Resolution - 6767RESOLUTION NO. 6767 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA RELATING TO CABLE . TELEVISION FRANCHISE AWARD NEGOTIATIONS WITH FALCON CABLE TV u 0 WHEREAS the City has adopted Article II of Chapter 11 of the West Covina Municipal Code relating to the regulation of franchises for community antenna television systems; and WHEREAS pursuant to the provisions of Section 11-21 of said Chapter, the City Council may in its discretion, deter- mine the award of a cable television franchise upon either those terms and conditions specified in the resolution of intent to grant same, or upon terms and conditions different than those so specified; and WHEREAS it is the intent of the Council to negotiate the final terms and conditions prior to such an award; NOW THEREFORE, the City Council of the City of West Covina, California does resolve as follows: SECTION 1. The City Manager and/or his designee(s) and the City's Independent Cable Television Consultant are hereby authorized to enter into negotiations with representatives of Falcon Cable Television Company, to finalize the terms and conditions of the cable television franchise. SECTION 2. Such negotiations shall not exceed a time period of more than ninety (90) days from this date, and, prior to that time, the final terms and conditions for award of the cable television franchise shall be presented to City Council for final approval. SECTION 3. In the event negotiations between the City's representatives and representatives of Falcon Cable Television Company are not concluded to the satisfaction of the City prior to the time indicated in Section 2., such indication shall be presented to the City Council for final determination, in which case the Council may elect to do one of the following: A. extend the time. for B. deny the franchise Television Company C. authorize the City neaotiations with Company. further negotiations award to Fal con Cable representatives to enter into Fal con Cable Television SECTION 4. In the event negotiations between the City's representatives are concluded prior to the deadline specified and the terms and conditions agreed to between city representatives and any cable company represented in this resolution are deemed agreeable to the City Council, the City Council will adopt an Ordinance pursuant to Article II, Chapter 11, of the West Covina Municipal Code, awarding the cable television franchise to that company so specified in the Ordinance. f SECTION 5.
