C331 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA,.APPROVING PCD-1, DEVELOPMENT PLAN NO. 31 AND CERTIFYING THE NEGATIVE DECLA- RATION OF ENVIRONMENTAL IMPACT AS IT APPLIES THERETO. THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, DOES RESOLVE AS FOLLOWS: WHEREAS, there was filed with the Planning Commission verified applications on the forms prescribed in Chapter 26, Art. XIII, Div. 3 of the West Covina Municipal Code for the physical development of that certain property described as follows: Parcels 1,2,3 and 4 of Parcel Map No. 7713 in the City of West Covina, as per Map Book Records in Map Book 119, Page 16 of Parcel Maps as record- ed in the office of the County Recorder of Los Angeles, California; and WHEREAS, the Planning Commission, upon giving the requ- ired notice, did on the 15th day of April, 1981, conduct a duly advertised public hearing as prescribed by law to consider said application; and WHEREAS, studies and investigations made by this Commi- ssion and in its behalf reveal the following facts: 1. The applicant has submitted a development plan for the construction of 9 units with an overall density of 7.2 dwelling units per acre. 2. The development plan is consistent with the adopted General Plan and Woodside Village Master Plan as amend- ed. 3. The proposed project meets or exceeds the development standards of Woodside Village. 4. The developer will draft a Prospective Homebuyer's Awareness Package to better inform homeowners of exist- ing and potential conditions. 5. Streets, roads, sewers, and other improvements are adequate to accommodate the proposed development. 6. An initial study has revealed that, because of its comp- atibility.with the surrounding Woodside Village Master Plan land use designations and developments, this pro- ject will have no significant effect on the environment. 7. Subject development plan has been filed in conjunction with PCD-1, Amendment.No. 6 and Tentative Tract No. 41972. 40 WHEREAS, the Planning Commission based on said findings, adopted Resolution No. 4-81-3098 recommending to the City Council approval of Development Plan No. 31; and WHEREAS, the City Council of the City of West Covina, did on the llth day of `May;.. 1981,,conduct a duly advertised public hearing; and WHEREAS, as a -result of said hearing, the City Council affirms the findings made by the Planning Commission and set forth in their Resolution No. 4-81-3098. • NOW, THEREFORE, BE IT RESOLVED, that the subject Develop- ment Plan No. 31 and the Negative Declaration of Environmental Impact as it applies thereto, be approved and certified respect- ively subject to the provisions of the West Covina Municipal Code provided that physical development of the herein described prop- erty shall conform to said Plan and the following conditions which, except as otherwise expressly indicated, shall be fully performed and completed or shall be secured by bank or cash'dep- osit satisfactory to the Planning Director before the use or occupancy of.the property is commenced and before a Certificate of Occupancy is issued, and the violation of any of which shall be grounds for revocation of said Development Plan by the Planning Commission of City Council. The Development Plan shall not be effective for any purpose until the owner of the property invol- ved (or his duly authorized representative) have filed at the office of the Planning Department his affidavit stating that he is aware of, and accepts, all the conditions of this Development Plan as stated below: 1. The proposed project shall conform to Study Plan "A", dated April 15, 1981. 2. The proposed project shall conform to the floor plans and elevations submitted. 3. All utilities shall be underground in accordance with, Section 7500 of the Municipal Code. 4. The Covenants, Conditions and Restrictions of the project (if applicable) shall be submitted to the City Attorney for his approval prior to the sale of any units. 5. Street Trees'shall be required. 6. The developer shall draft a Prospective Homebuyer's Awareness,Package (PHAP). Such package shall include: a. A standardized cover sheet developed by the Plan- ning Department; b. Zoning and General Plan information; C. School information; d. Special assessment district information; e. A copy of the Covenants, Conditions and Restrictions (C.C. & R.'s) applicable to the tract; and f. Any additional information deemed necessary by the • Planning Department, Planning Commission, or City Council for the full disclosure of important info- mation. The draft PHAP shall be submitted to the Planning Director prior to recordation of the final tract map. -2- 7. Engineering Department Requirements: a. Applicant to comply with all conditions contained in Planning Commission Resolution No. 567. • b. Sanitary sewers shall be provided. C. The required street improvements shall include those portions of Pass and Covina Road and Lark Ellen Avenue contiguous to subject property. d.. 9-foot wide sidewalks (with trees in tree wells) shall be constructed along Pass and Covina Road and Lark Ellen Avenue adjacent to (curb). e. Adequate provision shall be made for acceptance and disposal of surface drainage entering the property from adjacent areas. f. Parking lot and driveway improvements on private property shall comply with Planning Commission Reso- lution No. 2513 and be constructed to the City of West Covina Standards. g. Prior to (issuance of a Building Permit) and/or (approval of a final map) the applicant shall satisfy all of the following requirements: i. A final grading and drainage plan showing existing and proposed elevations and drainage structures (and --showing existing and proposed on -site and off -site improvements) shall be submitted to and approved by the Planning, Build- ing, and Engineering Departments:" ii. Arrangements for the installation of street lights with underground wiring shall be made with Southern California Edison Company. At the time of installation, the applicant shall provide the necessary trenching and backfill. A (parking lot) lighting plan showing electroiler types and locations, average illumination levels, points of minimum illumination and photometric data is requested shall be submitted to and app- roved by the City Engineer and Planning Director. iv. An itemized cost estimate for all on -site and off -site improvements to be constructed (except buildings) shall be submitted to the Engineering Department for approval. Based upon the approved cost estimates, required fees shall be paid and improvement securities for all on -site and off - site improvements (except buildings) shall be posted prior to final approval of the plans. • 8. Building Department Requirements: The proposed project shall comply with the requirements of the Uniform Building Code for buildings located in Fire Zone 3. -3- 9. Fire Department Requirements: a. Two Steamer Fire Hydrants (2h x 4" outlets) - James Jones Model 3700 or approved equal. b. Fire hydrants on plan to be flushed and painted by contractor or developer before Fire Department acceptance. C. Both hydrant outlet openings shall form a 450 angle with curb face. d. Center of hydrant head outlet openings to be 30"- 36" above finish grade. e. On -site water serviceable hydrants to be provided by developer before framing started. Hydrants to be provided as development progresses supplied with water. f. 50' turning radius for Snorkel. 15' overhang from rear wheel to end of Snorkel basket. 25' drive standard. g. Snorkel use on travelled areas needs 20 ton support. h. Water mains and hydrants to be installed as per City of West Covina Water Department Standards or AWWA Standards.. See C600 , '''AWWA. Standard for Installation of Cast Iron Water Mains," and AWWA Manual M17, "Installation, Operation and Mainten- ance of Fire Hydrants," and AWWA C503-75 "Wet Barrel'Fire Hydrants". 10. Police Department Requirements: a. A locking device with a combination of single cylinder dead bolt (minimum 1" throw) and entry set, containing panic free operation for interior egress on all exterior doors other than sliding glass doors. b. Automatic spring activated auxillary locking devices on all exterior windows and sliding glass doors. Must be separate from main locking device. C. Door viewers in all main entrance exterior doors with 1800 view. d. No exterior "french" type doors. e. High pressure sodium lighting with break resistant covers in all parking and open space areas.
