Resolution - 6525RESOLUTION NO. 6525 A RESOLUTION OF THE CITY COU14CIL OF THE CITY OF WEST COVINA GRANTING A VARIANCE (Variance Application No. 823 SWK Enterprises) The City Council of the City of West.Covina does resolve as follows: SECTION 1. It is hereby found and determined that the application of SWK Enterprises for a variance to permit identification signs 16 inches high not to exceed 60 percent of lease frontage on the second floor in a shopping center located on the northeast corner of Aroma Drive and Azusa Avenue in the N-C .(Neighborhood -Commercial) zone and more particularly described in Variance Application No. 823, was duly made, that a hearing thereon was duly held by the Planning Commission after legal notice thereof, that the Planning Commission denied said variance by its Resolution.No.. 2-82-3147, that said action was appealed to the City Council, and the. City Council has held a hearing thereon after legal notice thereof. SECTION 2. It is hereby found by the City Council that: (a) There are exceptional circumstances applicable to the property which distinquish it from other properties in the same area in that the building is not a typical office building having its own iden- tifying features easily recognized by the public and is located in and is a part of a shopping center rather than an office complex. (b) This variance is necessary to allow the tenants of the second floor offices to have exposure to the public equivalent to other offices and stores in the shopping center and offices located in land- mark type office buildings. • (c) Granting of this variance will not be.materially detri- mental to the public welfare or injurious to property in the vicinity and will aid the public to locate establishments they may be seeking. (d) Signage adjudged to be appropriate to circumstances will not reduce the quality of the visual environment and will not adversely affect the attainment of the goals of the Comprehensive General Plan. SECTION 3. A variance is hereby granted as applied for in Variance Application No. 823. " It is granted upon,.the following conditions., the violation of any one of which shall be grounds for the revocation of this variance by the Planning Commission or the City Council. 1. Second floor signs shall be identifying type only. 2. Second floor signs shall be no higher than 16 inches and shall not exceed 60 percent of the lease frontage of the store or office that it identifies. 3. Any provision of this sign ordinance not waived as part of this Variance must be met. 4. The signs shall be compatible and coordinated with the balance of the signs for the shopping center as to colors and style subject to the approval of the Planning Director. • SECTION 4. The City Council hereby finds that the improvement project for which the variance is granted is categorically exempt under the provisions of the California Environmental Quality Act. SECTION 5. The City Clerk shall certify to the adoption of this resolution. Adopted and approved this loth day of May , 1982.
