Resolution - 6041RESOLUTION NO. 6041 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING TENTATIVE PARCEL MAP NO. 12870. • The City Council of the City of West Covina, California, does resolve as follows: WHEREAS, there was filed with the Planning. Commission a verified application on the forms prescribed in Section 9100 of the West Covina Municipal Code, for the physical development of that certain property generally described as follows: a 13.5-acre portion of Lots 130 and 131 of E. J. Baldwin's Fourth Subdivision, as recorded in Book 8, Page 186 of Maps, in the office of the Los Angeles County Re- corder;. and WHEREAS, the Planning Commission upon giving the re- quired notice did on the 14th day of November, 1979, conduct a public hearing as prescribed by law to consider said application; and WHEREAS, studies and investigations made by this Commission and in its behalf reveal the following facts: 1. The applicant is requesting approval of.a tentative parcel map dividing a 13.5-acre parcel into four lots at the above location. • 2. Said tentative parcel map has been filed in conjunction with General Plan Amendment No. 1979-1, Zone'Change No. 545, and Precise Plan of Design No. 740. 3. Following are the findings necessary for approval of a tentative parcel map:. a. The proposed map is consistent with the applicable general and specific plans. b. The design of the proposed subdivision is consistent with the applicable general and specific plans, and will allow development consistent with said Plans. C. The site is physically suitable for the type of devel- opment proposed in that it is level and in excess of the minimum size of one acre,, and has frontage on a four -lane major street. d. The site is physically suited for the proposed density of the project, which is similar to nearby apartment development at Cameron and Sunset Avenues. e. Since the site has been developed for many years, there is no significant wildlife or habitat thereof. • f. The type of improvements proposed will cause no health problems': g. The proposed parcel map is designed to accommodate the flood control right-of-way across the northwester- ly corner of the site. It will not conflict with any existing or proposed public easements. 3. It has been determined that, although the tentative parcel map itself will have no effect on the environ- ment, the combined projects herein mentioned will have and Environmental Impact Report No. 1979-6 has been prepared accordingly. WHEREAS, the Planning Commission based on said findings • adopted Resolution No. 11-79-3003 recommending to the City Council. approval of Tentative Parcel Map No. 12870; and WHEREAS, the City Council of the City of West Covina, California, did on January 7, 1980, conduct a duly advertised public hearing; and WHEREAS, as a result of said hearing, the City Council affirms the findings made by the Planning Commission and set forth in their Resolution No. 11-79-3003. . NOW, THEREFORE, BE IT RESOLVED, that subject Tentative Parcel Map therefor be APPROVED, subject to the provisions of the West Covina Municipal Code provided that the physical development of the herein described property shall conform to said plan and the following conditions which, except as otherwise expressly indi- cated, shall be fully performed and completed or shall be secured by bank or cash deposit satisfactory to the Planning Director before the use or occupancy of the property is commenced and before a Certificate of Occupancy is issued, and the violation of any of which shall be grounds for revocation of said Tentative Parcel Map by the Planning Commission or City Council. 1. Comply with Tentative Parcel Map No. 12870. • 2. Engineering Department Requirements: a. Applicant to comply with all conditions contained in Planning Commission Resolution No. 567. b. Sanitary sewers shall be provided. C. Adequate provision shall be made for acceptance and disposal of surface drainage entering the property from adjacent areas. d.` Parking lot and driveway improvements on private property in the area of new construction shall com- ply with Planning Commission Resolution No. 2513 and be constructed to the City of West Covina Standards. e. Prior'to issuance of a building permit and approval of a final map the applicant shall satisfy all of the following requirements: i. Arrangements for the installation of street Tights with underground wiring shall be made with Southern California Edison Company. At the time of installation, the applicant shall provide the necessary trenching and backfill. • ii. An itemized cost estimate for all on -site and off -site improvements to be constructed (except buildings) shall be submitted to Engineering Department for approval. Based upon the approved cost"estimates, required fees shall be paid and improvement securities shall be posted prior to final approval of the plans. -2- 3. Building Department Requirements: No requirements. 4. Fire Department Requirements: • No requirements. 5. Police Department Requirements: No requirements. • 6. Planninq Commission Requirements: Parcel 3 shall be dedicated to the City of West Covina for park purposes. FINALLY RESOLVED, that the City Clerk shall certify to the adoption of this resolution.
