A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF WEST COVINA, CALIFORNIA, APPROVING
PRECISE PLAN NO. 744, TENTATIVE TRACT MAP
NO. 39733, AND VARIANCE NO. 802
(Crowder Construction Company)
The City Council of the City of West Covina, California, does
hereby resolve as follows:
WHEREAS, there was filed with the Planning Commission
a verified application on forms prescribed in Sections 9100,
26-226 and 26-261 of the West Covina Municipal Code, requesting
approval of a precise plan of design on that certain property
generally described as follows:
a 3.44-acreportion of Lot 163 of
E. J. Baldwin's Fourth Subdivison
of the Rancho La Puente, as per
map recorded in Book 8, Page 186
of Maps, in the office of the Los
Angeles County Recorder; and
WHEREAS, the Planning Commission .upon giving the re-
quired notice did on the 7th day of May, 1980, conduct a duly
advertised public hearing as prescribed by law to consider said
application; and
WHEREAS studies and investigations made by this Commis-
sion and in its behalf reveal the following facts:
1. The applicant is requesting approval of a precise plan
of design for the construction of a-41-unit condominium
complex on a 3.44-acre parcel at the above location.
2. Said precise plan application has been filed in con-
junction with, and approval is contingent upon, the
adoption of General Plan Amendment No. 1980-1, Zone
Change No. 549 and Variance No. 802. Tentative Tract
Map No. 39733 is required for condominium development.
3. Findings necessary for approval of a precise plan of
design:
a. Consideration has been given and restrictions shall
be imposed to the extent necessary, in view of the
size and shape of the parcel, the existing zoning of
the surrounding property and the proposed zoning of
the subject property, to permit the same degree of
enjoyment of the subject property, but subject to
the same degree of protection of adjoining properties,
as would be accorded in normal circumstances by the
standard restrictions imposed in the Municipal Code.
• b. The proposed precise plan of design will not depre-
ciate property values in the vicinity or interfere
with the use or enjoyment of property in the vicinity
or endanger the public peace, health, safety or gen-
eral welfare.

4. The applicant is requesting approval of a variance to
allow the rezoning of a 1.31-acre portion of land to
MF-8 to construct, as part of a larger project, a 41-unit
condominium (Part a). In addition, .the applicant is re-
questing a variance to allow three garages to open
directly onto Robindale Street (Part b).
5. Subject variance application has been filed in conjunc-
tion with General Plan Amendment No. 1980-1, Zone Change
No. 549, Precise Plan of Design No. 744 and Tentative
Tract Map No. 39733.
6. Findings for approval of Part (a)' of Variance No. 802:
a. The site is unique in that it is located adjacent to
a larger site proposed for condominium development
and is, in fact, reliant upon the larger site for
access, as it is otherwise landlocked.
b. The applicant is requesting the variance to permit
the same use as is proposed on the -larger adjacent
site to the east. Though the type of development
would be the same, the density on this portion would
be only eight units per acre.
C. The granting of this variance should not be materi-
ally detrimental to property or improvements in the
vicinity. The site will be part of a larger devel-
opment which will be oriented toward Robindale and
Glendora Avenue.
d. The granting of a variance will not adversely affect
the General Plan, which suggests a density of not
more than eight units per acre on this site.
7. Findings for approval of Part (b) of Variance No. 802:
a. The site plan, as.originally submitted required no
variances. A unique situation has been created by
the City in requiring a portion of the site to be
dedicated foruse as a public street, thereby causing
a non -conforming situation.
b. This variance, which has been.imposed on the appli-
cant, will create a situation not unsimilar to cer-
tain,condominium developments in Woodside Village,
or in most single family residential subdivisons
where garages face public streets.
C. The granting of the variance would not necessarily
be materially detrimental to"public welfare or in-
jurious to property or improvements in the vicinity.
The applicant will provide automatic garage door
openers and textured driveway surfaces to lessen
visual impact. 0
d. The granting of the variance would not affect the
General Plan.
8. The applicant is requesting approval of a one -lot tenta-
tive tract map for the purpose of constructing a forty-
one unit condominium development at the above location.

