RESOLUTION NO. 6683
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF WEST COVINA DEMANDING THAT THE STATE DE-
PARTMENT OF HEALTH SERVICES NOTICE AND HOLD
A PUBLIC HEARING PURSUANT TO HEALTH AND SAFETY
CODE SECTION 25149
WHEREAS, in March of 1983, the State Department of Health Services,
in cooperation with the California Air Resources Board and the South Coast
Air Quality Management District, issued a report: Ambient Air Monitoring
and Health Risk Assessment for Suspect Human Carcinogens Around the BKK
Landfill in West Covina; and
WHEREAS, on April 7, 1983, representatives of the State Department
of Health Services held a public meeting in the City of West Covina to
discuss said report; and
WHEREAS, said report and the information presented at the public
meeting have raised serious questions as to the risk to the health and environ-
ment of the residents of West Covina; and
WHEREAS, the State Department of Health Services has the:,.authority
and responsibility'to determine, after a noticed public hearing, whether or
not the operation of the BKK facility may present an imminent and substantial
endangerment to health and environment (Health and Safety Code ® 25149);
NOW, THEREFORE, the City Council of the City of West Covina hereby
finds and declares and resolves:
• 1. That in light of the State report on Ambient Air Monitoring
and Health Risk Assessment for Suspect Human Carcinogens Around the BKK
Landfill in West Covina and the questions raised at the public meeting on
April 7, 1983, the State Department of Health Services is required to notice
and hold a public hearing and determine whether the operation of the BKK
facility may present an imminent and substantial endangerment to health
and environment of the residents of the City of West Covina.
2. That the City Council of the City of West Covina on behalf of
itself and the residents of the City, hereby demands that the State Department
of Health Services notice and hold a public hearing pursuant to Health and
Safety Code Section 25149, and determine whether the operation of the BKK
facility may present an imminent and substantial endangerment to the health
and environment of the residents of the City of West Covina.
3. That the staff and the City Attorney are hereby authorized and
directed to take all appropriate actions necessary to insure that the State
Department of Health Services holds the hearing in accordance with applicable
law.
