2) Code Amendment No. 01-04 — Density Bonuses
The proposed code amendment consists of certain amendments to Chapter 26
(Zoning) of the West Covina Municipal Code related to low and moderate -income
and senior citizen housing. Specifically to be considered is an increase in the
maximum level of density bonus that may be granted from the current level of
100 percent to 160 percent. For example, where zoning permits 20 dwelling units
per acre, a 100 percent density bonus would allow the approval of a housing
development with a density of 40 dwelling units per acre. The proposed
amendment to increase the maximum allowable density bonus to I60 percent
would allow consideration of approving low and moderate -income and/or senior
citizen housing developments up to 52 units per acre.

Anneal of Precise Plan No 01-04
The project proposes the construction of a three-story, 86-unit senior citizen
apartment complex on a 1.66-acre site. The project is proposed to be restricted to
senior citizens age 62 years and over, with 20 percent of the units restricted to
very low-income households and 80 percent of the units restricted to low-income
households. A total of 85 one -bedroom units and one two -bedroom manager's
unit are proposed. The one -bedroom units are proposed to be 690 square feet, and
the manager's unit is proposed to be 1,040 square feet in size. Additionally, the
project includes a 1,215-square foot community room.
The project requires the granting of the following entitlements:
(1) a General Plan amendment to change General Plan land use designation from
"Low Medium Residential" (4.1-8.0 dwelling units per acre) to "Medium High
Residential" (15.1-20.0 dwelling units per acre);
(2) a zone change from "R-A" (Residential -Agricultural), Area District I, to "MF-
20" (Medium Density Multiple -Family Residential);
(3) an appeal of a conditional use permit for incentives for the provision of senior
citizen and lower -income housing, including the granting of a density bonus for
an increase in density from 20 units per acre allowed under the "MF-20" Zone to
52 units per acre, and the approval of certain deviations from the development
standards of the "MF-20" Zone, including deviations from required front, side,
and rear yard setbacks, providing less than the required number of parking spaces,

The City Council and the Redevelopment Agency Board shall consider a joint

between the Redevelopment Agency and West Covina Senior Villas, LLC

a) Justen A. Stock vs. Citv of West Covina
This claim arises from an incident that occurred on April 7, 2001. The
claimant alleges that a branch from a City owned tree broke off and struck
the hood of his vehicle that was parked in front of his residence located at
612 N. Nora Avenue. Claimant indicates in his claim that the branch
broke off during a rainstorm.
b) Edwardo Leroy Martinez vs. City of West Covina
On June 18, 2001, the City Clerk's Office received an application for
authorization (leave) to present a late claim for property damage in the
amount of $387.59. Claimant is seeking reimbursement for costs he
incurred to replace the windshield of his vehicle.

One June 1, 2001, the City Clerk's Office received a claim for
indemnification relating to personal injuries sustained in a trip and fall
accident. The amount of claim had not been determined at time of
presentation.
d) Vincent R. Joseph vs. City of West Covina
One May 10, 2001, the City Clerk's Office received a claim for property
damage in the amount of $89,057.10 relating to an alleged slope failure on
public property. Pursuant to Government Code requirements, the original
claim was returned as insufficient because it failed to state a specific date
of accrual or date the loss was discovered. On May 23, 2001, the City
Clerk's Office received an amended claim that included a date the loss
was discovered.
3) Temporary Use Permits (receive & file)
TUP #2673-01 issued to St. Christopher's Church at 629 S. Glendora Avenue for
a fiesta fundraiser from 10/05/01 to 10/07/01.
4) Traffic Committee
a) Minutes from Meeting of September 18 2001 (accept & tile)
I. A City initiated request that adult crossing guards be considered at
the intersections of Vine Avenue/California Avenue, Vine
Avenue/Glenshaw Avenue, Merced Avenue/Sunset Avenue, and
Conlon Avenue/Durness Avenue resulted in the following
recommendation:
That this item be held over to provide staff time to gather the
necessary data.
II. A City initiated request that red curb be placed adjacent to shuttle
stops on the east and west sides of Lark Ellen Avenue at Herring
Street, at 4129 Sentous Avenue and at 2775 Valley Boulevard
resulted in the following recommendation:
i) That red curb be installed at the shuttle stops on the east
and west sides of Lark Ellen Avenue at Herring Street, at 4129
Sentous Avenue and at 2775 Valley Boulevard.
ii) Authorize the City Engineer to install red curb/no parking
adjacent to shuttle stops as needed except in front of single-
family residences.
III. A City initiated request that a multi -way stop be installed at the
intersection of Willow Avenue and Alwood Street resulted in the
following recommendation:
i) That stop signs (RI) be installed along with stop messages
and stop ahead signs (W17) on the north and southbound
approaches of Willow Avenue at Atwood Street based on the
multi -way stop warrant for intersections adjacent to schools
and for intersections on "Safe Routes to Schools."
ii) That school crosswalks be installed on Willow Avenue
north of Farlington Street and on Alwood Street east of Tamar
Drive with required signs and pavement messages.

