On December 3, 1992, the City Clerk's Office
received a claim for indemnification pertaining to
a vehicle accident. It is recommended that the
indemnification claim of the City of Walnut filed
on December 3, 1992 be denied and that the
claimant's attorney be so notified.
e) Pete Jimenez vs City of West Covina
The City Clerk's Office received a claim for
reimbursement of vehicle impound fees amounting to
$325.50 on February 1, 1993. It is recommended
that the claim of Pete Jimenez filed on February 1,
1993 be denied and that the claimant be so

That left -turn lanes be installed on the east and
westbound approaches of Merced Avenue to California
Avenue.

Glendora Avenue.
Recommendation:
It is recommended that this request be held over
for further study.
7) City Treasurer's Report (Receive and file)
City Treasurer's Report for the month of February, 1993.
8) Award of Bids
a) GP-93305 - Award of Contract for Office Lighting
Replacement in City Hall, Police, and
Communications Buildings
On March 22,1993, four bids were received and'
opened by the City Clerk for the installation of
new T-8 energy efficient lights and ballasts in
City Hall, Police, and Communications Buildings.
The lowest bid was submitted by Osram/Sylvania
Lighting Services of Anaheim for $118,915. It is
recommended that the City Council take the
following actions:
Transfer $31,612 from GP-91303(161-320-3121-
7500) to GP-93305(161-320-3339-7900);
Transfer $3,388(110-320-2331-6330) to GP-
93305; and
Accept the bid of Osram/Sylvania Lighting
Services in the amount of $118,915 plus $1,085
in contingencies and authorize the Mayor and
City Clerk to execute an agreement with
Osram/Sylvania Lighting Services for the work
to be done.

b)
This contract provides for complete Custodial
Maintenance for three Civic Center Buildings: City
Hall, Police, and Communications. The contractor,
D.H. Maintenance, has requested renewal of the
contract for the third year with a cost reduction
of 5% off the current $5,400 monthly charge. This
will decrease the monthly charge to $5,130. It is
recommended that the City Council grant renewal of
the D. H. Maintenance services contract for the
period of July 1, 1993 to June 30, 1994 with a 5%
contract decrease to $5,130 per month.

a) Sale of Tax Defaulted Property - Walnut Creek
Channel
In accord with provisions of Section 3775 of the
Revenue and Taxation Code, the County of Los
Angeles is required to obtain an agreement from the
governing body of any City as to the purchase and
purchase price of any tax defaulted property within
that jurisdiction. It is recommended that the City
Council review Engineer's report and adopt the
following resolution:
RESOLUTION NO. - A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA,
AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN
AGREEMENT WITH THE COUNTY OF LOS ANGELES, IN
COMPLIANCE WITH SECTION 3775 OF THE REVENUE AND
TAXATION CODE FOR THE' PURCHASE OF TAX DEFAULTED
PROPERTY IN THE RIGHT-OF-WAY OF WALNUT CREEK
CHANNEL.
b) Street Vacation of South Hills Drive - Mark Booth
The property owner at the southwesterly corner of
Queen Summit and South Hills has requested that the
adjacent portion of South Hills be vacated. The
area is approximately 60 feet wide and 165 feet
long. Because of topographic conditions and the
developments adjacent and southerly to South Hills
Drive, it is never expected that South Hills will
be extended southerly to connect to Aroma Drive.
With the approval of a Resolution of Intent to
Vacate, a hearing date for this vacation will be
set for May 4, 1993. It is recommended that the
City Council review Engineer's report and adopt the
following Resolution:

d) Renewal of Lease Space Between City of West Covina
and Los Angeles Count
The Council will decide whether or not to renew an
existing lease for a crime laboratory and office
space for use by Los Angeles County in the West
Covina Police Department for a three-year period.
It is recommended that the City Council authorize
the Mayor and City Clerk to execute a lease with
Los Angeles.County Facilities Management Department
for the lease of 891 square feet of laboratory
space in the West Covina Police Department for a
three-year period at a rate of $172.50 per month.
e) Audit Contract
This report requests the City Council to approve
the audit contract for the fiscal year ended June
30, 1993. It is recommended that the City Council
authorize the Finance Director to extend the
agreement with Moreland & Associates to perform
annual financial and compliance audits of the City,
Agency, and Authorities, records for the fiscal
year ended June 30, 1993, for $41,700. .

