AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING AND EXPANDING PROVISIONS REGARDING ABATEMENT OF GRAFFITI. aam&09-m 4 City Council Agenda September 20, 1994 C) CONSENT CALENDAR (Continued) 6) Award of Bids Ten (10) bids were received and opened on Friday, September 9, 1994, for the project which provides for the coldmilling and asphaltic concrete overlay including striping and all appurtenant work on Glendora Avenue from Walnut Creek Wash to Robindale Street. The lowest responsible bid was $379,988.70, from SULLY -MILLER CONTRACTING COMPANY of Anaheim. It is recommended that the City Council take the following actions: a) Transfer $130,000 from unobligated Proposition "C" funds (1993-94) to City Project No. SP-93117. b) Accept the bid of Sully -Miller Contracting Company of Anaheim in the amount of $379,988.70 as submitted at the bid opening on September 9, 1994, and authorize the Mayor and the City Clerk to execute an agreement with said Sully -Miller Contracting Company.for the work to be done. 7) Miscellaneous Engineering a) 1994-95 Capital Improvement Program The City Council has reviewed the 1994-95 Capital Improvement Program (C.I.P.) and given preliminary approval for the projects to be funded. The City Council is now being requested to formally adopt the 1994-95 Capital Improvement Program and appropriate funds in the amount of $6,002,787. It is recommended that the City Council review the proposed C.I.P. for 1994-95, provide staff .with any recommended changes as to projects or funding, and adopt the following resolution: RESOLUTION NO. - A RESOLUTION OF THE CITY COUNCIL OF THE .CITY OF WEST COVINA, CALIFORNIA, APPROVING THE ADOPTION OF THE 1994-95 CAPITAL IMPROVEMENT PROGRAM. b) Delvale Street Storm Drain Approval of Plans and This project consists of the construction of a storm drain system in Delvale Street, Orange and Fairgrove Avenues to alleviate localized street flooding problems. The County is requesting temporary transfer of jurisdiction of various streets in order to construct the storm drain improvements within the City. It is recommended that the City Council adopt the following resolution: RESOLUTION NO. - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING CERTAIN PLANS AND SPECIFICATIONS FOR THE CONSTRUCTION OF THE DELVALE STREET DRAIN PROJECT IN THE CITY OF WEST COVINA, CALIFORNIA, AND AUTHORIZING THE USE OF PUBLIC STREETS FOR CONSTRUCTION, OPERATION AND MAINTENANCE OF THESE FACILITIES. a8amo9-20 5 City Council Agenda September 20, 1994 C) CONSENT CALENDAR (Continued) 7) Miscellaneous (Continued) Recreation Services c) Community Recreation Agreement The City of West Covina and the West Covina Unified School District's Projects Sub -Committee has reviewed the current Agreement that regulates the use of the Edgewood Pool. The Sub -Committee has recommended a number of changes that will distribute the maintenance and utility costs in a more equitable manner. On September 13, 1994, the Human Services Commission reviewed and approved the proposed changes. It is recommended that the City Council authorize the Mayor to sign the revised Community Recreation Agreement between the West Covina Unified School District and the City of West Covina. Environmental Services d) This is a report on the review of the Final Environmental Impact Report for the Walnut Village Development in the ,City of Walnut. Further comments from the Waste Management and Environmental Quality Commission may be presented at the October 4th City Council meeting. It is recommended that the City Council approve the transmittal of comments to the City of Walnut on the Final EIR for the Walnut Village Development. Planning Department e) State Legislation requires the Los Angeles County Metropolitan Transportation Authority (°MTA") to annually monitor and determine that local jurisdictions are in conformance with local Congestion Management Program responsibilities. Cities have until November 1, 1994, to file congestion mitigation credit claims under -the Countywide Deficiency Plana Staff is recommending that the City Council authorize staff to transmit to MTA, the list of regional transportation improvements as contained in the West Covina 1994 CMP Local Implementation Report, by the November 1, 1994 deadline. agmda09-20 6 City Council Agenda September 20, 1994 C) CONSENT CALENDAR (Continued) 7) Miscellaneous (Continued) Planning Department (Continued) f) California Wildlife Protection Act of 1990 Habitat Conservation Fund Grant Program for Wetland Habitat Enhancement/Restoration This request is to authorize submittal of an application for funds from the Habitat Conservation Fund Grant Program under the California Wildlife Protection Act of 1990 for riparian enhancement and/or restoration at Heritage Gardens Historical Park. It is recommended that the City Council adopt the following resolution: RESOLUTION NO. - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA APPROVING THE APPLICATION FOR- FUNDS AVAILABLE THROUGH THE CALIFORNIA WILDLIFE PROTECTION ACT OF 1990 HABITAT CONSERVATION FUND GRANT PROGRAM FOR WETLAND HABITAT ENHANCEMENT/RESTORATION. Police Department g) The Police Department has worked cooperatively with the ESGVROP for the last fifteen years: The Police Department and the ESGVROP have developed a partnership agreement that has been proven to be mutually beneficial. Currently, the ESGVROP has funds available to help subsidize the Department partnership and the Department will be taking an active part to secure those funds. It is recommended that the City Council approve the concept, of the ESGVROP and its partnership with the Police Department and give the Police Chief the authority to enter into a contractual agreement, with ROP. A total of twelve (12) bus stop pads will installed at an estimated total project cost of $118,000. It is recommended that the City Council approve the plans and specifications for City Project No. SP-94106, and authorize the City Engineer to call for bids. One seat on the board represents cities without pumping rights and this term is due to expire on January 1, 1995. The WQA Board has called for nominations for the board seat representing cities without pumping rights. This is a matter of Council policy and staff makes no recommendation. If the Council chooses to nominate a candidate, the WQA requires a resolution naming the candidate be forwarded to WQA Headquarters not later than October 16, 1994. Staff has prepared a report covering the provisions of the West Covina Municipal Code and a discussion of efforts to. establish statewide campaign financing limitations. RECOMMENDATION: The establishment of new campaign financing regulations is a matter of City Council polity, and staff makes no substantive recommendation. If an amendment to the Municipal Code is desired, staff requests direction for the drafting of the appropriate ordinance for future consideration.
