In October, an unmaintained pool was determined to present a threat to life and
public health and was pumped. The City Council will conduct a hearing as required
by Section 15-204 of the Municipal Code regarding the emergency abatement.

Two ordinances have been introduced by the City Council and are on the Council
agenda this evening for final reading and adoption. It is recommended that the City
Council adopt the following ordinances:

7) Award of Bids
a) Project No. `PP-95206 Shadow Oak Community Center Miscellaneous
Four bids were received and opened on Monday, December 9, 1996, for
this project which provides for miscellaneous repairs at Shadow Oak
Community Center. The lowest responsible bid is $18,400.00 from B & Z
f/ S Construction of Monrovia, California. it is recommended that the City
Council accept the bid of B & Z Construction in the amount of $18,400, and
authorize the Mayor and City Clerk to execute the agreement with same for
the work to be done.
b) Proiect No. MP-97122 Bus Stop Shelters - Various Locations
Two bids were received and opened on Thursday, December 5, 1996, for
this project which consists of supplying and installing fifteen bus stop
shelters. The lowest responsible bid is $67,125.00 from Armstrong
H s 2 Construction of Covina, California. It is recommended that the City
Council accept the bid of Armstrong Construction in the amount of
$67,125.00, and authorize the Mayor and City Clerk to execute an
agreement for the work to be done.
c) Project No. PP-97202 Aluminum Bleachers at Various Locations
One bid was received and opened on Thursday, December 5, 1996, for this
project which provides for aluminum bleachers at various pqEk_1Qcations.
The bid received is $26,684.09 from Aluminum Seating, Inc. of San
kEG Bernardino, California. It is recommended that the City Council accept the
bid of Aluminum Seating, Inc. in the amount of $26,684.09, and authorize
the Mayor and City Clerk to execute an agreement for the work to be done.
d) Project No. PP-97210-A Maverick Field Netting Installation
Two bids were received and opened on Tuesday, December 10, 1996, for
this project which provides for netting installation at Maverick Baseball
kC-C- Field. The lowest responsible bid is $25,650.06 from Woodman Pole
Company of Huntington Beach, California. It is recommended that the City
Council take the following actions:
Transfer $30,000 from Project No. MP-87152 to Project No. PP-
97210-A; and

Accept the bid of Woodman Pole Company in the amount of
$25,650.00, and authorize the Mayor and City Clerk to execute an
agreement with same for the work to be done.
8) Miscellaneous - City Clerk
a) Biennial Review of the City's Conflict of Interest Code
The Political Reform Act requires the City Council to review the City's
Conflict of Interest Code on a biennial basis and make any necessary
amendments. It is recommended that the City Council approve the City's
amended Conflict of Interest Code, as prepared by the City Clerk.
Miscellaneous - Finance Department
b) 1997 Business License Fees
The City Council will consider adopting a resolution suspending: 1) C.P.I.
increases on business license fee; 2) a portion of the business license fee for
Category A -II and all of the business license fee for Category A -III; and 3) a
portion of the business license fee for Category S(26). It is recommended
that the City Council adopt the following resolution suspending certain
C.P.I. increases and portions of the business license tax:

SUSPENDING ANY INCREASE IN THE AMOUNT OF CHARGES

OF THE BUSINESS LICENSE TAXES IMPOSED UNDER SECTION
A -III OFFICE AND COMMERCIAL RENTALS, AND A PORTION
OF THE BUSINESS LICENSE TAXES IMPOSED AND CATEGORY
S(26) SMALL COLLECTING FACILITIES AND REVERSE
VENDING MACHINES.
c) 1997 Investment Polic
The Council will consider the City's Investment Policy for the year 1997.
Staff recommends that the City Council receive and file the City's
Investment Policy for 1997.
d) Business Improvement Tax Appropriation
The Council will consider appropriating excess Citizens' Celebration
Committee funds. Staff recommends that the Council appropriate $1,776
from Business Improvement Tax fund balance to 118-304-2430-6497
(Fourth of July Event).
e) Comprehensive Annual Financial Report CAFR
The City's CAFR for Fiscal Year 1995-96, which has been audited by
Moreland & Associates CPA's, will be presented. Staff recommends that
the City Council receive and file the City's Comprehensive Annual Financial
Report and ratify the following transfers:

f) Los Angeles County - West Covina Civic Center Authority Financial
Report - Fiscal Year End June 30, 1996
The Los Angeles County - West Covina Civic Center (Authority) Annual
Financial Report for Fiscal Year 1995-96 audited by Moreland and
Associates, independent accountants, is submitted. It is recommended that
the City Council receive and file the Authority's Annual Financial Report
for the year ending June 30, 1996.
Miscellaneous - Engineering Department
g) 1996-97 Transportation Development Act (TDA) Funding
Each year, pursuant to SB-821, the State of -California provides funds for
bicycle and pedestrian facilities. In order to claim these funds, it is
necessary that the City apply for them. These funds will be needed for this
Eye year's sidewalk program. The 1996-97 TDA allocation is $41,721. It is
recommended that the City Council adopt the following resolution:

