Resolution - 6518RESOLUTION NO. 6518 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, DECLARING ITS INTENTION TO VACATE A CERTAIN PORTION OF BARRANCA STREET, SUBJECT TO THE RESERVATION AND EXCEPTION OF CERTAIN RIGHTS AND EASEMENTS. The City Council of the City of West Covina does resolve as follows: SECTION 1. The City Council of the City of West Covina, does hereby declare its intention to vacate a certain portion of Barranca Street in the City of West Covina as shown on a map or plan on file in the office of the City Engineer to which ref- erence is made for -further particulars, described as follows: That portion of Barranca Street being a portion of Lot 8 in block 26 of the City of West Covina, County of Los Angeles, State of California, as per map recorded in book 9 pages 3 and 4 of miscellaneous Records on file in the office of the County Recorder of said County, bounded as follows: Bounded northwesterly by the northwesterly line of Barranca Street (66.00 feet wide) as described in the deed to the County of Los Angeles and recorded on November 28, 1934, as Instrument No. 766 in book 13072 page 328 of official records on file in the office of said County Recorder; bounded easterly by the northerly prolongation of that certain course described as South 0 09.' 58" East, 142.43 feet in the deed to the State of California, recorded on • January 29, 1957, as Instrument No. 1307 in book 53494 page 152 of said official records; bounded southerly by the northerly line of that certain portion of Barranca vacated by.the City of West Covina described in Resolution No. 3765, recorded on April 5, 1968 as Document No. 2722 in Book D 3962 Page 671 of Official Records. RESERVING AND EXCEPTING ALSO from said vacation the permanent easement and right at any time., or from time to time, to con- struct, maintain, operate, replace, remove`, and renew sanitary sewers, and appurtenant structures thereof and to construct, maintain, operate, replace, remove, renew, and enlarge lines of pipe, conduits, cables, wires,'poles, and. other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, and traffic control pur- poses and for transportation control or -'distribution of electric energy and water lines, including access and the right to keep the property free from inflammable materials, and wood growth, and otherwise protect the same from all hazards in, upon, and over the street or part thereof proposed to be vacated. The City Council does hereby determine that the.public convenience and necessity require the reservation of the rights, easements, and rights -of -way enumerated above. These proceedings for the vacation of said portion of Barranca Street are taken subject to such reservations and exceptions. SECTION 2. The City Council of the City of West Covina does hereby elect to proceed to vacate the said portion of said street under the provisions of Part 3, Division 9 of the Streets and I-Tighways Code of the State of California. W SECTION 3. The hour of 8:00 P.M. on Monday, the 24th day of May, 1982, is hereby fixed as.the time and the Council Chambers in the City Hall at 1444 West Garvey Avenue South, West Covina, is hereby fixed as the place for hearing all persons interested in or objecting to the proposed vacation of said portion of said street. SECTION 4. Notices of Street Vacation shall be posted by the State Superintendent in the manner prescribed by Section 8322 of the Streets and Highways Code of the State of California. SECTION 5. The City Clerk shall certify to the adoption of this resolution and shall cause the same to be published within fifteen days of its adoption in one regular issue of the West Covina Tribune, a newspaper of general circulation, printed, published, and circulated in the City of West Covina.
