Resolution - 6909RESOLUTION NO. 6909 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING PLANNED COMMUNITY DEVELOPMENT NO. 1, AMENDMENT NO. 8, DEVELOPMENT PLAN NO. 33, TENTATIVE TRACT MAP NO. 43297 AND VARIANCE NO. 851 AND CERTIFYING THE NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT THEREFOR (Richard Greene Construction) THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, DOES RESOLVE AS FOLLOWS: WHEREAS, there were filed with the Planning Commission, verified applications on the forms prescribed in Chapters 20 and 26, Article XIII, Division 3 of the West Covina Municipal Code for the physical development of that certain property described as follows: That portion of Parcel 1, in the County of Los Angeles, State of California, as shown on a Record of Survey Map filed in Book 85, pages 10, 11 and 12, of Record of Surveys, and that portion of Pass and Covina Road, 60.00 feet • wide, as vacated by Resolution No. 5978, recorded August 24, 1979, as Instrument No. 79-947472, in the City of West Covina, County of Los Angeles, State of California, as shown on Tract No. 517, recorded in Book 15, page 16 of Maps, in the Office of the County Recorder of said County. WHEREAS, the Planning Commission, upon giving the required notice, did on the 6th day of June, 1984, conduct a duly advertised public hearing as prescribed by law to consider said application; and WHEREAS, studies and investigations made by the Planning Commission and in its behalf reveal the following facts: 1. In reviewing what the Planned Community Development is and what its intents are, the creation of the planned commun- ity was to provide for a wide range of housing types with related public facilities and shopping areas integrated therewith. The adopted Planned Community Development Master Plan, with text, sets forth standards which become the official document for development within this area. City Council Res. No. PCD-1, Amend. The revision to the Woodside Village Master Plan was • desired by both the Planning Commission and the applicant. 3. The applicant has submitted a development plan for the construction of eight units with an overall density of 8.79 dwelling units per acre. 4. The development plan is consistent with the adopted General Plan and Woodside Village Master Plan as amended. 5. The proposed project meets or exceeds the development standards of Woodside Village. 6. The developer will draft a Prospective Home Buyer's Aware- ness Package to better inform homeowners of existing and potential conditions. 7. Streets, roads, sewers and other improvements are adequate to accommodate the proposed development. 8. Findings for Approval of a Tentative Tract Map: a. The proposed map is consistent with applicable General and Specific Plans. b. The design or improvement of the proposed subdivision • is consistent with applicable General and Specific Plans. C. The site is physically suitable for the type of development. d. That the site is physically suitable for the proposed density of development. e. The design of the subdivision or the proposed improve- ments are not likely to cause substantial environ- mental damage or substantially and avoidably injure fish, wildlife or their habitat. f. The design of the subdivision or the type of improve- ments are not likely to cause serious public health problems. g. The design of the subdivision or the type of improve- ments will not conflict with easements acquired by the public at large for access through or use of property within the proposed subdivision. 9. Findings for Approval of a Variance: • a. That there are exceptional or extraordinary circum- stances not applicable generally to the other property or class of use in the same vicinity or zone. b. That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone but which is denied to the property in question. That the granting of such variance will not be mate- rially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. d. That the granting of such variance shall be consistent with the adopted General Plan and any applicable specific plans. 10. An initial study has revealed that, because of its compatibility with the surrounding Woodside Village Master Plan land use designations and developments, this project will have no significant effect on the environment, and a Negative Declaration of Environmental Impact has been prepared accordingly. WHEREAS, the Planning Commission, based on said findings, adopted Resolution No. 6-84-3321 recommending to the City Council approval of PCD-1, Amendment No. 8 and Resolution No. 6-84-3322 approving Development Plan No. 33, Tentative Tract Map No. 43297 and Variance No. 851; and WHEREAS, the City Council called up Development Plan No. 33, Tentative Tract Map No. 43297 and Variance No. 851; and WHEREAS, the City Council of the City of West Covina, did • on the 23rd day of July, 1984, conduct a duly advertised public hearing; and WHEREAS, as a result of said hearing, the City Council affirms the findings made by the Planning Commission and set forth in their Resolution No. 6-84-3321 and Resolution No. 6-84-3322. NOW, THEREFORE, BE IT RESOLVED, that subject PCD-1, Amend- ment No. 8, Development Plan No. 33, Tentative Tract Map No. 43297 and Variance No. 851 be APPROVED and the Negative Declaration of Environmental Impact therefor be CERTIFIED subject to the provisions of the West Covina Municipal Code, provided that the physical devel- opment of the herein described property shall conform to said Plan and the following conditions which, except as otherwise expressly indicated, shall be fully performed and completed or shall be secured by bank or cash deposit satisfactory to the Planning Director before the approval of the final map is granted by the City Council, and the violation of any of which shall be grounds for revocation of said tract map by the Planning Commission or City Council. The PCD-1, Amendment No. 8, Development Plan, Tentative Tract Map and Variance shall not be effective for any purpose until the owner of the property involved (or his duly authorized represen- tative) has filed at the office of the Planning Director his affi- davit stating he is aware of, and accepts, all conditions of this PCD-1, Amendment No. 8, Development Plan, Tentative Tract Map and Variance as stated below: • 1. Comply with Study Plan "A", dated June 6, 1984. 