE
REDEVELOPMENT PLAN FOR THE CENTRAL BUSINESS
DISTRICT REDEVELOPMENT PROJECT HAS BEEN
• PREPARED IN COMPLIANCE WITH CEQA AND STATE AND
LOCAL GUIDELINES; CERTIFYING THAT THE CITY
COUNCIL HAS REVIEWED AND CONSIDERED THE
INFORMATION CONTAINED IN SAID FINAL SUPPLEMENTAL
ENVIRONMENTAL IMPACT REPORT WITH RESPECT TO THE
PROPOSED THIRD AMENDMENT; MAKING CERTAIN
FINDINGS REGARDING THE ENVIRONMENTAL IMPACT OF
THE PROPOSED THIRD AMENDMENT; AND ADOPTING A
STATEMENT OF OVERRIDING CONSIDERATIONS
WHEREAS, a Redevelopment Plan for the Central Business District
Redevelopment Project ("Project") was approved and adopted by the City Council of
the City of West Covina on December 20, 1971 by Ordinance No. 1180, and amended
on May 23, 1977 and July 7, 1980 by Ordinances Nos. 1342 and 1481, respectively; and
WHEREAS, The City Council proposes to approve and adopt a Third Amendment
to the Redevelopment Plan which includes the addition of two areas to the Project,
hereinafter referred to as the "Workman Site" and the "Juniper Site"; and
WHEREAS, the addition of said two areas is necessary in order to effectively
• complete the development of a retail commercial center adjacent to the Workman Site
and an automobile center adjacent to the Juniper Site already under construction in
the Project area as it now exists; and
WHEREAS, the Redevelopment Agency of the City of West Covina ("Agency")
has caused to be prepared a Final Supplemental Environmental Impact Report ("Final
SEIR") for the proposed Third Amendment to the Redevelopment Plan pursuant to the
California Environmental Quality Act ("CEQA"), and State and local guidelines, rules,
regulations and procedures adopted pursuant thereto; and
WHEREAS, said Final SEIR supplements a Final Environmental Impact Report
dated April 15, 1983 which was certified by the Agency for the retail commercial
center which included the Workman Site as a part of the retail center in its analysis;
and
WHEREAS, the Agency by Resolution No. 240 and the City Council by Resolution
No. 6684, after a duly noticed joint public hearing, made all required findings and
determinations regarding the environmental impacts and significant effects of the
retail commercial center, and adopted mitigation measures and a statement of
overriding considerations with respect to the unavoidable significant effects of the
• center, and authorized the execution of an Owner Participation Agreement governing
the sale of property and the development of the retail commercial center; and
WHEREAS, the Agency and the City Council have held a duly noticed joint public
hearing to consider the proposed Third Amendment to the Redevelopment Plan and the
• Final SEIR; and
WHEREAS, the City Council has reviewed and considered the information
contained in said Final SEIR with respect to adoption of the proposed Third
Amendment to the Redevelopment Plan; and
WHEREAS, the Agency has certified that the Final SEIR has been prepared and
completed in compliance with CEQA and State and local guidelines, rules, regulations
and procedures adopted pursuant thereto;
NOW, THEREFORE, the City Council of the City of West Covina does hereby
resolve as follows:
SECTION 1. The City Council hereby certifies that the information
• contained in the Final SEIR has been reviewed and considered by the Members of said
Council.
SECTION 2. The City Council hereby finds with respect to the adverse
environmental impacts detailed in the Final SEIR:
• a. That the adverse environmental impacts of the proposed Third
Amendment to the Redevelopment Plan set forth in the Final SEIR, including any
raised in comments on the Draft SEIR, have been considered and recognized by the
• City Council.
b. That based on information set forth in the Final SEIR and other
documents and information in the record:
i) The addition of the Workman Site to the Project area by the
proposed Third Amendment to the Redevelopment Plan will not have a significant
effect on the environment, other than as identified in the Final Environmental Impact
Report dated April 15, 1985 which was certified by Agency Resolution No. 240.
ii) City Council Resolution No. 6684, attached hereto as Exhibit
"A" and incorporated herein by this reference, and the findings and determinations,
mitigation measures and statement of overriding considerations contained therein are
hereby adopted as the findings and determinations, mitigation measures and -the
statement of overriding considerations for the proposed Third Amendment to the
Redevelopment Plan with respect to the Workman Site.
