RESOLUTION NO. 6349
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA
CALIFORNIA, AMENDING RESOLUTION NO. 6345 PROVIDING FOR THE
CHANGE OF THE DATE AND TIME OF A HEARING AND THE METHOD OF
PUBLISHING NOTICE OF SAID HEARING, WITH RESPECT TO THE FORMA-
TION OF A SPECIAL ASSESSMENT AREA FOR THE CENTRAL BUSINESS
is DISTRICT REDEVELOPMENT PROJECT.
WHEREAS, the City Council, at its regular meeting of May 11, 1981,
approved Resolution No. 6345 providing for the declaration of intention of
the City to form a Special Assessment Area for the Central Business District
Redevelopment Project and to levy special assessments on properties located
therein; describing the Special Assessment Area and specifying the proposed
assessments; and providing for a hearing to beheld thereon; and
WHEREAS, Section 6 of said Resolution No.. 6345 provides for the
date and time of a hearing; and
WHEREAS, Section 8 of said Resolution.No. 6345 provides for the
method of publishing notice of said hearing; and
WHEREAS, the City Council desires to change the date of said
hearing and the method of publishing notice with respect to said hearing.
NOW, THEREFORE, the City Council of the City of West Covina
does RESOLVE, DECLARE, FIND, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. The date and time for the hearing on the Resolution of
Intention with respect to the formation of a Special Assessment Area for the
Central Business District Redevelopment Project is hereby changed from
June 22, 1981 at 8:00 p.m. to July 13, 1981 at 8:00 p.m.
SECTION 2. Exhibit D - "Notice of Hearing" attached to Resolution g ut on
No. 6345 shall be changed to conform to the amended date and time.
SECTION 3. Section 8 of Resolution No. 6345 shall be amended to
read as follows:
"The City Clerk shall cause the Notice of Hearing attached hereto
and incorporated herein as Exhibit "D" to be published twice in
the San Gabriel.Valley Tribune, a newspaper published and
circulated in the City of West Covina, the first publication
shall be not less than twenty (20) days prior to July 13, 1981,
the date of said hearing. The City Clerk shall further give
notice by mailing and posting in the manner and with other ..
documents as required and established by Law."
SECTION 4. No other changes in said Resolution No. 6345 are made
with respect to all other matters contained therein; Resolution No. 6345
shall remain in full force and effect.
Section 5. The City Clerk shall certify to the adoption of this
Resolution and thenceforth and thereafter the same shall be in full force
and effect.

NOTICE OF HEARING BY THE CITY COUNCIL OF THE CITY
OF WEST COVINA,- CALIFORNIA ON THE FORMATION OF A
SPECIAL ASSESSMENT AREA FOR THE' CENTRAL BUSINESS
DISTRICT REDEVELOPMENT PROJECT AND THE LEVY OF
• SPECIAL ASSESSMENTS ON PROPERTIES LOCATED
THEREIN.
NOTICE IS HEREBY GIVEN that the City Council of the City of West Covina,
California will conduct a hearing on the formation of a Special Assessment Area for
the Central Business District Redevelopment Project and the levy of special
assessments on properties located therein pursuant to Section 33800 et seq. of the
Health and Safety Code of the State of California, at 8:00 P.M. on July 13,19810 in the
City Council Chambers, City Hall, 1444 West Garvey Avenue, West Covina, California
91790.
At the time and place specified above, any person may appear before the City
Council and object to the formation of the Special Assessment Area and the levy of
special assessment on properties located therein.
Purpose: The 'City Council of the City of West Covina adopted the
Redevelopment Plan for the Central Business District Redevelopment Project on
December 20, 1971. The Project area comprises some 230 acres in the central part of
the City. The West Covina Redevelopment Agency (the "Agency") has the
responsibility for carrying out the Project. In connection with carrying out the Project
the Agency has undertaken such activities as assembly and disposition of land,
demolition and site clearance, public improvements, and others to eliminate blight and
make land available for revitalization and expansion of the West Covina Fashion Plaza
Shopping Center. To meet its costs in connection with redevelopment of the shopping
• center, the Agency issued bonds and incurred other financial obligations before July 1,
1978 which it expected to repay withproperty tax increments attributable to new
private investment resulting from the Agency's .activities. However, the amount of
property tax increments available to repay Agency debts has now been reduced below
the amounts needed by the Agency to meet. these already incurred bond and other
financial obligations....
The purpose of the hearing by the City Council is to consider the formation of a
Special Assessment Area and the levy of special assessments on properties located
therein which are specially benefited by the Agency's redevelopment activities with
respect to those properties, in order to obtain supplemental revenues to be used for
the payment of indebtedness incurred by the Agency before July 1, 1978.
A Report on the Special Assessment Area for the Central Business District
Redevelopment Project filed with the City Council by the Agency on May U, 1981,
describes in more detail the debt incurred by the Agency, the revenues available to
pay the debt and the insufficiency of funds, the applicable redevelopment activities,
and other information regarding the proposed Special Assessment Area.
The Report, the Resolution of the City Council declaring the intention of the
City to form a Special°Assessment Area, and copies of the contracts, agreements and
other documents creating the Agency's indebtedness, are on file and available for
public review and copying in the office of the City Clerk, City Hall, 1444 West Garvey
Avenue, West Covina, California 91790.
Total Estimated Payments Required: The total estimated payments of principal
and interest and other payments required to meet outstanding obligations incurred by
the Agency before July 1, 1978 is $25,617,000.00
Annual Assessment: The amounts to be assessed annually against each Special
Assessment Parcel within the Special Assessment Area are as follows:

Filing Protests: Any owner of property within the proposed Special Assessment
Area may protest the formation of the Special Assessment Area, the extent thereof,
or the proposed assessment by filing a written protest with the City Clerk, City Hall,
1444 West Garvey Avenue, West Covina, California 91790, at or before the time set for
the hearing. Such written protest must contain a description of the property owned by
the person making the protest which is sufficient to identify the property and must be
signed by the property owner. If the signer of the written protest is not shown on the
last equalized assessment roll as the owner of such property, the protest shall contain
or be accompanied by written evidence that such signer is the owner of such property.
If written protests are filed against the Special Assessment Area by the owners of
more than one-half of the area of the property included within the proposed Special
Assessment Area, all further proceedings to form the Special Assessment Area are
barred unless the City Council overrules the protests by an affirmative vote of four -
fifths of its members.
Residential Dwellings: The proposed Special Assessment Area includes no
property whatsoever containing residential dwelling units.
Special Assessment Diagram: The accompanying Special Assessment Diagram
shows the properties which are included within the boundaries of the proposed Special
Assessment Area. The Special Assessment Parcel Nos. shown on the Diagram
• correspond to those contained in the schedule of amounts to be assessed annually
against each such Special Assessment Parcel as shown in this Notice.
