Resolution - 6777RESOLUTION NO. 6777 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, FINDING AND DETERMINING THAT THE PUBLIC INTEREST, CON- VENIENCE AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN REAL PROPERTY FOR STORM DRAIN PUR- POSES AND ALL USES APPURTENANT THERETO. THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA., DOES HEREBY DETERMINE AND RESOLVE AS FOLLO1"7S: • SECTION 1. That the City Council of the City of West Covina does hereby find, determine, and declare that the public interest, convenience, and necessity require the acquisition by said City of fee interests in and to certain hereinafter described real property for storm drain purposes and all uses appurtenant thereto. That the project is planned or located in the manner that will be most compatible with the greatest public good and the least private injury; That the taking of the interest of said property as above described is necessary to such use and is authorized by Section 19, Article I, of the California Constitution, Section 37350.5 of the California Government Code, Sections 1240.010 through 1240.050 of the California Code of Civil Procedure. SECTION 2. That the City Council of the City of West Covina does hereby declare that it is the intention of said City to acquire said property in its name in accordance with the pro- visions of the laws of the State of California with reference to condemnation procedures. Said City has made an offer to acquire said real property as required by Section 7267.2 of the Govern- ment Code. • SECTION 3. That said real property hereinabove referred to the acquisition of which is required by said public interest, convenience, and necessity for the purposes set forth in Section 1, hereof, is located in the County of Los Angeles, State of California, and is more particularly described in Exhibit "A" which is attached hereto and incorporated herein by reference and made a part hereof. A map showing the general location of the property sought to be acquired in this proceeding is marked Exhibit "B" attached hereto and incorporated herein by ref- erence and made a part hereof. SECTION 4. That the City Attorney and the firm of BURKE, WILLIAMS AND SORENSEN are hereby employed as special counsel and are authorized and directed to prepare, institute, and prosecute in the name of the City of West Covina such proceedings in the proper court having jurisdiction thereof as may be necessary for the acquisition of said real property described in Section 3 hereof. SECTION 5. That the City Clerk shall certify to the passage and adoption of this resolution, shall enter the same in the book of original resolutions of said City, shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City in the minutes of the meeting at which the same is passed and adopted. • SECTION 6.
