Resolution - 6842RESOLUTION NO. 6842 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING VARIANCE NO. 844 (Courtney Building Design) • The City Council of the City of West Covina, California, does resolve as follows: WHEREAS, there was filed with the City of West Covina, certified applications on the forms prescribed in Chapter 26, Article VI of the West Covina Municipal Code for the physical devel- opment of that certain property described as follows: Lot 2, Tract No. 33840; and WHEREAS, this variance is Categorically Exempt, Class 5, from the requirements of CEQA as minor alterations in land use limitations on a slope of less than 20 percent, which does not result in any changes in land use or density; and WHEREAS, hearings on said application were duly noticed and conducted by the Planning Commission on February 1, 1984, at which time said application was denied; and WHEREAS, the action of the Planning Commission was appealed to the February 27, 1984, City Council meeting for hearing and consideration; and WHEREAS, after proper and legal notice the City Council ___ held hearings on said Planning Commission action on March 26, • 1984; and WHEREAS, the applicant presented sufficient evidence re- lated to the case to show the following necessary findings for a variance have been met: a. There are exceptional circumstances not applicable gen- erally to other property in the same vicinity and zone, in that the proposed residence is approximately 100 feet long and has over 6,800 square feet of floor space which is four and one -quarter times the minimum size required in Area District IV. b. This variance is necessary for the enjoyment of the prop- erty right possessed by others in the same vicinity and zone to have architectural features and appurtenances appropriate for a building's size, length and character. C. Granting of a variance that has been found to be necessary for the enjoyment of property rights enjoyed by others and has exceptional circumstances to warrant the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which the subject property is located. • d. zoning regulations are implemental tools of the General Plan. Approval of a variance processed through a public hearing as prescribed by the zoning regulations implements the General Plan and, therefore, does not adversely affect the General Plan. tsr I NOW, THEREFORE, BE IT RESOLVED, that the findings and deci- sion in Planning Commission Resolution No. 2-84-3300 be set aside and the City Council does hereby APPROVE the requested variance sub- ject to the following conditions, the violation of any one (1) of which shall be grounds for revocation of variance by the Planning Commission or City Council: • 1. Comply with Study Plan "A" dated February 1, 1984. 2. Comply with Exhibits 1 through 4 (elevations). 3. The building height shall not exceed 40.75 feet or 38.5 feet when measured from the grade of the front of the building. 4. The building shall have no more than two (2) stories except for the third floor library and clerestory, vertical skylight. FINALLY RESOLVED, that the City Clerk shall certify to the adoption of the resolution. ADOPTED and APPROVED this 26th day of March, 1984.
