received a claim purporting to have tortious merit

On April 2, 1993, the City Clerk's Office received
a claim for personal injuries. The amount of claim
had not been determined at time of presentation.

5) Award of Bids
a) Landscape Maintenance Contract City Specification
No. MD93-11 Citywide Medians and Freeway Rights Of
This five year contract provides for landscaping,
hardscaping and sprinkler systems and City medians
and freeway rights -of -way. Also included is
mandatory green waste recycling. Staff recommends
that the City Council reject the low bid of Midori
due to an insufficient bid bond and errors in the
proposed five year bid calculation. Therefore, it
is recommended that the City Council accept the
responsive low bid of Azteca Landscape of Pomona
for a five year contract in the amount of
$519,480.00 (103,896.00 annually) and authorize the
Mayor and City Clerk to execute an agreement with
Azteca Landscape for the work to be performed.
b) Landscape Maintenance Contract - City Specification
No. MD-1 & 2-93-11 Maintenance District Nos. 1 & 2
This five year contract provides for the
maintenance of all City maintained landscape,
hardscape and sprinkler systems in Woodside Village
Districts 1 and 2. Also included in this contract
is mandatory green waste recycling. Staff
recommends that the City Council accept the bid of
Azteca Landscape of Pomona for a five year contract
in the amount of $444,555.00 ($88,911.00 annually)
and authorize the Mayor and City Clerk to execute
an agreement with said Azteca Landscape for the
work to be performed.
c) Acquisition of Riding Mower Unit With 72 Inch
Mowing Deck
The Maintenance and Finance Departments approval to
replace a Rotary Riding Mower. It is staff's
recommendation that the City Council:
i) Find that it would be uneconomical to comply
with the formal bid procedures specified in
Section 2-333 of the West Covina Municipal
Code and, therefore, waive formal bid
procedures; and

ii) Authorize the purchase of a Toro Groundsmaster
325-D, Model 30788 and 72 inch side discharge
cutting unit Model 30722 from Pacific
Equipment & Irrigation, Inc. of Industry for
$15,793.67 including tax and shipping.

Personnel Services
a) 93/94 Petition of Formal Recognition - SEIU, Local
Official recognition by the City Manager and the
City Council of the Service Employees'
International Union (SEIU), Local 347 is necessary
for the purpose of official representation of
Maintenance employees during contract negotiations.
It is the recommendation of the Personnel
Commission that the City Manager and City Council
grant formal recognition to SEIU, Local 347, as
majority representative of non -management
Maintenance employees. Such representation to be
effective from July 21, 1993 through July 20, 1994,
pursuant to Municipal Code Section 2-218.

b) Destruction of Certain Documents as Prescribed. by
The City Clerk's Office has several boxes of
materials which are no longer needed or have been
placed on microfilm. In accordance with provisions
of state law, these materials may now be destroyed.
It is recommended that the City Council adopt the

Speed Zone
In order to implement the speed zones that the City
Council approved as part of the Traffic Committee
Minutes on October 5, 1993, for the above five
locations., it is necessary that the Municipal Code
be amended as required by the California vehicle
Code. It is recommended that the City Council
introduce the following ordinances:

e) Approval of Plans and Specifications for the
Maintenance of Heating and Air Conditioning
Equipment in Thirteen City Owned Buildings
The maintenance of heating and air conditioning
equipment in City owned buildings has been provided
by a variety of private contractors for the past 22
years. These new and updated specifications will
provide for improved maintenance of City owned
equipment. In addition, rebidding this contract
during today's competitive bidding climate could
result in a cost reduction from the current
$4,026.00 monthly charge. It is recommended that
the City Council approve plans and specifications
for the maintenance of heating and air conditioning
equipment in thirteen City owned buildings and
authorize the Maintenance Director to call for
bids.
f) Construction Activity Report - Building and
Engineering Department - Quarterly Report for Third
Ouarter Fiscal Year 1993-94
These reports are to provide .the City Council with
a summary of major building construction activity
as reflected by issued Building Permits and
Citywide Construction Activity for the quarter
ending September 30, 1993. It is recommended that
the City Council receive and file these reports.

