A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF WEST COVINA, AMENDING
THE DESTRUCTION OF OBSOLETE RECORDS
• POLICY FOR THE WEST COVINA POLICE
DEPARTMENT BY APPROVING THE DESTRUC-
TION OF RECORDINGS OF..1 TELEPHONE AND
RADIO COMMUNICATIONS AFTER 100 DAYS
WHEREAS, in 1981, by Resolution No. 81-60, the City
Council established a Destruction of Obsolete Records Policy
for the West Covina Police Department; and
WHEREAS, at the time of the adoption of said Policy,
Section 34090 et seq. of the Government Code required that
public records be maintained for not less than two (2) years;
and
WHEREAS, subsequent to the adoption of said Policy,
Section 34090.6 was added to the Government Code to provide
that with the approval of the City Council and with the written
consent of the City Attorney, recordings of telephone and radio
communications could be destroyed after 100 days; and
WHEREAS, Section 34090.6 became effective on January 1,
1982; and
WHEREAS, the City Attorney has reviewed and has approved
in writing the amendment to the Police Department's Destruction
of Obsolete Records Policy in accordance with the provisions of
Section 34090.6.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WEST COVINA AS FOLLOWS:
Section 1. The West Covina Police Department's Destruction
of Obsolete Records Policy is hereby amended by adding Schedule 7
as Subsection G of Section III as follows:
G. Schedule 7. The following records must be kept for at
least one hundred (100) days, after which they may be destroyed;
1. Recordings of telephone and radio communications,
except that in the event such recordings are evidence in any
claim filed or litigation pending, the same shall be preserved
until the claim or litigation is resolved.
Section 2. The West Covina Police Department's Destruction
of Obsolete Records Policy is hereby amended by adding the
definition of records of telephone and radio communications.to
the CATEGORIES OF RECORDS as follows:
RECORDINGS OF TELEPHONE AND RADIO COMMUNICATIONS:
• The routine daily tapings and recordings of telephone
communications to and from the Department and all radio communications
relating to operations of the Department.

Section 3. The City Clerk shall certify to the passage and
adoption of this Resolution and the same shall thereupon take
effect and be enforced.