f). Weed Abatement 1993
This request provides for the lawful and safe
removal of dangerous and/or noxious weeds and trash
from vacant improved properties and vacant
unimproved properties in the City of West Covina
during the 1993 calendar year. It is recommended

International Union, AFL-CIO, Local 347
The City has completed the meet and confer process
with the Service Employees' International Union,
AFL-CIO, Local 347, representing Maintenance
employees and reached agreement. This item
transmits the resulting Memorandum of Understanding
(MOU) and an implementing resolution. The City
Council is asked to receive and file the MOU in
acknowledgement of the written memorialization of
the agreement terms and adopt the implementing
benefit Resolution as follows:

1) City Proiect WP-90103/Leak Detection Program - Selection
of Consultant
The leak detection program will reduce the City's Water
Department water and revenue losses from underground
leaks. Proposals have been submitted by four (4)
consultants. Staff proposes using Fluid Conservation
Systems, Inc., at a cost of $11,675.51. It is
recommended that the City Council accept the proposal of
Fluid Conservation Systems, Inc. of Austin, Texas; in the
amount of $11,675.51, and authorize the Mayor and City
Clerk to execute a Consultant's Agreement with said Fluid
Conservation Systems, Inc. for the work to be done.

2) City Project WP-93112 -
Wxfar TA "a Tlua4m" - Calu
The third phase of providing a second source of water for
the City's Water Department is the provision of further
storage capacity. Since the design of reservoirs and
pumping stations is a very specialized work, the City
requested proposals from engineering consultants and
received three responsive proposals ranging from $150,264
to $168,705. Staff proposes using J.F. Davidson
Associates, Inc. from Ontario at a "Not to Exceed" amount
of $150,264. It is recommended that the City Council
take the following actions:
a) Transfer $25,000 from Water Revenue Bond funds to
City Project WP-93112; and
b) Accept the proposal of J.F. Davidson Associates,
Inc. of Ontario, California, in a "Not to Exceed"
amount of $150,264, and authorize the Mayor and
City Clerk to execute a Consultant's Agreement with
said J.F. Davidson Associates, Inc. for the work to
be done.

1) Galster Park Stream
to
The Galster Park stream was temporarily closed from March
19, 1993 through March 29, 1993 due to possible
contamination from the BKK Landfill. Water sample
results indicated that there was no evidence of
contamination, therefore the stream was reopened. It is
recommended that this report be received and filed.

b) Formation of the West Covina Auto Plaza Business
Improvement District
Transmitted for City Council consideration is a
Resolution of Intention, which establishes a
parking and business improvement district for the
West Covina Auto Plaza and levies assessments
within that area for the purpose of constructing
and maintaining an electronic readerboard. The
resolution also sets a public hearing date for June
1, 1993. It is recommended that the City Council
adopt the following resolution:
RESOLUTION NO. - A RESOLUTION OF INTENTION OF
THE CITY COUNCIL OF THE CITY OF WEST COVINA,
CALIFORNIA, TO ESTABLISH A PARKING AND BUSINESS
IMPROVEMENT AREA IN THE WEST COVINA AUTO PLAZA AND
LEVY ASSESSMENTS WITHIN THAT AREA, AND NOTICE OF
PUBLIC MEETING AND HEARING THEREON TO BE CONDUCTED

Telephone System Upgrade
This report recommends that the City's
switch be upgraded with the current
version and that the necessary interface
and instruments be purchased from Rolm,
upgrade the telephone instruments at City
Fire Station 1. It is recommended that
Council authorize staff to:

Approve the purchase from Rolm, Inc. of
Torrance, CA, of: 1) OCIG telephone switch
software to upgrade the City's Saturn III
telephone switch; and 2) a Saturn II satellite
switch with all associated hardware and
telephone instruments to upgrade -the City
Yard/Fire Station 1 complex at a total cost
not to exceed $74, 836.87.

