Resolution - 6345E • • RESOLUTION NO. 6345 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA DECLARING THE INTENTION OF THE CITY TO FORM A SPECIAL ASSESSMENT AREA FOR THE CENTRAL BUSINESS DISTRICT REDEVELOPMENT PROJECT AND TO LEVY SPECIAL ASSESSMENTS ON PROPERTIES LOCATED THEREIN; DESCRIBING THE SPECIAL ASSESSMENT AREA AND SPECIFYING THE PROPOSED ASSESSMENTS; AND PROVIDING FOR A HEARING TO BE HELD THEREON WHEREAS, the California Community Redevelopment Law (Section 33800 et seq, of the Health and Safety Code of the State of California) authorizes the establishment of special assessment areas within redevelopment project areas and the levy of special assessments on properties within such special assessment areas to obtain supplemental revenues to be used for the payment of indebtedness incurred prior to July 1, 1978; and WHEREAS, the West Covina Redevelopment Agency has determined that, in the opinion of the Agency Board, there will be insufficient tax revenues alloca- ted to the Agency to pay its incurred indebtedness; and WHEREAS, the Agency has filed with this City Council a Report on the Special Assessment Area for the Central Business District Redevelopment Project pursuant to Section 33821 of the California Community Redevelopment Law; and WHEREAS, the Agency has requested that this City Council proceed with the formation of a Special Assessment Area and levy special assessments on proper- ties in the Special Assessment Area; and WHEREAS, the members of this City Council have reviewed and considered the information contained in the Report on the Special Assessment Area. NOW; THEREFORE, the City Council of the City of West Covina does RESOLVE, DECLARE, FIND, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. The City Council hereby declares the intention of the City to form the Special Assessment Area for the Central Business District Rede- velopment Project and to levy special assessments on properties located therein to provide supplemental revenues for the purpose of making payments on the indebtedness when due. SECTION 2. The exterior boundaries of the proposed Special Assessment Area are described as all property within the City of West Covina, County of Los Angeles, contained within those certain County Assessor's Parcels designated and illustrated on the Special Assessment Diagram attached hereto and incorporated herein as Exhibit "A". SECTION 3. The estimated annual amounts needed to be levied on the properties within the Special Assessment Area for the purpose of making payments on the indebtedness when due are as shown on the Schedule of Estimated Annual Amounts Needed to be Levied attached hereto and incorporated herein as Exhibit "B". The period during which such special assessments will be required is eight (8) years, during fiscal years 1981-82 through 1988-89, inclusive.. SECTION 4. The proposed assessments to be levied against each par- cel of property within the Special Assessment Area are as shown on the Schedule of Proposed Assessments attached hereto and incorporated herein as Exhibit "C". SECTION 5. The Report on the Special Assessment Area for the Central Business District Redevelopment Project filed by the Redevelopment Agency of the City of West Covina on May 11, 1981, is hereby incorporated by reference and made a part hereof as fully as if set out at length. The City Council calls and gives notice that a hearing on • Area and the levy of a special assessment Assessment Area will be held: DATE: June 22, 1981 TIME: 8:00 P.M. of the City of West Covina hereby the formation of the Special Assessment on properties located within the Special PLACE: Council Chambers 1444 W. Garvey Avenue West Covina, CA 91790 Any owner of property within the proposed Special Assessment Area may protest the formation of the Special Assessment Area, the extent thereof, or the proposed assessment, by filing a written protest with the City Clerk at or before the time set for the hearing. Such protest shall contain a descrip- tion of the property sufficient to identify the same, and if the signer is not shown on the last equalized assessment roll as the owner of such property, shall contain or be accompanied by written evidence that such signer is the owner of such property.. The City Clerk shall endorse on each protest the date of its receipt and at.the time appointed for the hearing shall present to the City Council all protests filed. No other protests shall be considered by the City Council. SECTION 7. The Redevelopment Agency of the City of West Covina, • whose telephone number is (213) 962-8631, hereby is designated by the City Council to answer inquiries regarding the hearing procedures for the Resolution of Inten- tion and to answer inquiries relating to any hearing or proceedings concerning this action. SECTION 8. The City Clerk shall cause the Notice of Hearing attached hereto and incorporated herein as Exhibit "D" to be published three times in the West Covina Tribune, a newspaper published and circulated in the City of West Covina, the first of which publications shall be not less than twenty (20) days prior to June 22, 1981, the date of said hearing. The City Clerk shall further give notice by mailing and posting in the manner and with other documents as required and established by law.. SECTION 9. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect.