g) City Project WP-93111 - Waiver of a Formal
Competitive Bidding Procedure - Purchase of
Pressure Reducing Valves and Gate Valves
The installation of pressure reducing valves and
accessory gate valves are needed to protect water
services at eleven high pressure locations in the
City's water system. The prices for the pressure
reducing valves and gate valves are $26,629.50 and
$6,324.25, respectively, including spares, taxes
and delivery charges. It is recommended that the
City Council take the following actions:
i) Appropriate $5,000 from City's Water Funds
reserve to Project WP-93111;
ii) Approve waiver of a formal competitive bidding
procedures and authorize the Finance Director
to issue Purchase Orders to Pacific Industrial
Supply Company of Riverside, in the amount of
$26,629.50, and Familian Pipe and Supply
Company of the City of Industry in the amount
of $6,324.25, both including all taxes and
delivery charges.
h) Street Sweeping - Informational
In April of this year, the City Council approved a
one year extension of the street sweeping contract
with Community Disposal Company of Industry,
California. The Contract calls for residential
streets ,to be swept twice per month with the
downtown commercial area being swept three times
per week. The annual cost for sweeping is
$196,037.28. During the Council Meeting, the
possibilities of realizing cost.savings by reducing
the sweeping of residential areas to once per month
was discussed. This report outlines possible cost
savings and the service level implications. Staff
recommends that the specifications for the street
sweeping contract be rewritten and rebid in
January/February of next year with alternate levels
of service as follows:
Base Bid: Current service level of twice per
month in residential areas and three

Alternate 1: Residential areas once per month;
downtown commercial areas three
times per week.

i) Flashing Yellow Signals Work Program/Informational
The Traffic Committee will be reviewing the need
for installation of flashing yellow signals at 12
elementary school locations. It'is expected that
the study will take from three to four months to
complete. It is recommended that the City Council
receive and file this report.
Police Department
j) Outside Police Memorial
In June, 1993, a Citizen's Volunteer Committee was
formed to fund an exterior and interior Police
Memorial. Phase II of the Memorial includes three
black granite statues placed on the dirt area just
West of the front doors to the Police Station. It
is recommended that the City Council approve the 36
x 12 dirt area to be used by the Police Department
to erect the above Police Memorial.
Human Services
k) Fair Housing Assessment Consultant Agreement
The Federal Fair Housing Act requires the City to
conduct an analysis to determine the impediment's to
fair housing choice by citizens of West Covina.
Staff has received proposals for this work and is
recommending a consultant to prepare the necessary
documentation. It is recommended that the City
Council authorize the Mayor to execute an Agreement
with Willdan Associates for the preparation of the
West Covina Fair Housing Assessment Plan at a cost
not to exceed $8,000.

1) HolidaV Decorations
At the October 5, 1993 City Council Meeting, staff was
asked about the possibility of installing holiday
decoration around the downtown area. This report
outlines possible areas to be decorated, estimated costs
and the feasibility of implementation. The estimated
cost for a three-year.lease program is $24,300. If the
City Council elects to have holiday decorations installed
on City street light poles, staff recommends:
a) Waive formal bid procedures as per West Covina'
Municipal Code 2-333(i)1.
b) Appropriate $24,300 from General Fund reserve to
Civic Promotion Account (110-320-2630-6120).
c) Authorize the Maintenance Director to enter a .3-
year contract with Dekra-Lite for the lease of
holiday decorations, in an amount not to exceed
$24,300.

