Resolution - 6730c RESOLUTION NO. 6730 • A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, FINDING THAT AN EMERGENCY EXISTS IN CONNECTION WITH THE FAILURE OF THE TRAFFIC SIGNAL CONTROLLER AT THE INTERSECTION OF VINCENT AVENUE AND SOUTH GARVEY AVENUE AND AUTHORIZING THE WAIVER OF COMPETITIVE BIDDING PROCEDURES TO PERMIT THE EMERGENCY PURCHASE OF A REPLACEMENT TRAFFIC SIGNAL CONTROLLER. WHEREAS, the City maintains and operates a.traffic signal system at the intersection of Vincent Avenue and South Garvey Avenue; and WHEREAS, said intersection has traffic volumes and turning movements that are among the heaviest in the city; and WHEREAS, the complexity of traffic movements in the intersection requires a high level of performance from the traffic signal equipment controlling those movements; and WHEREAS, failure of the traffic signal equipment to operate properly creates conditions that could be hazardous to the public using this inter- section whether as drivers or pedestrians; and • WHEREAS, it is extremely difficult to properly control traffic during peak periods using police officers; and WHEREAS, adequate, reliable, temporary replacement equipment to operate the traffic signal for an extended period is not available to City personnel; and WHEREAS, the period of time necessary to design, competitively bid and construct a replacement installation would require an estimated period of eight (8) months; and WHEREAS, the present traffic signal equipment is obsolete and cannot be repaired to assure future reliability of operation; and WHEREAS, the availability of spare parts in the event of further malfunctions is highly questionable; and WHEREAS, present environmental conditions under which the equipment operates is conducive to further failures of said equipment; and WHEREAS, continued operation on a temporary basis for said period of time could constitute a calamity for public traffic and create a dangerous condition for the safety of the public; and WHEREAS, if competitive bidding procedures are waived, a replacement traffic signal controller can be obtained and installed within a period of • from six (6) to eight (8) weeks; and WHEREAS, it would be impractical, useless, or uneconomical in this instance to follow the competitive bid procedures and that the public welfare would be promoted by dispensing with the same. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of West Covina, California, does hereby authorize the waiver of competitive • bidding procedures pursuant to the provisions of Section 2-330 of the West Covina Municipal Code and Section 20168 of the Public Contract -: ­ Code to permit the emergency purchase of a replacement traffic signal con- troller for the intersection of Vincent Avenue and South Garvey Avenue so as to avoid a public calamity and a dangerous condition at said intersection. The City Clerk shall certify to the adoption of this resolution. • APPROVED AND ADOPTED this 27th day of June , 1983.