9. Findings for approval of a tentative tract map:
a. The proposed map is consistent with the General Plan
as amended.
b. The design_ and improvements of the proposed subdi-
vision are consistent with the General Plan as
• amended.
c. The site is physically suited.for the proposed type
of development.
d. The site is physically suitable for.the proposed -
density of development.
e. Neither the design nor the improvements of the pro-
posed.subdivision will cause any substantial environ-
mental damage.
f. Neither the design nor the improvements of the pro-
posed subdivision are likely to cause any public
health problems.
g. Neither the design nor the improvements of the pro-
posed subdivision will conflict with easements ac-
quired by the public for' use of property within the
subdivision. The applicant will provide a nine and
one-half foot easement for sidewalk and utilities
along the extended portion of Robindale Street ad-
jacent to the subject site.
10. An initial study'has disclosed that, because of its loca-
tion adjacent to a shopping center, with access to Glendora
. Avenue, and its adherence..to development standards, the
project will not have a significant effect on the environ-
ment, and.a Negative Declaration of Environmental Impact
has been prepared.
WHEREAS, the Planning Commission based on'said findings,
adopted Resolution Nos. 5-80-3035, 5-80=3.036 and 5-80-3037 recom-
mending to the City.Council approval of Precise Plan No. 744, Tenta-
tive Tract Map No..39733 and Variance No.' 802; and
WHEREAS, the City Council of the City of West Covina,
did on June 9, 1980, conduct a duly advertised public hearing; and
WHEREAS, as a result of said.hearing, the City Council
affirms the findings made by the Planning: Commission and set forth
in their Resolution No.s 5-80-3035,.5-80-3036 and 5-80-3037.
NOW, THEREFORE, BE IT RESOLVED, that subject Precise Plan
of Design No. 744, Tentative Tract Map No. 39733 and Variance No. 802
be APPROVED subject to the provisions of the West Covina Municipal
Code, provided that the physical development of the herein described
property shall conform to sald Plan and the following conditions
which, except as otherwise expressly indicated, shall be fully per-
formed and completed or shall be secured by bank or cashdeposit
satisfactory to the Planning Director before the use or occupancy
• of the property is commenced and before a Certificate of Occupancy
is issued, and the violation of any of which shall be grounds for
revocation of said Precise Plan by the Planning Commission or City
Council. The Precise Plan shall not be effective for any purpose
until the owner of the property involved (or his duly authorized
representative) has filed at the office of the Planning Department
his affidavit stating that he is aware of, and accepts, all the
conditions of this Precise Plan as stated below:

1. Comply with Study Plan "A", dated May 7, 1980.
2. Comply.with Exhibit I, (Elevations).
3. Comply with Tentative Tract Map No. 39733, dated May 7,
1980.
. 4. Project shall comply with all requirements of the MF-8
and MF-15.Zones except.where modified by variance.
5. All utilities shall be installed underground.
6. Five and one-half.foot high trash enclosures shall be
provided pursuant to Section 26-517.
7. Prior to issuance of building permits, applicant shall
e submit a detailed landscaping.plan to the Planning
Director for review and approval. Plan shall include
type, size and quantity of landscaping materials, as
well as a detailed watering plan. All landscaped areas
and parkway trees to be served with a fully automatic
watering system. Landscaped areas are to be kept free
of litter and diseased or dead plants.
8. Applicant shall provide eight (8) parkway trees and
bubblers at approximately 40-foot intervals on center.
9. All exterior mechanical equipment, vents, pipes and
ducts shall be totally screened from.all directions,
in'a mariner that is architecturally comptaible with
the main building.
• 10. Engineering Department Requirements:
a. Applicant to comply with all conditions contained in
Planning Commission Resolution No. 567.
b.. ..Sanitary sewers shall be provided.
c. The required street improvements shall include that
portion of Robindale Street contiguous to subject
property.
d. The required street dedication shall include that
portion of Robindale Street contiguous to subject
property.
e The access rights to Tract No. 39733 from Duff Avenue
shall be dedicated to the City.
f. Four -foot wide sidewalks shall be constructed along
Robindale Street adjacent to curb.
g. Adequate provision shall be made for acceptance and
disposal of surface drainage entering the property
from adjacent areas.
h. Parking lot and driveway improvements on private
property shall comply with Planning Commission
Resolution No. 2513 and be constructed to the City
of West Covina Standards..
i. Applicant shall grant five-foot.easements contiguous
to the street right-of-way for utility, street light-
ing, and traffic signing purposes.

