A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST
• COVINA, CALIFORNIA, DEMANDING THAT THE STATE DEPART-
MENT OF HEALTH AND OTHER APPROPRIATE STATE AGENCIES
VERIFY THAT THE B.K.K. SANITARY LANDFILL IS NOT A
HEALTH HAZARD AND THAT A HEALTH HAZARD ASSURANCE
SYSTEM FOR CLASS I LANDFILLS BE ESTABLISHED.
The City Council of the City of West Covina, California, does
hereby resolve as follows:
WHEREAS, persons residing, working near or at hazardous waste
disposal sites, have a right to be assured that said site is not
a danger to their health and safety; and
WHEREAS, the growth in the quantities of hazardous wastes
generated within California has increased the need for hazardous
waste disposal sites; and
WHEREAS, the socio-economic well being and stability of the
state necessitates the provision and maintenance of Class I land-
fills; and
WHEREAS, the State Department of Health Services is charged
with the responsibility of providing appropriate surveillance of
hazardous waste processing, use, handling,- storage and disposal
practices in the state; and
• WHEREAS, it is the position of the State that the Department
of Health Services has been assigned by State law the responsibil-
ity for regulating hazardous waste disposal facilities; and
WHEREAS, the State Department of Health Services has the
authority by State law to impose conditions on the operations of
hazardous waste disposal facilities, to assure that they are
operating in a manner that does not threaten public health and
safety; and
WHEREAS, Attorney General's Opinion 51 OPS_AG 159 of April
4, 1974 states that the State of California has pre-empted local
jurisdictions in the field of hazardous waste as it pertains to
the processing, handling and disposal of hazardous waste materials;
and I
WHEREAS, The City of West Covina has received information
to the effect that the B.K.K. Sanitary Landfill does not pose a
hazard to public health; and
WHEREAS, the City of West Covina is entitled to immediate
assurances that said information is accurate and reliable; and
WHEREAS, in the long term a permanent health hazard assurance
program is necessary to provide public confidence in the safety
10 of hazardous waste disposal operations; and
NOW, THEREFORE, BE IT RESOLVED, that the City Council of
City of West Covina, California, does hereby demand as follows:
Section 1. That the State Department of Health Services
take all actions necessary and appropriate, ,including, but not
limited to, studies, investigations, and on -site monitoring in
order to verify whether or not the information received by this
City Council that a hazard to public health does not exist from
the B.K.K. operation is correct.
Section 2. That said assurances be given to the City of
West Covina City Council within'ninety.(90) days of the..date of
this resolution.
Section 3. That the State Department of Health Services
and any other appropriate State agencies develop and implement a
permanent Health Hazard Assurance Program.
Section 4. That said program provide comprehensive and con-
tinuous monitoring and reporting on the health safety of hazardous
waste disposal facility operations.

I HEREBY CERTIFY that the foregoing resolution was duly
adopted by the City Council of the City of West Covina, California,
at a regular meeting thereof held on the 27th day of October ,
1980 by the following vote of the Council.
