A R SOLUTION OF THE CITY COUNCIL OF THE CITY OF
West Covina , CALIFIORNIA,
REQUESTING THE BOARD OF SUPERVISORS OF THE
LOS A14GELES COUNTY FLOOD CONTROL DISTRICT OF THE
STATE OF CALIFORNIA TO ACCEPT ON BEHALF OF SAID
DISTRICT A TRANSFER A14D CONVEYANCE OF STORM DRAIN
IMPROVEMEIM IQ40 N AS MTD 436
IN THE CITY OF West Covina
FOR FUTURE OPERATION, MAINIM,1ANCE, REPAIR AND
IMPROVEMENT, AND AUTHORIZE THE TRANSFER AND
CONVEYANCE THEREOF.
WHEREAS, there have been dedicated to, or the City has otherwise acquired,
the storm drain improvements and drainage system known as MTD 436
, described in Exhibit A attached hereto; and
WHEREAS, the City is authorized and enpowered to transfer and convey to the
Los Angeles County Flood Control District any stom drain improvements and
drainage systems for future operation, maintenance, repair, and improvement; and
WHEREAS, the City and the Los Angeles County Flood Control District entered
into an agreement dated February 2, 1982 , and recorded March 8,1982 ,
as Document Number 82-247855 , of the Official Records in the office of
the County Recorder for the County of Los Angeles, whereby the City made certain
warranties about its future transfers and conveyances of Flood Control facilities]
to the District; and

WHEREAS, the best public interest will be served by transfer and conveyance

of the storm drain improvements and drainage. system described in Exhibit A

attached hereto from the City to the Los Angeles County Flood Control. District

for future operation, maintenance, repair, and improvement.

NOW, THEREFORE, BE IT RESOLVED that the City does hereby request the

Los Angeles County Flood Control District to accept the transfer and conveyance
7
of the stoma drain improvements and drainage system described in said Exhibit A.

BE IT FURTHER RESOLVED that, subject to the acoeptanoe thereof of the Board

of Supervisors of the Los Angeles County Flood Control District, the City
10
Engineer is directed and ordered to prepare all neoessary instruments and
11
documents, including deed, to effectuate said transfer and oonveyance, and that

the Mayor is authorized and instructed to execute said deed and other instruments

and documents. District shall have no obligation or responsibility to maintain

said storm drain, improvements, and drainage until all rights of way for said

Reference is hereby made to District Drawings Nos. 275-589-F35.1-2 ,

the plans nand profile of said storm drain inproveme-nts and drainage system on

file in the offioe of the City Engineer and on file in the office of the Chief

Engineer of said District for further data as to the exact location, extent,

and description of said storm drain inprovements and drainage system.

BE IT FURTHER RESOLVED that the transfer and oonveyanoe hereby requested are
23
subject to each of the warranties described in the Agreodwnt between the City and
24
the District dated Feb. 2, 1932 , and recorded March 8, 1982 ,

as Document Number 82-247855 , of the Official Records in the office of

the County. Recorder for the County of Los Angeles. Such warranties by the City

A total of 1200 feet more or less of 36" R.C.P. and appurtenances extend-
ing from approximately the intersection of State Street and Glendora
Avenue, then northwesterly on State Street to Garvey Avenue South, then
westerly on. Garvey Avenue joining existing drain, Miscellaneous Transfer
Drain No. 181 on Vincent Avenue all in the City of West Covina, as shown
on District Drawing No. 275-589-F35.1-2, West Covina. Drawing No. 609-D.