j. Prior to issuance of a building permit and/or approval
of a final map the applicant shall satisfy all of the
following requirements:
i. A final grading and drainage plan showing exist-
ing and proposed elevations and drainage -struc-
tures (and showing existing and proposed on -site
and off -site improvements) shall be submitted to
and approved by the Planning, Building and En-
gineering Departments.
ii. Arrangements for the installation of street
lights with underground wiring shall be made
with Southern California Edison Company. At
the time of installation, the applicant shall
provide the necessary trenching and backfill.
iii. A parking lot lighting plan showing electrolier
types and locations, average illumination levels,
points of minimum illumination and photometric
data as requested shall be submitted to and
approved by the City Engineer and Planning
Director.
iv. An itemized cost estimate for all on -site and
off -site improvements to be,constructed (except
buildings) shall be submitted to Engineering
Department for approval. Based upon the approved
cost estimates, required fees shall be paid and
improvement securities shall be posted prior to
• final approval of the plans.
k. The proposed subdivision shall conform to Article IX,
Chapter 1.- Subdivisions of the West Covina Municipal
Code.
1. Robindale Street (42 feet wide right-of-way) shall
be dedicated and constructed in full to the City
Standards from the northwesterly terminus of the re-
quested MF-15 zoning portion of the lot to Glendora
Avenue.
M. A transferable irrevocable offer of joint access
shall be given to the City so that future develop-
ment of the parcel of land southwesterly of the re-
quested MF-8 zoning portion of this lot can be
integrated into the presently proposed development.
Such offer shall be approved by the City Attorney
and City Engineer and shall include the right to
remove improvements and do construction as necessary
on this lot to provide required access.
n. -The By -Laws of the,homeowner.'s association for the.
presently proposed development shall provide for in-
clusion of future development of the parcel of land
southwesterly of the requested MF-8 zoning portion
• of this lot to the extent necessary to share in the
related.maintenance costs of the private street serv-
ing such future development- Such provision shall
be approved by the City Attorney and City Engineer.

10. Fire Department Requirements:
a. Five (5) steamer fire hydrants (22" x 4" outlets) -
James Jones model 3700 or approved equal, as shown
on Study Plan "A".
is b. 300 ft. spacing between hydrants.
c.. Fire hydrants on plan to be flushed and painted by
contractor or developer before Fire Department ac-
ceptance.
d. Both hydrant outlet openings shall form a 450 angle
with curb face.
e. Center of hydrant head outlet openings to be 30" -
36" above finish grade.
f. On -site -water serviceable hydrants to be provided by
developer before framing started. Hydrants to be pro-
vided as development progresses supplied with water.
g. 50 ft. turning radius for Snorkel. 15 ft. overhang
from rear wheel to end of Snorkel basket. 25 ft.
drive standard.
h. Minimum 2.5 ft. access drives around commercial Bevel-
. opments.
i. Interior drives shall provide circulation around
complex and vehicle access within 150 ft. of any
• building.or portion thereof.
j. Two means of ingress, egress for development.
k. Snorkel use on travelled areas needs 20 ton support.
1. Where ladder access is necessary, will need adequate.
room to raise ladders. Please use following formula
(approximate guideline under normal conditions.)
Height of building ; by 4.
M. Water mains and hydrants to be installed as per City
of West Covina Water Department Standards or AWWA
Standards. See C600, "AWWA Standard for Installation
of Cast Iron Water _Mains," and AWWA Manual M17, "In-
stallation, Operation and Maintenance of Fire Hy-
drants," and AWWA C50.3-75 "Wet Barrel Fire Hydrants".
n. Provide minimum 8" looped water main. (1 hydrant at
west end of project may be on a dead-end 8" main.)
o. Provide address numbering on or near garage doors.
p. Security gates across driveways must be approved by
Fire. Department.
11. Building Department Requirements':
a. Comply with requirements and standards of the Uni-
form Building Code,.the State of California and the
City of West. Covina for'accommodation of, and access
by, the physically handicapped. The developer is
encouraged to exceed the minimum requirements of
said codes whenever feasible.
b. Comply with requirements of Uniform Building Code
for construction in Fire Zone III.
C. Comply with all requirements of Title 24 - 25 State
of California Energy and Insulation requirements.
• d. Comply with construction codes adopted by the City
of West Covina:
i. 1976 - Uniform Building Code
ii. 1976 - Uniform Plumbing Code
iii. 1976 - Uniform Mechanical Code
iv. 197V- National Electrical.Code as amended by
local ordinance.
12. Police Department Requirements:
a. Adequate directory sign.at,entrance.
b. Addresses and/or building numbers clearly visible on
all four sides of each building.
C. Standard requirements for safety hardware.
d. Security lighting around'swimming pools and along
all walkways.
e. Fencing around pools.
13. Planning Commission Requirements:
a. The developer shall, draft a Prospective Homebuyers
Awareness Package (PHAP.) pursuant to Section 9135 of
the Municipal Code.
b. A park fee shall be'paid to the City of West Covina
prior to the issuance.of building permits, pursuant
to Section 9134 of the Municipal Code.
C. Automatic garage door openers shall be provided for
all units.
FINALLY RESOLVED, that the City Clerk shall certify to
the adoption of this resolution.
