On April 2, 2002, the City Council preliminarily approved the Engineer's Report for West Covina Landscape Maintenance District No, 4. In addition, the City Council declared its intention to levy and collect assessments within the district and set June 18, 2002, as the date for the Public Hearing. Staff is proposing to maintain the current assessment rates for the Fiscal Year beginning July 1, 2002. The City Council should now hold the required hearing to levy and collect assessments. The total amount to be assessed is $772,926. Staff is proposing to use the voter approved Consumer Price Index adjustment to increase the assessment rates 2% from their current level resulting in a total assessment amount of $1,266,223. This project provides for structural repairs to be made to the Historical House at Heritage Park. At the request of the City Council, Hess Engineering, Inc. completed a structural survey of the facility and on March 5, 2002, the City Council directed staff to seek bids to have the work done. It is recommended that the City Council approve the repairs listed in Line Item Nos. B-1 through B-4 to the Historical House at Heritage Park as identified by the firm of Hess Engineering, Inc. and take the following actions: 1. Approve the expenditure of $9,350 from City Buildings Termite Repair (110-320-3001-7500) and $12,840 from Park Buildings Termite Repairs (161-320-3201-7500) for this project. 2. Approve an appropriation of $19,800 from City Yard Fuel Island (110- 320-3769-7900) to be transferred into Account No. 110-320-3294- 7500 to be used for this project. 3. Approve an appropriation of $91,910 from Construction Tax Fund balance to be transferred into Account No. 161-320-3294-7500 to be used for this project. 4. Approve an appropriation of $56,000 from Park Dedication Fund "F" (Fund 175). 5. Accept the bid of Pacific Construction in the amount of $143,800 as submitted at the bid opening on April 30, 2002, and authorize the Public Works Director/City Engineer and City Clerk to execute an agreement with Pacific Construction Company of Granada Hills, California, for the recommended work to be done. 06.18,02 6 Council Agenda 06/18/02 • C1 2) Award of Bids (continued) b) Citywide Street Sweeping Project No. SP-02104 — Award of Bid This report was held over from the June 4, 2002 City Council meeting to allow staff time to explore potential cost savings by allowing the sweeper debris to be deposited at the City yard. On May 14, 2002, three bids were received and opened for this contract, which provides for five years of Citywide sweeping of streets, alleys, medians, and City -owned parking lots. The lowest responsive bid based on Option No. 2 is $779,850 ($155,970 annually) from R.F. Dickson Company of Downey, California. It is recommended that the City Council accept the bid from R.F. Dickson Company in the amount of $779,850 ($155,970 per year) for a five-year period as submitted at the bid opening of May 14, 2002, and authorize the Public Works Director/City Engineer and City Clerk to execute an agreement with R.F. Dickson of Downey, California. c) Construction of Sidewalks at Various Locations — Citywide Project No. SP-02104 — Award of Bid Seven bids were received and opened on June 4, 2002, for the construction of a stamped concrete sidewalk at various locations Citywide. The lowest responsive bid was $55,350.00 from Grigolla and Sons Construction Company of Azusa, California. It is recommended that the City Council take the following actions: 1. Transfer $10,000.00 from Project No. SP-02106 (124-320-3250-7200) to Project No. SP-02104 (126-320-3248-7200). 2. Accept the bid of Grigolla and Sons Construction Company in the amount of $55,350.00 as submitted at the bid opening on June 4, 2002, and authorize the Public Works Director/City Engineer and City Clerk to execute an agreement with Grigolla and Sons Construction Company of Azusa, California, for the work to be done. d) Purchase of One Road Marking Machine Traffic Striper Award of Bid The Maintenance Division of the Public Works Department is requesting approval to replace one aged traffic striper with a new traffic striper. It is recommended that the City Council award the bid for the purchase of one Road Marking Machine per specifications in bid No. 01-02-02404 to Dispensing Technology Corporation of Moorpark, California, including tax and delivery, not to exceed $41,859.08 ($38,000.00 from Capital Improvement Program Account No. 115-320-3279-7160 and $3,859.08 from Street Maintenance Account No. 124-320-2230-6251). 