1) Code Amendment No. 280 — Extension of3nterim Ordinance No. 2009
Indoor Swap Meets and Indoor Multi -Tenant Retail Uses
Location: Citywide
On December 15, 1997, the City Council adopted Urgency Ordinance No. 2009
extending a moratorium on new "indoor swap meets" and "indoor multi -tenant retail
centers" for a period of 10 months and 15 days until November 2, 1998. On October
13, 1998, the Planning Commission considered Code Amendment No. 280 to establish
a permanent prohibition on these uses. The Commission, however, was deadlocked on
this matter and voted to table it in order to provide time for further study and
consideration. The Commission did recommend that

On July 1, 1998, the City Clerk's Office received a claim for property damage
amounting to $2,141.52. It is recommended that the claim of Farmers
Insurance/Williams filed on July 1, 1998, be denied and the claimant be so
notified.
b) Barbara Sprowson vs City of West Covina
On June 1, 1998, the City Clerk's Office received a claim for personal injury,
the exact amount of which was unknown, however, believed to be in excess of
$10,000.00. It is recommended that the claim of Barbara Sprowson filed on
June 1, 1998, be denied and the claimant's attorney be so notified.
c) Oliver Jacobs IV vs City of West Covina
On July 21, 1998, the City Clerk's Office received a claim for personal injuries
amounting to $1,000,000.00. It is recommended that the claim of Oliver
Jacobs, IV filed on July 21, 1998, be denied and the claimant's attorney be so

City Treasurer's Report for the month of September, 1998.
6) Award of Bids
a) Project No. GP-99308 Fire Station No. 3 and Palmview Park Parking Lot
Renavine
Three bids were received and opened on October 12, 1998, for this project
which provides for pavement repair and replacement services at Palmview park
and Fire Station No. 3. The lowest responsive bid is $64,865 from E. C.
Construction Company of South El Monte. It is recommended that the City
Council accept the bid of E. C. Construction Company in the amount of
$64,865 and authorize the Mayor and City Clerk to execute an agreement for
the work to be done.
b) Proiect No. MP-98229 - Slone Repair at Hooper Drive
Three bids were received and opened on October 8, 1998, for this project
which provides repair work of a slope failure on a Maintenance District No. 6
slope in the vicinity of Hooper Drive. The lowest responsive bid is $58,000
from Aman Environmental Construction of Covina. It is recommended that
the City Council take the following actions:
i) Appropriate $75,000 from the City's Risk Management Reserve Fund
to Project No. MP 98229.
ii) Accept the bid of Aman Environmental Construction in the amount of
$58,000 as submitted at the bid opening and authorizing the Mayor and
City Clerk to execute an agreement for the work to be done.

7) Miscellaneous — Police Department
a) Informational Report Concerning the BJA Grants
At the City Council meeting of September 1, 1998, the City Council requested
evaluation information concerning the use of the first BJA Grant at five local
middle schools. The information requested is presented in the staff report.
Recommendation is to receive and file the report.
Miscellaneous — Fire Department
b) Fire Department Records Management Systems
The Fire Department is recommending approval of the funding required for the
completion of the Fire Department's Records Management System and CAD
Interface. This funding is for purchase of the final hardware, software setup
and installation, and training to operate and administer the system. It is
recommended that the City Council authorize the transfer the appropriation of
$103,000.00 in Account Number 200-320-2181-6424 to Account Number
110-320-3854-7900 for completion of Phase I of the Fire Department's
Records Management System and Automation.
Miscellaneous — Personnel/Risk Management
c) Petition for Formal Recognition — San Bernardino Public Employees'
Association
Official recognition by the City Council of the San Bernardino . Public
Employees' Association is requested pursuant to Sections 2-213 through 2-215
of the West Covina Municipal Code. It is recommended that the City Council
approve the Petition for Recognition from the San Bernardino Public
Employees Association as meeting the intent of Municipal Code Sections 2-
213 through 2-215.
d) Transmission of a Resolution Authorizing an Amendment to the Contract
Between the Board of Administration of the Public Employees'
Retirement System (PERS) and the City of West Covina for Safe
Employees (Police)
This report transmits to the City Council a Resolution of Intention to amend
the contract between the Public Employees' Retirement System (PEAS) and
the City to provide Section 21573 (Third Level of 1959 Survivor Benefits) for
local Police members. It is recommended that the City Council adopt the
following resolution entitled:

COUNCH. OF THE CITY OF WEST COVINA, CALIFORNIA,
AUTHORIZING AN AMENDMENT TO THE CONTRACT
BETWEEN THE BOARD OF ADMINISTRATION OF THE PUBLIC