Automation of the Telephone Switchboard Operations
This report recommends that our telephone
switchboard operation be converted to an Automated
Attendant operation and that the Switchboard
Operator position be eliminated. It is recommended
that the City Council authorize staff to:
Proceed with. plans to automate the City's
telephone switchboard function and include a
voice mail capability; and
Employ the services of Mr. Don Bushor, COM
CONSULTANTS, to assist staff with the
preparation of bid specifications, evaluation
of bid responses, and implementation of the
system selected, for an overall fee not to
exceed $9,500; and
Transfer $40,000 from the City's
Unappropriated Fund Balance to Account 110-
320-2190-7150.

Amendment of the Transient Occupancy Tax, City Municipal
Code Section 21-43 through 21-59
Staff is requesting that the Transient Occupancy Tax,
Section 21-43 through 21-59 of the Municipal Code (Code)
be amended to clarify vague and gender specific language;
allow the City to recover costs of auditing in instances
of noncompliance with the Code; eliminate tax exemptions
for local government employees; increase the record
retention period from three to five years; and increase
interest charged on untimely payments. It is recommended
that the City Council amend the City Municipal Code by
introducing the following ordinance:

Alhambra State Budget Law Suit
(Alhambra v. Ikemoto)
This is an informational report on the lawsuit
filed by the City of Alhambra against the State of
California to prevent the State from diverting
revenues from cities and redevelopment agencies in
an effort to balance the State's budget. Inasmuch
as the League of California Cities and the
California Redevelopment Association are evaluating
the suit and its implications, it is recommended
that the matter of the City of West Covina/West
Covina Redevelopment Agency taking a position on
the lawsuit and its hearing in the Second District
Court of Appeals be carried over to the City
Council meeting of April 20, 1993. There is no
question that all cities and redevelopment agencies
in the State can support the underlying philosophy
of "home rule" embraced by the Alhambra suit.
However, in light of the importance of the issues
raised by the Alhambra lawsuit, and inasmuch as the
League of California Cities and the California
Redevelopment Association are evaluating the suit
and its implications, it is recommended that.the

b) Proposed Reorganization

A reorganization is proposed of the Public Works
and Building and Safety Departments. The
reorganization would consolidate activities
currently performed by three departments into two
departments with an initial estimated annual
savings of $130,000. There could be a one time
cost of not more than $20,000 to make the physical
changes necessary to implement the reorganization.
It is expected that the present level of service to
the public would be maintained after the
reorganization. It is recommended that this report
be received and filed.

c) Chamber of Commerce Auto Promotion
The Chamber of Commerce will hold a promotional
event featuring local auto dealers on June 5 & 6 at
Eastland Center. The purpose of the event is to
showcase the dealers, to maintain a favorable
market position for each dealer, and to attract a
wider coverage area of customers to this area. The
event is proposed to be funded 83% by participating
auto dealers. The Chamber of Commerce has
requested that the remaining 17% be funded by
Business Improvement Tax proceeds. It is
recommended that the City Council approve the use
of $15,000 for the auto promotion and appropriate
$9,000 from the Business Improvement Tax fund for
this purpose.

1) Amendment No. 2 to the Foothill Transit Joint Exercise of
Powers Agreement
The original service area for Foothill Transit
encompassed two supervisorial districts. Due to the
recent Los Angeles County redistricting, the service area
for Foothill Transit now lies in three districts.
Accordingly the agreement must be amended to reflect the
increase to three districts and provide for a
representative from each district. It is recommended
that the City Council:
a) Approve Amendment Number 2 to the Foothill Transit
Joint Exercise of Powers Agreement; and
b) Authorize the Mayor and the City Clerk to execute
Amendment Number 2 to the Foothill Transit Joint
Exercise of Powers Agreement.