C. That based on information set forth in the Final SEIR and other
documents and information in the record, the addition of the Juniper Site to the
Project area by the proposed Third Amendment to the Redevelopment Plan will not
have a significant effect on the environment in that:
• i) Adverse land use impacts of noise, traffic on and visual
incompatibility with adjacent residential uses (SEIR, p. 41) are mitigated to
insignificance or avoided by the mitigation measures included in the Garvey Auto
Center Development Guidelines adopted by the Agency on January 26, 1981 which
Guidelines are attached hereto and incorporated herein as Exhibit "B" by this
reference, and are hereby adopted as mitigation measures for, and made applicable to,
the Juniper Site.
ii) Adverse traffic, circulation, and access impacts identified in
the Final SEIR (pp. 26-28) are mitigated to insignificance or avoided by measures
included in Exhibit 1113" hereto to control vehicular movement and parking, in the City's
Municipal Code to control on -site and/or off -site parking, and in Planning Commission
Resolution No. 2513.
iii) Construction activities will generate significant adverse short
term impacts (SEIR, p. 38) which will be mitigated by City Noise Ordinance 1251.
Other noise impacts will be mitigated or avoided by the standards of the Garvey Auto
Center Guidelines (Exhibit "B").
d. That based on information set forth in the Final SEIR and other
• documents and information in the record, the adverse environmental impacts relating
to population and housing (SEIR, pp. 31-32), which will be the displacement and
relocation of persons and families from housing within the Workman Site and the
Juniper Site, cannot be entirely mitigated or avoided, but will be substantially
mitigated by the following measures which are incorporated into the Project by the
• Redevelopment Plan:

i) The Redevelopment Plan as amended by the proposed Third
• Amendment requires the Agency to assist all persons displaced by redevelopment
activities in the Project area in finding housing structures and locations that are
decent, safe and sanitary and within their financial means in reasonable convenient
locations and otherwise suitable to their needs, and to make all relocation payments to
such persons as required by law (SEIR, p. 33).
• ii) The Redevelopment Plan as amended by the proposed Third
Amendment requires the Agency to replace within four years all dwelling units housing
persons and families of low and moderate income which are destroyed or removed
• from the low and moderate income housing market by redevelopment activities (SEIR,
p. 32).
e. That no additional adverse impacts will have a significant effect or
result in a substantial or potentially substantial adverse change in the environment as
a result of the proposed development.
SECTION 3. The City Council hereby finds and determines that all
significant environmental effects identified in the Final SEIR have been reduced to an
acceptable level in that:
a. All significant environmental effects that can feasibly be avoided
have been eliminated or substantially lessened as determined through the findings set
forth in paragraphs 2.b, 2.e and 2.d of this Resolution.
b. Based upon the Final SEIR and other documents and information in
the record, the project alternatives identified in the Final SEIR are totally infeasible
in that the Third Amendment to the Redevelopment Plan and the addition of the
Workman and Juniper Sites are necessary for effective redevelopment and completion
of existing planned developments adjacent to the two Sites; the Final SEIR does not
identify any significant impacts which can not be substantially mitigated or avoided;
the expansion of the Amendment Sites would result in greater adverse impacts than
• are proposed by the Third Amendment; a reduction in area of the Amendment Sites
would only result in a slight decrease in identified adverse impacts with respect to the
Juniper Site, and would have no effect on the Workman Site; the retail commercial
center development adjacent to the Workman Site is under construction pursuant to
plans approved by and agreements with the Agency, and can not now be reduced; a
change in land use on the Juniper Site to office, banking or hotel uses would be
incompatible with existing auto uses and Agency plans for an auto center; there is no
alternative site for the three parcels included in the Workman Site as those parcels are
being included to solve certain planning problems and to effectively develop the retail
center under construction; the proposed alternative sites for the Juniper Site were
analyzed earlier by the Agency in terms of minimizing the removal of single family
homes and eliminating inconsistent uses, and were determined to be less viable for
expansion of the auto center.
SECTION 4. The City Council hereby authorizes and directs that a Notice of
Determination be filed with respect to the Final SEIR upon approval of the proposed
Third Amendment to the Redevelopment Plan.
SECTION 5. The City Clerk shall certify to the adoption of this
Resolution.