Miscellaneous - Environmental Management
e) BKK Landfill Closure Plans - Status Report
This is an updated report on the STATUS OF PLANS FOR BKK
LANDFILL CLOSURE and other related BKK matters. This is a part of the
City program to keep the community informed of the progress toward
implementation of the closure plans for the BKK Landfill. Recommendation is
to receive and file.

f) Project MP-98229 - Hooper Drive Designation of City's Authorized
Ment(S) for FEMA Reimbursement Request
The City has requested the Federal Emergency Management Agency (FEMA)
for Federal assistance towards the cost of repairing the slope failure at Hooper
Drive. In order to receive reimbursement from FEMA, a resolution approved
by the City Council is necessary to designate an authorized agent to execute
any necessary documents. It is recommended that the City Council approve
and adopt the following resolution entitled:
RESOLUTION NO. - A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF WEST COVINA DESIGNATING THE
CITY'S AUTHORIZED AGENT FOR EXECUTION OF
DOCUMENTS FOR SUBMITTAL TO THE FEDERAL
EMERGENCY MANAGEMENT AGENCY (FEMA).
g) Project GP-98306 - Seismic Strengthening of Civic Center Parking
Structure Relocation of Suburban Water Utility Easement
Construction of this project, which provides for the seismic retrofit of the Civic
Center parking structure commenced on September 8, 1998. Exploration has
revealed that the Suburban Water underground main line must be relocated.
The relocation requires the realignment of the existing underground utility
easement. It is recommended that the City Council adopt the following
resolution entitled:
RESOLUTION NO. - A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF WEST COVINA AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE A GRANT OF
EASEMENT IN FAVOR OF SUBURBAN WATER SYSTEMS.
h) Capital Improvement Program and Building Activity Report — Third
Quarter 1998
This report is to provide the City Council with a summary of major building
permits issued and capital improvement activity during the quarter ending
September 30,1998. Recommendation is to receive and file.

D) ENVIRONMENTAL MANAGEMENT DEPARTMENT
1) ATHENS SERVICES CURBSIDE RECYCLING PROPOSAL
FOR THE CITY OF WEST COVINA
Athens Services has submitted a Curbside Recycling proposal with four alternative
curbside programs for the City to select from. The programs vary from types of
services with different monthly fees and diversion percentages. The City of West
Covina is mandated by State law to divert 50% of its waste stream by the year 2000.
The curbside program is to help the City achieve its 50% diversion State mandate. It is
recommended that the City Council:
a) Ensure that due diligence is performed by having an independent third party
consultant review the curbside recycling proposal. The consultant should advise the
Council on which program would be the best for West Covina or recommend a viable
alternative. It is recommended the consultant should be hired by the City and paid for
by Athens Services. The cost for services should not exceed $20,000.
b) Appoint an adhoc committee with members from the Waste Management and
Environmental Quality Commission, staff and Athens Services to review and discuss
the proposal and report back to the City Council before final approval.

E) REDEVELOPMENT AGENCY

1) 1998 HOME APPLICATION (refer to Agency Item HI)
the Agency is applying to the State Department of Housing and Community Develop-
ment for HOME funds to supplement the First Time Home Buyer program. $500,000
in HOME funds were awarded last year. The Agency is required to provide a 25%
match. Significant changes to the FTHB/HOME program are recommended, which
will only apply to those loans funded by HOME dollars. It is recommended that the
City Council adopt the following resolution:

THE CITY OF WEST COVINA AUTHORIZING THE SUBMITTAL OF AN
APPLICATION TO THE CALIFORNIA STATE DEPARTMENT OF HOUSING

INVESTMENT PARTNERSHIPS PROGRAM; AND THE EXECUTION OF A
STANDARD AGREEMENT AND ANY RELATED DOCUMENTS NECESSARY

F)- COMMUNITY SERVICES
1) SHADOW OAK PARK DEVELOPMENT
Roller Hockey Rink
Skateboard Park
The Community Services Commission has reviewed the second noise study pertaining
to the development of a roller hockey rink and skateboard park on the lower level of
Shadow Oak Park. Based on input received from the community as well as no
negative noise impacts apparent from the proposed project, it is recommended that
funding sources be identified to allow this project to move forward. Because funding
may be a constraint, it is also suggested that the project be constructed in phases. The
Community Services Commission is requesting that this prioritization of phases occur
during a joint meeting of the Community Services Commission and the City Council.
Recommendation is that the City Council participate in a joint meeting with the
Community Services Commission to discuss the funding source(s), neighborhood
concerns, and phasing priorities of the Shadow Oak Roller Hockey Rink and
Skateboard Park Project.

This report recommends approval of a Public Services Department and revised class
specifications for Building Official, City Engineer, City Planner, Director of Public
Services, and Superintendent of maintenance Operations. An organizational chart and
revised class specifications are attached for review. It is recommended that the City
Council approve:
a) The creation of a Public Services Department
b) The proposed revisions of the class specifications for: Building Official, City