iii) That a handicap ramp be installed on the cast side of
Willow Avenue for the crosswalk at Farlington Street.
IV. Cherrywood Street residents requested that speed humps be
installed along Cherrywood Street and Garvey Avenue South and
that a multi -way stop be installed at the intersection of Cherrywood
Street and James Street which resulted in the following
recommendation:
i) That in accordance with the provision of the California
Traffic Manual, the following speeds shall be established by
ordinance along Garvey Avenue South:
• Between Lark Ellen Avenue to Cherrywood Street 35 mph
• Between Cherrywood Street and Azusa Avenue 35 mph
ii) That additional advisory signing, marking, and pavement
messages be installed on Cherrywood Street such as:
Enhanced Centerline Markers
Additional Curve Warning Signs
Rumble Strips (BOT Dots)
iii) That sidewalk construction on the east side of Cherrywood
Street from Garvey Avenue South to Stuart Avenue be
included in this year's priority sidewalk program.
V. Principal of Merced Elementary School requested that red curb be
installed temporarily between two existing driveway approaches
for use by school buses to loading and unloading school age
passengers which resulted in the following recommendation:
That red curb be temporarily installed between the existing
drive approaches at Merced Elementary School, 1545 East
Merced Avenue.
b) Ordinance Introduction to Implement Traffic Committee
Recommendation for Establishing Speed Limit of Garvey Avenue
South from Lark Ellen Avenue to Azusa Avenue
Based upon an Engineering and Traffic Survey of Garvey Avenue South
from Lark Ellen Avenue to Azusa Avenue, the City Traffic Committee has
recommended establishing a 35 mph speed limit in place of the existing 40
mph speed limit. It is recommended that the City Council initiate the
reduction of the speed limit on Garvey Avenue South from Lark Ellen
Avenue to Azusa Avenue by introducing the following ordinance:

