A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF WEST COVINA, CALIFORNIA, APPROVING
TENTATIVE TRACT MAP NO. 40799, AND CERTIFY-
ING THE NEGATIVE DECLARATION OF ENVIRONMENTAL
IMPACT THEREFOR. (Sand Dollar Development,
Inc.)
THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, DOES
RESOLVE AS FOLLOWS:
WHEREAS, there was filed with this Commission a verified
application on the forms prescribed in Section 9100 of the West
Covina Municipal Code, for the physical development of that certain
property generally described as follows:
a 14.45-acre portion of Lots 302 and 318
of E. J. Baldwin's Fifth Subdivision of a
portion of the Rancho La Puente; as per
map recorded in Book 12, Page 134 of Maps,
in the office of the Los Angeles County
Recorder; and
WHEREAS, the Planning Commission upon giving the required
notice did on the lst day of October, 1980, conduct a duly adver-
tised public hearing as prescribed by law to consider said appli-
cation; ,and
WHEREAS, studies and investigations made by.this Commis-
sion and in its behalf reveal the following facts:
1. The applicant is requesting approval of a two -lot tenta-
tive tract map for the purpose of constructing a 215-unit
condominium development at the above location, pending
annexation to the City of West Covina.
2. Findings necessary for approval of a tentative tract map:
a. The proposed map is consistent with the General Plan
as amended.
b. The design and improvements of the proposed subdivi-
sion are consistent with.the General Plan as amended.
C. The site is physically suited for the proposed type
of development.
d. The site is physically suitable for the proposed
density of development.
e. Neither the design nor the improvements of the pro-
posed subdivision will cause any substantial environ-
mental damage.
f. Neither the design nor the improvements of the pro-
posed subdivision are likely to cause any public
health problems.
g. Neither the design nor the improvements of the pro-
posed subdivision will conflict with easements ac-
quired by the public for use of property within the
subdivision. The proposed buildings will not en-
croach into the flood control easement along the
southerly portion of the site.

3. An initial study has disclosed that, although the project
could have a significant impact on the environment, com-
pliance with the Zoning Ordinance, Subdivision Ordinance
and the.Building Code -will mitigate the impact of noise,
dust and erosion during construction, increased drainage
and sewage disposal. There will be no significant impact
on the school system. Francisquito and Azusa Avenues can
accommodate the additional traffic, with most freeway -
oriented traffic utilizing the latter. On -site parking
facilities will exceed the minimum required by Code. A
Negative Declaration of.Environmental Impact has been pre-
pared pursuant to the requirements of the California
Environmental Quality Act of 1970 (CEnA).
4. Subject tentative tract map has been filed in conjunction
with General Plan Amendment No. 1980-2, Zone Change No.
555 and Precise Plan of Design No. 748.
WHEREAS, the Planning Commission on October 1, 1980,
adopted Resolution No. 10-80-3069 recommending that the City
Council approve Tentative Tract Map No. 40799,, subject to certain
conditions contained therein; and
WHEREAS, the City Council upon giving the required notice
did on the loth day of November, 1980, conduct a duly advertised
public hearing to consider said application; and
WHEREAS, testimony and staff reports received at said
hearings affirmed the findings made by the Planning Commission
during its hearings of October 1, 1980, and set forth in this
resolution.
NOW, THEREFORE, BE IT RESOLVED THAT:
a. Pursuant to the findings made in Planning Commission
Resolution No. 10-80-3069 and re -affirmed by this
Council; and those findings contained in the Plan-
ning Commission Resolution No. 10-80-3069 certifying
the Negative Declaration of Environmental Impact,
and'the findings of staff reports dated October 1,
1980,-for said Tentative.Tract Map No. 40799, Zone
Change No. 555, and Precise Plan No. 748, which are
hereby incorporated herein, the City Council does
hereby approve Tentative Tract Map No. 40799.
b. The physical development.of.the property encompassed
by Tentative Tract Map No. 40799 shall conform to the
following conditions which, except as otherwise ex-
pressly indicated, shall be fully performed and com-
pleted or shall be secured by bank or cash deposit
satisfactory to.the Planning Director, and the vio-
lation of any of which shall be grounds for revocation
of said Tentative..'Tract.

Comply with Tentative Tract Map No. 40799, dated October 1,
1980.
Comply with all reauirements of the MF-15 Zone except
where modified by Planning Commission or City Council.

3. Engineering Department Requirements:
a. Applicant to comply with all conditions contained in
Planning Commission Resolution No. 567.
b. Sanitary sewers shall be provided.
• C. The required street improvements shall include pri-
vate street intersection on Francisquito Avenue,
driveway approach on Azusa Avenue, and left -turn
pocket on Azusa Avenue, contiguous to subject prop-
erty.
d. Nine -foot wide sidewalks with trees in tree wells,
shall be constructed along Francisquito Avenue and
along Azusa Avenue adjacent to curb.
e. Adequate provision shall be made for acceptance and
disposal of surface drainage,entering the property
from adjacent areas.
f. Parking lot and driveway improvements on private
Property shall comply with Planning Commission Reso-
lution No. 2513 and be constructed to the City of
.West Covina Standards..
g. Prior to issuance of a building permit and/or approval
of a final map the applicant shall satisfy all of the
following requirements:
i. A final grading and drainage plan showing exist-
ing and proposed elevations and drainage struc-
tures (and showing existing and proposed on -site
and off -site improvements) shall be submitted to
and approved by the Planning, Building and En-
gineering Departments.
ii. Arrangements for"the installation of street
Tights with underground wiring shall be made
with Southern California Edison Company. At
the time of installation, the applicant shall
provide the necessary trenching and backfill.
iii. A parking lot lighting plan showing electrolier
types and locations, average illumination levels,
points of minimum illumination and photometric
data as requested shall be submitted to and
approved by the City Engineer and Planning
Director.
iv. An itemized cost estimate for all on -site and
off -site improvements to be constructed (except
buildings) shall be submitted to Engineering
Department for approval. Based upon the ap-
proved cost estimates, reauired fees shall be
paid and improvement securities shall be posted
prior to final approval of the plans.
• h. The proposed subdivision shall conform to the Sub-
division Ordinance of the City of West Covina.
i. Joing use agreement between Lots 1 and 2 to the satis-
faction of the City Attorney shall be recorded.

j. If development is built in stages, the first stage
shall include two access points to public streets
and on -site circulation to the satisfaction of the
City Engineer.
k. Private streets shall,comply with -Planning Commission
• Resolution No. 2519 and be constructed to the City of
West Covina Standards.
4. Building Department Requirements
No requirements.
5. Fire Department Requirements.:
No requirements.
6. Police Department Requirements:
No requirements.
The City Council further finds and determines that the
Negative Declaration of Environmental Impact for the project has
been prepared in accordance with the .California. Environmental
Quality Act of 19.70 and the State Guidelines and is hereby approved
and shall be certified as required by law.
FINALLY RESOLVED, that the City Clerk shall certify to
the adoption of the resolution.
