A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF WEST COVINA, CALIFORNIA
RESCINDING RESOLUTIONS NO. 6345 AND
6349 WITH RESPECT TO THE FORMATION OF
A SPECIAL ASSESSMENT AREA FOR THE
CENTRAL BUSINESS DISTRICT REDEVELOPMENT
PROJECT; TERMINATING ALL FURTHER
PROCEEDINGS WITH RESPECT THERETO;
AUTHORIZING THE CITY CLERK TO PROVIDE
NOTICE OF SAID RESCISSION AND TERMINA-
TION; AND APPROVING AND'AUTHORIZING
THE EXECUTION.OF THE WAIVER BY THE CITY
OF ITS RIGHT TO LEVY OR COLLECT CERTAIN
SPECIAL ASSESSMENTS

WHEREAS, the City Council, at its regular meeting of May 11,
1981, approved Resolution No. 6345 providing for the declaration
of intention of the City to form a Special Assessment Area for
the Central Business District Redevelopment Project and to
levy special assessments on properties located therein; describing
the Special Assessment Area and specifying the proposed assessments;
and providing for a hearing to be held thereon; and .
WHEREAS, the City Council, subsequently adopted Resolution
No. 6349 changing the date of said hearing and the method of
• publishing notice with respect to said hearing; and
WHEREAS, the Redevelopment Agency of the City of West Covina
has approved that certain Supplement to Management Agreement
with Carter, Hawley, Hale Stores, Inc., Federated Department
Stores, Inc., J.C. Penney Properties, Inc., and Sylvan S. Shulman
Company (the "REA parties") providing for the payment to the
Agency of fees for the use of the West Covina Fashion Plaza
automobile parking area subject to receipt by the Agency of an
executed counterpart of said agreement from each REA party;
NOW, THEREFORE, the City Council of the City of West Covina
does RESOLVE, DECLARE, FIND, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. The City Council hereby rescinds Resolutions
No. 6345 and 6349 and said Resolutions shall, as of the effective
date of this resolution be of no further force or effect.
SECTION 2. Any and all further proceedings with respect to
the formation of a Special Assessment Area for the Central
Business District Redevelopment Project shall be terminated.'
SECTION 3. The City Clerk shall cause to be published in
the San Gabriel Valley Tribune, a newspaper published and
circulated in the City of West Covina, a notice of said
rescission and termination of proceedings with respect to the
formation of a Special Assessment Area, shall further give notice

by mailing to any persons who have heretofor been provided by the
City with'Notice of Hearing pertaining to the formation of said
Special Assessment Area.
SECTION 4. The City Council hereby approves the waiver by
the City of West Covina of its right to levy or collect special
assessments on property of the REA parties, as set forth in said
Agreement, and authorizes the execution of the waiver by the
Mayor, subject to the execution of said Agreement by the
Redevelopment Agency.
SECTION 5. The City Clerk shall certify to the adoption of
this Resolution upon execution of said Agreement by each of the
REA parties and the Redevelopment Agency and thenceforth and
thereafter the same shall be in full force and effect.