5) Award of Bids
a) Street Rehabilitation Work on Segments of Various Bus Route Streets
— Proiect No. SP-01116 — Award of Bid
Five bids were received and opened on September 18, 2001 for the
rehabilitation work on various bus route streets. The lowest responsive
bid is $998,614.08 from All American Asphalt of Corona, California.
Recommendation is to take the following actions:
1) Establish project SP 01116.
2) Transfer $694,000 from SP O1106 (122-320-3134-7200), which is the
2000-2001 annual street rehabilitation project, and $456,000 from SP
02106 (122-320-3250-7200), which is the 2001-2002 annual street
rehabilitation project, to SP 01116 (122-320-3291-7200).
3) Accept the bid of the lowest responsive bidder, All American Asphalt,
in the amount of $998,614.08 as submitted at the bid opening on
September 18, 2001, and authorize the Mayor and City Clerk to
execute an agreement with All American Asphalt for the work to be
done.
b) Structure Demolition at 421 South Citrus Street — PP 02323 —
Award of Bid
This project provides for property maintenance work to be done at 421
South Citrus Street that was identified as part of the 2001-2002 Capital
Improvement Program agenda. The work will include asbestos abatement
work, the demolition and disposal of all existing residential structures, the
demolition of existing above -grade utility systems, and the installation of a
new electric power pole and service. It is recommended that the City
Council accept the bid of Whelan Construction in the revised amount of
$25,654.00, and authorize the Mayor and City Clerk to execute an
agreement with Whelan Construction of West Covina, California, for the
work to be done.
c) Purchase of Portable Radios
This report recommends that the City Council approve the award of Bid
0901-A, for the purchase of portable radios and related accessories for
both the Police and Fire Departments, to Motorola Inc. of San Diego, the
lowest responsive bidder. It is recommended that the City Council
approve the award of Bid 0901-A for the purchase of 44 Motorola Model
MT 2000 portable radios and accessories to Motorola Inc. of San Diego at
a total cost of $40,687.69.
d) Community Center and Gym Facility at Cameron Park — Project No.
PP-97226 —Award of Architectural Services Contract
City staff reviewed 24 proposals for design services of a community
center and gym facility at Cameron Park. Staff recommends contracting
with Dougherty and Dougherty Architects of Costa Mesa, California for
architectural services for an amount not to exceed $248,000. It is
recommended that the City Council accept the following
recommendations:
1) Accept the proposal of Dougherty and Dougherty Architects,
including the civil and soils consultants in the amount not to exceed
$248,000 and authorize the City Manager to execute a consultant

e) Gingrich Park Play Area Rehabilitation — Project No. RM —0101 —
Award of Bid
This project provides for the installation of replacement playground
equipment that was damaged by fire at Gingrich Park. Bids were opened on
September 25, 2001 and the lowest responsive bid was $34,892 from Hondo
Company of Santa Ana, California. It is recommended that the City Council
accept the bid of Hondo Company in the amount of $34,892 as submitted at
the bid opening on September 25, 2001 and authorize the Mayor and City
Clerk to execute an agreement with Hondo Company of Santa Ana,
California for the work to be done.
6) .July 2001 Statement of Treasurer's Accountability (receive & file)
This staff report serves as a transmittal of the monthly Statement of Treasurer's
Accountability and provides a brief explanation of that report.
7) Miscellaneous — Environmental Management
a) Appropriation Authorization for AB 2766 Alternative Fuel
Equipment Maintenance and Repair Budget Line Item
This is a request for authorization to appropriate $12,700 from AB 2766
AQMD Air Quality Improvement fund balance in order to establish a line
item for service and maintenance of alternative fuel vehicle infrastructure,
including vehicles and fueling stations. It is recommended that the City
Council authorize the transfer of $12,700 from the Air Quality
Improvement Fund # 119-300 balance to account number 119-320-2319-
6330 Equipment Maintenance and Repair for expenditures related to the
repair and/or installation of electric vehicles and charging stations.
7) Miscellaneous — Community Services
b) Authorization to Apply for Roberti-Z'Berg-Harris Urban Open Space
and Recreation Grant Program Funds
The City Council will consider adoption of a resolution authorizing staff
to apply for West Covina's share of the Roberti -Z'Berg- Harris (RZH)
Urban Open Space and Recreation Program Block Grant. 'fhe funds must
be utilized for the development or rehabilitation of parks or recreational
facilities. It is recommended that the City Council adopt the following
resolution:

c) Authorization to Apply for Prop. 12 Per Capita Grant Funds
The City Council will consider adopting a resolution authorizing staff to
apply for West Covina's share of Proposition 12 Per Capita Grant Funds.
Based on population, the City of West Covina is eligible to receive
$976,000 from this portion of Proposition 12 grants for the rehabilitation,
acquisition, expansion, and development of recreational facilities. It is
recommended that the City Council adopt the following resolution:

d) Competitive Grant for Community Center/Gymnasium
The City Council will consider adopting a resolution authorizing staff to
apply for a competitive grant for the proposed Community Center/Gym. It
is recommended that City Council approve the following resolution and
authorize staff to apply for the grant.

