A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
WEST COVINA, CALIFORNIA, DENYING AMENDMENT NO. 174
TO THE WEST COVINA MUNICIPAL CODE, CHAPTER 26, ARTICLE
XI, SECTION 26-597 TO PERMIT COMMUNITY RE-ENTRY CENTERS
IN THE LOW -DENSITY MULTIPLE -FAMILY, MF-15, ZONE. I
The City Council of the City of West Covina does resolve as
• follows:
WHEREAS, application was made by Glen Cornist pursuant to
Section 26-153 to amend Chapter 26 of the West Covina Municipal Code to
establish Community Re-entry Growth Centers under the direction of the
State Department of Corrections as a permitted use in the MF-15 Zone; and
WHEREAS, pursuant to Chapter 26, Article III and the requirements
of the California Environmental Quality Act of 1970, City staff did analyze
and study the proposal and prepared related reports and a Draft Environ-
mental Impact Report (DEIR); and
WHEREAS, studies and investigations made by this Council and
in its behalf reveals the following facts:
1. The proposed amendment constitutes a substantial change in land
use not similar or consistent with land uses currently existing
or permitted by Code in the MF-15 Zone.
2. The proposed amendment will have an adverse affect on property
in the MF-15 Zone as'to value or land use precendent and will be
detrimental to such residential zones.
3. The granting of the ordinance amendment will not be in the
interest or furtherance of public health, safety and general
• welfare.
4. The granting of the ordinance amendment will adversely affect
the goals of.the comprehensive General Plan adopted by the City.
5. The granting of the ordinance amendment is not consistent with
the General Plan or Specific Plans.
6. A Draft Environmental Impact Report was prepared in accordance
with CEQA and reveals a number of impacts that would occur as
a result of.the project related to human health, demanded
increase in public services and other impacts which could not
be significantly mitigated to reduce impacts to the community
environment; and
WHEREAS, the Planning Commission, upon giving the required notice,
did on the 18th day of August, 1982, conduct a public hearing and adopted
Resolution No. 8-82-3174 recommending that the City Council deny Amendment
No. 174 and certify the Draft Environmental Impact Report prepared by staff.
NOW, THEREFORE, BE IT RESOLVED, that the City Council does hereby
adopt a resolution denying Ordinance Amendment No. 174 and Certifying the
Draft Environmental Impact Report related thereto.
FINALLY RESOLVED, that the City Clerk shall certify to the
adoption of this resolution.