3) Miscellaneous — Personnel Department a) Transmission of Memorandum of Understanding and Implementing Resolution for the West Covina Police Officer's Association The City has completed the meet and confer process with the West Covina Police Officers' Association. This report transmits the resulting Memorandum of Understanding (MOU) and the implementing resolution. It is recommended that the City Council: a. It is recommended that the City Council receive and file this report. Miscellaneous — Finance Department e) Appropriations Limit for Fiscal Year 2002-2003 Article XIIIB of the California Constitution imposes an appropriations limit on units of State and local government. This report calculates the 2002-2003 appropriations limit for the City of West Covina to be $72,875,756. City Council will consider adopting this appropriations limit for the year ending June 30, 2003. It is recommended that the City Council adopt the following resolution: RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA SETTING THE ANNUAL APPROPRIATIONS LIMIT FOR THE FISCAL YEAR 2002-2003 f) Contract Extension — Independent Auditing Services The City has contracted with the independent auditing firm of Caporicci & Larson for the last five years. Staff is recommending that the audit contract with Caporicci & Larson be extended for two years to include fiscal years 2001/02 and 2002/03. It is recommended that the City Council authorize Cit staff to enter into a contract to extend the auditing services for the two fiscal years ending June 30, 2003, subject to review and approval of the City Attorney. Miscellaneous — Public Works g) Resolution Authorizing Litigation Challenging the Trash TMDL for the Los Angeles River The United States Environmental Protection Agency (EPA) has established a "Zero" Trash TMDL (Total Maximum Daily Load) for the Los Angeles River, while a nearly identical TMDL is in the process of being approved as a regulation at that State level by the State Water Resources Control Board (SWRCB). This report explores the impacts of the TMDL and the proposed litigation And recommends that the City of West Covina be included in the Coalition for Practical Regulation (CPR) in challenging these regulations. All additional application measures required by the Fire Department have been approved and completed. It is recommended that the City Council ratify authorization of a fireworks display at the West Covina High School for June 18, 2002. i) Appropriating Funds for a Senior Volunteer Program The West Covina Fire Department has been approved for a grant under the Federal Emergency Management Agency "Assistance to Firefighters Grant Program" for a community based Fire Prevention Program. The grant total is $30,088 with a City share of $12,895. It is recommended that the City Council take the following actions: a. Accept the FEMA Assistance to Firefighters Grant for $30,088 to create the Senior Volunteer Program. b. Appropriate the "FEMA Assistance to Firefighters Grant" for a total of $30,088 in account 4139-320-2182-7170 for the purchase of the Senior Volunteer vehicle. Due to a change in the level of coverage offered, coupled with a 294% increase in premium, staff is recommending the City totally self -insure this exposure until such time as an insurance pool can be formed to provide a more acceptable level of coverage and premium. It is staffs recommendation that the City Council accept Option 2 and totally self -insure this exposure until a pool can be formed that can provide acceptable coverage. Motion by 2nd by approve disapprove hold over 2) Placement of the City's General and Auto Excess Liability Insurance Coverage On July 1, 2002, the City's general and auto excess liability insurance policy is due for renewal. Due to a significant increase in the cost to risk share this coverage with the Independent Cities Risk Management Authority (ICRMA), coupled with internal problems the ICRMA is experiencing, staff felt it was prudent to obtain an additional quote from another insurance pool regarding this coverage. Staff recommends the City Council accept whichever insurance quote that is lower, as provided by staff at the City Council meeting. Motion by god by approve disapprove hold over FINANCE DEPARTMENT 3) Variable Rate Lease Revenue Refunding Bonds 2002 Series The City Council shall consider the approval of a resolution authorizing certain documents and taking certain actions in relation to the issuance by the West Covina Public Financing Authority of Taxable Variable Rate Lease Revenue Refunding Bonds, 2002 Series A in an amount not to exceed $4,000,000; Variable Rate Lease Revenue Refunding Binds, 2002 Series B in an amount not to exceed $25,000,000; and Variable Rate Lease Revenue Refunding Bonds, 2002 Series C in an amount not to exceed $4,500,000. L) CITY MANAGER'S OFFICE - GENERAL ADMINISTRATION 1) Future of ADA Committee The City Council formed the Americans with Disabilities Act (ADA) Committee to identify and evaluate City facilities' compliance with the Americans with Disabilities Act. The ADA Committee has completed their review of City Hall and has recently completed their inspection of the City's parks. Some Councilmembers have indicated a desire to examine the ADA Committee vacancies and to re -visit the current structure of the ADA Committee. City staff recommends that the City Council continue the ADA Committee with the current eight members, authorize the City Council to make appointments to fill any vacancies, instruct the ADA Committee to complete the review of the City facilities, and prepare the ADA Compliance Plan. The Parole Office Subcommittee will be arranging a meeting to discuss this and other issues with our State legislators. It is recommended that the City Council receive and file this informational report.