e) Lights for West Covina High School Quad
In FY 1999-2000, the City Council authorized $125,000 for the lighting of
the basketball courts at West Covina High School. This report requests
approval of a West Covina Unified School District (District) request to
fund lighting of the quad area of the High School as part of the basketball
court lighting project. It is recommended that the City Council:
1) Approve the expenditure of funds in the amount of $125,000 from
Account No. 174-320-3268-7700 for the lighting of the basketball
courts ($100,000) and the quad/security lighting ($25,000).
2) Authorize the City Manager to execute a contract with the West
Covina Unified School District to provide for the granting of funding
not to exceed $25,000 to light the West Covina High School Quad as
outlined in the agreement.
3) Transfer $4,000 from the FY 2001-2002 Non -Departmental Reserve
Appropriation Account No. I10-320-2640-6900 into Maintenance
Account No. 180-320-2244-6135 to hire a contractor to perform the
additional maintenance on the basketball courts.

Powers Agreement
The City of Palm Springs has applied for membership in the Independent
Cities Risk Management Authority (ICRMA). The City Council is
requested to consider and approve the attached resolution. It is
recommended that City Council adopt the following resolution:

g) Annexation No. 369 to Countv Sanitation District No 22
A portion of Tract Map No. 52590 on the northeast corner of Aroma Drive
and Galster Way is being annexed to County Sanitation District No. 22. It
is necessary to adjust the distribution of the property tax resulting from the
development to annually distribute to the district their 0.3577 percent
share of the tax bill in accordance with the previously approved Property
"fax Sharing Agreement. It is recommended that the City Council adopt
the following resolution to permit Annexation No. 369 to County
Sanitation District No. 22.

1) Municipal Pool Rehabilitation/Replacement Options
During the first Capital Improvement Program Study Session, the City Council
expressed concerns about the rehabilitation of the Municipal Pool. Staff is
requesting City Council direction as to the desired scope of rehabilitation. It is
recommended that the City Council provide direction to staff concerning the
extent of the rehabilitation and/or replacement of the Municipal Pool with a
recommended minimum scope of $435,000 in rehabilitation consisting of Items 1,
11, and III.I as detailed in the report.

2) Financing of Purchases of Valencia Heights Water Company Property and
Butler Property (Refer to Public Financing Authority Agenda Item No II)
The purchase agreements for the Valencia Heights Water Company (VHWC)
property specifies that the City will issue a promissory note for the purchase. The
City is legally restricted from issuing the note but the City's Public Financing
Authority can issue the note. The purchase agreement with Mr. Butler does
specify using the City Public Financing Authority. It is recommended that the
City Council authorize lease/purchase from the City's Public Financing Authority
by adopting the following resolution:

1) DESIGNATION OF VOTING DELEGATES FOR NATIONAL LEAGUE
OF CITIES 2001 CONGRESS
The National League of Cities will hold its annual congress in Atlanta, Georgia,
December 4 through December 8, 2001. During the congress, the League holds
its annual business meeting at which time City Representative vote on League
policy. The City of West Covina must designate a voting delegate and an
alternate to vote at this meeting. It is recommended that the City Council
designate a voting delegate and an alternate for the National League of Cities
Annual Congress.

The City Council directed the Police Department to provide information and an
analysis of the proposed expansion of the State Department of Corrections Parole
Office (Unite III) located in West Covina on Badillo Street. It is recommended

3) Councilmember Touhey — Loan of Fire Truck to New York Fire Department
Councilmember Michael Touhey asked to agcndize the loaning of the City's
reserve fire truck to the City of New York until the City of New York is able to
replace the fire trucks destroyed in the recent terrorists attacks. It is
recommended that the City Council discuss this matter and direct staff
accordingly.

Rose Parade Float
Councilmember Michael Touhey asked to agendize the making of design changes
to the City of West Covina's Rose Float to pay homage to the victims of the
recent terrorists attacks. Councilmember Touhey recommends that the City
Council instruct staff to contact the West Covina Rose Float Association,
Tournament of Roses and Charisma Floats to ask for the requested design changes
to the West Covina Rose Float.