2. Comply with Tentative Tract Map No. 43297, dated June 6, 1984. City Council Res. No. PCD-1, Amend. No. 8, DP No. 33 TTM No. 43297, Var. No. 851 Richard F. Greene June 6, 1984 Page 4 3. Comply with Exhibits No. 1 and 2 (Floor Plan and • Elevations). 4. Comply with all applicable standards of the West Covina Municipal Code and the Woodside Village Master Plan and site development standards. 5. Submit a comprehensive landscaping and automatic irriga- tion plan to the Planning Director for review and approval prior to the issuance of any building permit. 6. All ground -mounted, wall -mounted and/or roof -mounted equip- ment not shown on the approved study plans shall be screened from public view in a manner that is architec- turally compatible with the main building. Plans and elevations indicating the type of equipment and method of concealment shall be submitted to the Planning Director for review and approval prior to the issuance of a building permit. No above -ground equipment shall be permitted in the front building setback area. 7. Provide 17 street trees, with tree wells and bubblers at approximate 35-foot intervals. 8. All utilities shall be installed underground. 9. The covenants, conditions and restrictions of the project • shall be submitted to the City Attorney for review and approval prior to the sale of any units. 10. The developer shall draft a Prospective Home Buyer's Aware- ness Package (PHAP). Such package shall include: a. A standardized cover sheet developed by the Planning Department; b. Zoning and General Plan information; c. School information; d. Special assessment district information; e. A copy of the Covenants, Conditions and Restrictions (C.C. & R.'s) applicable to the tract; f . B.K.K. information; and g. Any additional information deemed necessary by the Planning Department, Planning Commission or City Council for the full disclosure of important informa- tion. The draft PHAP shall be submitted to the Planning Director prior to recordation of the final tract map. 11. A continuous solid -screening wall shall be provided and maintained along the southwesterly property line at a height of eight feet adjacent to the westerly six units and four feet over the balance of said property line. Portions of said property line where the screening wall is less than eight feet in height shall be landscaped and City Council Res. No. PCD-1, Amend. No. 8, DP No. 33 TTM No. 43297, Var. No. 851 Richard F. Greene June 6, 1984 Page 5 maintained with appropriate plant materials at a height of . six feet. 12. Engineering Department Requirements: a. Comply with all conditions contained in Planning Resolution No. 567. b. Sanitary sewers shall be provided to each "lot"in compliance with Municipal Code Chapter 23, Article 2, and to the satisfaction of the City Engineer. C. Sidewalks, nine -feet wide with trees in tree wells shall be constructed along Pass and Covina Road and Lark Ellen Avenue adjacent to curb. d. Adequate provision shall be made for acceptance and disposal of surface drainage entering the property from adjacent area. e. Parking lot and driveway improvements on private property shall comply with Planning Commission Resolu- tion No. 2513 and be constructed to the City of West Covina Standards. f. Water service facilities for the City's Water_ Depart- ment shall be constructed in compliance with Municipal • Code Chapter 23, Article 3, and to the satisfaction of the City Engineer. These facilities shall be deeded to the City of West Covina. g. Private street improvements shall comply with Muni- cipal Code Chapter 19, Article 8, and Planning Commission Resolution No. 2519. h. Prior to issuance of a Building Permit, all of the following requirements shall be satisfied: i. A final grading and drainage plan showing existing and proposed elevations and drainage structures and showing existing and proposed on -site and off -site improvements shall be submitted to and approved by the Planning, Building and Engineering Departments. ii. Arrangements for the installation of street lights with underground wiring shall be made with Southern California Edison Company. At the time of installation, the applicant shall provide the necessary trenching and backfill. Submit two (2) sets of the subdivision and/or development plan to the Engineering Department, Traffic and • Lighting Section, to be used for designing the street lighting system. iii. A parking lot lighting plan showing electrolier types in conformance with City Standard Drawing T-33 and locations, average illumination levels, points of minimum illumination and photometric data in conformance with Planning Commission City Council Res. No. PCD-1, Amend. No. 8, DP No. 33 TTM No. 43297, Var. No. 851 Richard F. Greene June 6, 1984 Page 6 Resolution No. 2513 and as requested shall be • submitted to and approved by the City Engineer and Planning Director. iv. An itemized cost estimate for all on -site and off -site improvements to be constructed, except buildings, shall be submitted to the Engineering Department for approval. Based upon the approved cost estimates,.required fees shall be paid and improvement securities for all on -site and off -site improvements, except buildings, and 100% labor/material securities for all off -site improvements, shall be posted prior to final approval of the plans. i. The proposed subdivision shall conform to Municipal Code Chapter 20 - Subdivisions. 13. Building Department Requirements a. Comply with all requirements of the following Codes of the City and State: i. 1979 Uniform Building Code ii. 1979 Uniform Plumbing Code iii. 1979 Uniform Mechanical Code iv. 1978 National Electric Code • V. Title 24-25 State of California Energy/Insulation Regulations and Handicapped Persons Standards. vi. West Covina Security Ordinance 14. Fire Department Requirements: a. Provide 2,500 gpm fire flow for development. b. Driveway must support 20-ton vehicle weight. 15. Police Department Requirements: No requirements. FINALLY RESOLVED, that the City Clerk shall certify to the adoption of this Resolution.