This is a status report on the recommendations made by
the City .Council -appointed citizens' Zero Tolerance
Graffiti Task Force. This is the requested review and
recommendations by staff. It is recommended that the
City Council take the following actions:
a) Review the provisions of neighboring cities'
ordinances and direct staff to prepare amendments
to the West Covina Municipal Code as may be
desired.
b) Approve the Task Force's and staff's recommendation
to establish a Gold Paint Brush Award Program.
c) Receive'arid file all other attached status reports
that implement the Task Force's recommendations.

Abatement Ordinance
The City has exclusively used criminal code enforcement
to abate public nuisances but certain situations have
arisen where criminal code enforcement has proven
ineffective. Staff is proposing the establishment of an
administrative public nuisance abatement process for such
cases. Staff recommends that the City Council introduce
an ordinance entitled:

1) Additional Funding for the Coronado Ball Field Lighting
The City Council previously granted the West Youth Pony
Baseball League $15,000 for their ball field lighting
project at Coronado School. The League is requesting an
additional $19,306 to complete the funding for this
project. It is recommended that the City Council approve
the allocation of $19,306 to the West Covina Youth Pony
League pending their commitment to install netting to
stop baseballs from going into neighbors' homes.

a) Informational Report on "Court TV"
During the City Council meeting of October 5, 1993,
Councilmember Herfert requested a report on the
status of "Court TV" and how this programming,
currently offered on a free, limited -time basis,
may be continued. It is recommended that the City
Council receive and file this report.

b) San Gabriel Valley Subregional Plan for the San
Gabriel Valley Association of Cities
The San Gabriel Valley Subregional Plan is designed
as input to the Southern California Association of
Governments' (SLAG) Regional Comprehensive Plan
(RCP). Undertaken by the San Gabriel Valley
Association of Cities (SGVAC), this plan was
prepared through a collaborative effort of 28
cities in the Valley. On September 29, 1993, the
Executive Committee of SGVAC unanimously approved
the Final Draft dated October 1, 1993, which will
be submitted to SCAG for incorporation in the
Regional Comprehensive Plan (RCP). Staff is
recommending that the City Council direct staff to
set a date for a joint City Council/Planning
Commission meeting in order to discuss the content
and recommendations of the San Gabriel Valley
Subregional Plan. Staff further recommends that
the City Council receive and file this report.

c) Animal Services Task Force
At the October 5, 1993 City Council meeting the
Council voted to authorize an Animal Services Task
Force with Councilmember Herfert as the liaison.
Several questions have arisen since the last
Council meeting about the task force, and staff is
bringing this item back to the City Council to
clarify the term of the task force, organizational
structure, and the level of staff support to be
given to the task force. It is recommended that
the City Council provide direction on the scope and
term of the task force, its organizational
structure, and the level of staff support for the
Animal Services Task Force.

Budget Appropriation for BKK Litigation
It is recommended that the City Council consider
and approve a general budget for the BKK
litigation, related legislative affairs and
community information programs, and .appropriate
monies from the General Fund Reserve to cover
anticipated expenditures for Fiscal Year 1993-94.
The City Manager recommend that the City Council
approve the budget at the higher figures with the
condition that staff. and attorneys make every
effort to conserve costs whenever possible. Staff
reviews all billings very closely and both attorney
firms exercise efforts to keep costs as low as
possible without compromising the quality of the
City's legal effort. Since there are not
unrestricted reserves at this time earmarked for
this type of litigation, it is recommended that
funds be appropriated from the General Fund Reserve
as outlined in the staff report.

Councilmember Herfert has requested that a resolution
supporting the City's continued ability to designate
itself as the Hearing Panel be agendized for Council
consideration. It is recommended that the City Council
consider the following resolution:
RESOLUTION NO. - A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF WEST COVINA, CALIFORNIA, SUPPORTING
CURRENT CALIFORNIA LAW WHICH ALLOWS THE WEST COVINA CITY
COUNCIL TO DESIGNATE ITSELF AS THE HEARING PANEL FOR THE
LOCAL SOLID WASTE MANAGEMENT ENFORCEMENT AGENCY