APPROVING THE APPLICATION FOR BICYCLE AND
PEDESTRIAN FUNDS AUTHORIZED UNDER SB-821 AND
RECONFIRMING THE ADOPTION OF ITS BICYCLE AND
PEDESTRIAN PLAN.
h) Project No. SP-96105 Construction of Sidewalks/Wheelchair RamDS
This project consists of the construction of concrete sidewalks and
wheelchair ramps to provide for safer pedestrian use and to remove barriers
EyGthat hinder the mobility of physically challenged persons. The estimated
cost of the project is $129,000. It is recommended that the City Council
approve plans and specifications for Project No. SP-96105 and authorize the
City Engineer to call for bids.
1) National Pollution Discharge Elimination System (NPDES) - Legal
Authority to Control Discharges To and From the Municipal Separate
Storm Sewer System
California Regional Water Quality Control Board Order No. 96-054 (which
became effective July 31, 1996) requires that the City of West Covina
demonstrate that it possesses "the legal authority necessary to control
discharges to and from those portions of the Municipal Separate Storm
Sewer System (MS4) over which it has jurisdiction." This legal authority
CND will be achieved through the adoption of an Ordinance which regulates:
storm water discharges; illicit discharges and illicit connections; and spills,
dumping, and disposal of prohibited materials. It is recommended that the
City Council introduce the following ordinance:
A STORM WATER AND URBAN RUN-OFF POLLUTION
CONTROL ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF WEST COVINA, CALIFORNIA, AMENDING CHAPTER 9 OF
THE WEST COVINA MUNICIPAL CODE BY DELETING
EXISTING SECTIONS 9-26 THROUGH 9-36, INCLUSIVE, AND
ADDING PROVISIONS PERTAINING TO CONTROL OF
MUNICIPAL STORM WATER AND URBAN RUN-OFF
DISCHARGES.

This is an updated report on the status of plans for BKK Landfill closure and
other related BKK matters. This is a part of the City program to keep the
community informed of the progress toward implementation of the closure

1) Planning Department
Code Amendment No. 275: Interim Urgency Ordinance Related to Wireless
Communication Facilities
On December 10, 1996, the Planning Commission adopted a resolution
recommending that the City Council adopt an interim urgency ordinance
establishing a moratorium on new and modified wireless communication facilities,
which include monopole and roof -mounted cellular and other personal
communication system antennas. Due to evolving changes in technology and State
and Federal regulations in this area, it is anticipated that the City will continue to
receive a considerable number of applications for these facilities in the future. The
proposed moratorium will suspend further consideration of proposed wireless
communication facilities until a comprehensive ordinance can be adopted to properly
regulate these facilities. The Planning Commission and staff recommend that the
City Council adopt the following interim urgency ordinance:

Proposition 208 Voluntary Campaign Spending Limit
Proposition 208, the campaign finance reform initiative passed by the voters at the
November, 1996, general election, provides that local jurisdictions may establish .
voluntary campaign spending limits. If limits are adopted, candidates who agree to
adhere to them can take advantage of increased individual contribution limits. --
generally equal to a doubling of the limits. Because the terms of Proposition 208
become effective on January 1, 1997, the City Council should consider whether it
wants to establish voluntary spending limits for the March 1997 City election. Staff
is not expressing a recommendation on this matter except to point out that generally
throughout the nation, the amount of money spent on candidate and initiative
campaigns has increased. It is reported that the public perception is that campaign
spending should be limited, but as the two "competing" propositions on the
November ballot pointed out the public is not generally in agreement as to how best
to accomplish that.

1) Appointment of Mosquito Abatement District Board
The City of West Covina has a seat on the Board of Directors of the San Gabriel
Valley Mosquito Abatement District. West Covina is represented by
Councilmember Nancy Manners, whose term expires in January 1997. It is
recommended that the City Council appoint a member to the Board of Trustees of
the San Gabriel Valley Mosquito Abatement District.
