• A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
WEST COVINA, CALIFORNIA, FINDING AND DETERMINING
THAT THE PUBLIC INTEREST, CONVENIENCE AND
NECESSITY REQUIRE THE ACQUISITION OF CERTAIN
REAL PROPERTY FOR OPEN SPACE, TRAFFIC SAFETY AND
DRAINAGE PURPOSES AND ALL USES APPURTENANT
THERETO.
THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA,
DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS:
SECTION 1. That the City Council of the City of West
Covina does hereby find, determine, and declare that the public
interest, convenience, and necessity require the acquisition
by said City of fee interests in and to certain hereinafter
described real property for open space, traffic safety and
drainage purposes and all uses appurtenant thereto.
That the project is planned or located in the manner
that will be most compatible with the greatest public good
and the least private injury;
That the taking of the interest of said property as
above described is necessary to such use and is authorized by
is Section 19, Article I, of the California Constitution, Section
37350.5 of the California Government Code, Sections 1240.010
through 1240.050 of the California Code of Civil Procedure.
SECTION 2. That the City Council of the City of West
Covina does hereby declare that it is the intention of said
City to acquire said property in its name in accordance with
the provisions of the laws of the State of California with
reference to condemnation procedures. Said City has made an
offer to acquire said real property as required by Section
7267.2 of the Government Code.
SECTION 3. That said real property hereinabove referred
to the acquisition of which is required by said public interest,
convenience, and necessity for the purposes set forth in
Section 1 hereof, is located in the County of Los Angeles,
State of California, and is more particularly described in
Exhibit "A" which is attached hereto and incorporated herein
by reference and made a part hereof. A map showing the general
location of the property sought to be acquired in this pro-
ceeding is marked Exhibit "B" attached hereto and incorporated
herein by reference and made a part hereof.
SECTION 4. That the City Attorney and the firm of
BURKE, WILLIAMS AND SORENSEN are hereby employed as special
counsel and are authorized and directed to prepare, institute,
• and prosecute in the name of the City of West Covina such
proceedings in the proper court having jurisdiction thereof
as may be necessary for the acquisition of said real property
described in Section 3 hereof. Said counsels are also
authorized and directed to obtain an Order of Court granting to
said City the right of immediate possession and occupancy of
said property.
SECTION 5. That the City Clerk shall certify to the
passage and adoption of this resolution, shall enter the
same in the book of original resolutions of said City, shall
make a minute of the passage and adoption thereof in the
• records of the proceedings of the City Council of said City
in the minutes of the meeting at which the same is passed and
adopted.
SECTION 6. This resolution shall be effective
immediately.

That portion of Gemini Street, 60.00 feet wide, in the City of West
Covina, in the County of Los Angeles, State of California, as shown
on Tract Map No. 28406 per map recorded. in Book 866, Pages 21, 22,
23 and 24 of Maps on file in the office of the County Recorder of
said County, and as described in deed recorded January 17, 1969 as
Document No. 2706 of Official Records, bounded as follows:
Bounded westerly by a line that is parallel with and 60.00 feet
easterly, measured at right angles, from the westerly boundary
line of said Tract 28406 and its southerly prolongation;
bounded easterly the following described line: Beginning at
the southeasterly corner of Parcel 1 of Parcel Map No. 7401
per map recorded in Book 74, Pages 43 and 44 of Parcel Maps
of Official Records of said County, said corner being on a
• curve concave northeasterly and having a radius of 45.00 feet,
a radial line to said corner bears North 75 degrees, 51 minutes,
22 seconds west; thence southerly and southeasterly, along said
curve through a central angle of 115 degrees 00 minutes 00
seconds and an arc length of 90.32 feet to a radial line that
bears south 10 degrees 51 minutes 22 seconds east; thence
southerly, along last mentioned radial line, to the southerly
line of said Gemini Street.
