At the Council meeting of August 21, 2001, the City Council introduced an
ordinance changing the commencement time of City Council meetings to 7:00
p.m. from 7:30 p.m. This ordinance is now being presented for second reading
and adoption. It is recommended that the City Council adopt the following

a) Angel Valdez Escudero vs. City of West Covina
On May 9, 2001, the City Clerk's Office received a claim for
discrimination in the amount of $5,000,000.00 relating to an automobile
vs. motorcycle accident.
b) Charlos W. Goff vs. City of West Covina
On January 12, 2001, the City Clerk's Office received a claim for property
damage in the amount of $173.42. Claimant is seeking reimbursement for
costs he incurred to repair the water service line at his residence.
c) Marion Murphy vs. City of West Covina
On June 25, 2001, the City Clerk's Office received an amended claim for
personal injuries relating to an automobile accident. The amount of claim
had not been determined at time of presentation.
d) Angelita Taylor vs. City of West Covina
On July 24, 2001, the City Clerk's Office received an application for leave
to present a late claim. Claimant is seeking reimbursement for costs she
incurred to repair damage to her apartment allegedly caused by West
Covina police officers.

TUP 92670-01 was issued to Marukai, West Covina at 1420 S. Azusa Avenue, for
a Hawaiian Food Festival from 8/18/01 to 8/19/01.
TUP #2671-01 was issued to West Covina Dodge at 2000 Garvey Avenue South
for a tent sale from 8/30/01 to 9/5/01.

C-6) Miscellaneous — Finance Department
a) Proposed Increase in the Fixed Asset Capitalization Threshold
The Government Accounting Standards Board (GASB) has issued
Statement 34, which radically modifies the presentation of financial data,
including how fixed assets are reported. The Government Finance
Officers Association has recommended that in no case should a
government establish a capitalization threshold of less than $5,000 for any
individual item for reporting purposes. The threshold currently in place in
the City of West Covina is $500. This change will only affect the
presented balance sheet; it will have no impact on the manner in which the
City controls or monitors its assets. It is recommended that the City
Council increase the capitalization threshold from $500 to $5,000 for any
individual item for reporting purposes by adopting the following
resolution:

b) Reappropriation of Funds for Programmer Analvst I
On August 7, 2001, the City Council approved the parameters of a
workers compensation case settlement regarding a Programmer Analyst I
position in the Finance Department. As a result of the City Council
direction, a reappropriation of funds is required to pay for salary and
benefits for the aforementioned employee's position with the current
year's budget. It is recommended that the City Council reappropriate
$81,600 in salary and benefits to account 110-320-2541-5XXX for the
Programmer Analyst I position in the Finance Department.
C-6) Miscellaneous —Planning Department
c) Public Noticing of Projects on City Property and Large -Scale Private
Projects
The City Council has requested consideration of a policy for expanded
public noticing for projects being proposed on City property. In addition,
the Planning Commission has expressed interest in adopting a policy for
expanded noticing requirement for larger -scale private projects. On
August 14, 2001, the Planning Commission recommended that for projects
on City property and for private projects on sites over one acre that the
radius for mailing notification be expanded from 300 feet to 500 feet and
that notices be posted on the site. It is recommended by the Planning
Commission and staff that the City Council adopt a policy to require the
use of expanded public noticing for projects on City -owned property and
private projects on sites of over one acre to include: (1) enlarging the
radius for mailed notices from 300 feet to 500 feet; (2) posting one or
more notices (as determined appropriate by staff) on the site; and (3)
utilizing other media options for providing notice of the public hearing as
available, including the City website, cable television "corkboard," and
Discover West Covina.

d) Youth Employment Plan for Proposition A Funded Projects
Adopt a Youth Employment Plan (YEP) to expend funds under the Safc
Neighborhood Parks Propositions of 1992 and 1996 on the employment of
at -risk youth. It is recommended that the City Council:
1. Select the 10% development project allocation of $77,849 as West
Covina's YEG.
2. Select the definition of "at -risk" youth as described by the
Community Services Commission.
J. Select the Youth Employment Plan as outlined in attachment to the
staff report. (County Format)
4. Appropriate $23,200 in account #XXX-320-2355-5112.
e) Application for the Roberti-Z'Berg-Harris Urban Open Space and
Recreation Grant Program Funds, Under the Safe Neighborhood
Parks, Clean Water, Clean Air, and Coastal Protection Bond Act of
2000 (Part of Proposition 12)
Staff is requesting authorization to apply for West Covina's share of the
Roberti -Z'Berg-Harris (RZH) Urban Open Space and Recreation Program
Block Grant. It is recommended that the City Council adopt the following
resolution.

Staff is requesting authorization to apply for West Covina's share of
Proposition 12 Per Capita Grant funds. Based on population, the City of
West Covina is eligible to receive $976,000 from this portion of
Proposition 12 grants for the rehabilitation, acquisition, expansion, and
development of recreational facilities. It is recommended that the City
Council adopt the following resolution:

1) BKK Landfill Proposed Corrective Action Management Unit
BKK has applied with USEPA for a Corrective Action Management Unit
(CAMU) designation to facilitate the contaminated groundwater remedy. On July
17, 2001 the City Council asked for a staff report on this item. it is recommended
that the City Council direct staff and special environmental counsel to review
BKK's application to make sure that it meets the criteria established in the
Federal Regulations in permitting a CAMU.
