SUMMARY: On December 8, 1992, the Planning Commission approved a Preliminary
Plan which designates the boundaries of the amended/merged
redevelopment project area. The City Council has ninety days from
that date to approve the membership of a Project Area Committee
(PAC). The first step in the selection of a Project Area Committee
is the adoption, by resolution of the City Council, of a procedure
for the formation of the PAC.
BACKGROUND
The City Council has initiated the procedure for the merger and amendment of the
Eastland and Central Business District Redevelopment Plans and the tentative
amendment of the. Central Business District (CBD) with respect to extension of the
time frame for the use of eminent domain within Parcel D of the CBD. The
tentative amendment of the CBD Redevelopment Plan is a relatively brief process
and will be implemented concurrently with the process of merging and amending the
Eastland and CBD Redevelopment Plans. Because the tentative amendment of the CBD
Redevelopment Plan does not include the addition of new area, adoption of a
Preliminary Plan by the Planning Commission is not required for that amendment
process. The brief procedure associated with the amendment of the CBD
Redevelopment Plan is initiated upon direction from the Council, which was
provided on November 18, 1992.
However, the parallel process of merging and amending the Eastland and CBD
Redevelopment Plans does include the addition of new areas. The more lengthy
merger and amendment process is initiated by the Planning Commission's adoption
of the Preliminary Plan which describes the proposed project area boundaries and
provides a.general statement of land uses, street layout, population densities,
building intensities, and development standards. The merger and amendment
procedure will include a blight study of the proposed added areas and will
involve fiscal review by affected taxing agencies.
Both the merger and amendment of the Eastland and CBD Redevelopment Plans and the
tentative amendment of the CBD Redevelopment Plan with respect to eminent domain
(within Parcel D) require the formation of a Project Area Committee (PAC). A PAC
is created when a substantial number of low- and moderate -income families may be
displaced by the Redevelopment Plan. Although "substantial" is not defined
within California Redevelopment Law, it is the position of the Agency's legal
counsel that the creation of a PAC is warranted for both phases of the proposed
amendment. After formation, the PAC reviews the amended redevelopment plans and
may prepare a report and recommendation to the Agency regarding adoption of the
plans. The PAC continues to serve as an advisory body to the Agency for three
years, reviewing only those issues pertaining to relocation of residents
displaced by Agency projects.
On December 8, 1992, the Planning Commission approved a Preliminary Plan for the
merger and amendment of the Eastland and CBD project areas. The City Council has
ninety days from that date to approve the membership of a Project Area Committee.
The first step in the selection of a Project Area Committee is the adoption, by
resolution of the City Council, of a procedure for the formation of the PAC.
ANALYSIS
California Health and Safety Code Section 33385 requires that the City Council
adopt by resolution a procedure for the formation of the Project Area Committee.
The procedure must include:
• publicizing the opportunity to serve on the PAC;
• provision for at least one public meeting to explain the establishment of,
the functions of and the opportunity to serve on the PAC. At the meeting,

the Agency (staff) must distribute copies of the procedures for forming
the PAC, the current redevelopment plan or pertinent portions thereof, and
any other materials the staff feels are useful;
• provision for publishing notices of all meetings or hearings conducted by,
or on be of the Agency or City Council regarding the formation and
selection of the PAC. Notices must be published at .least once in a
newspaper of general circulation at least ten days prior to the hearing
or, if there is no such newspaper, posted in at, least three public places
at least ten days prior to the hearing; and
• provision of written notice to all residents and businesses in the project
area (existing and proposed) of all meetings or hearings conducted by, or
on behalf of the Agency or City Council regarding the formation and
selection of the PAC.
A PAC is comprised., as applicable, of residential owner occupants, residential
tenants, business owners and representatives of the existing organizations within
the project area. The Agency must provide funding for the. operation of the PAC,
other than .for litigation. The members of the committee serve without
compensation.
The Procedure for Formation -of the Project Area .Committee transmitted for the
City Council's review complies with the legal -requirements outlined above. The
procedure provides for at least one informational public meeting, a PAC election
meeting and presentation of the results of the PAC election to the City Council.
The procedure also describes the community notification requirements, the
election process and the potential composition of the PAC membership.
The procedure provides for.15 committee members representing four categories
including Residential Owner Occupant., Residential Tenant, Business Owner and
Community Organization. The 15-member PAC includes a five -member subset (the
"CBD PAC"), which will be elected from representatives within the CBD Parcel D
only and will make a recommendation to'the Council on the amendment relative to
that parcel. The five -member CBD PAC will also -serve as members of the larger
PAC and will share the responsibilities of that committee. The procedure
describes the composition of .both the larger 15-member committee and the five -
member subset'.
RECOMMENDATION
It is recommended that the City Council adopt the following resolution:

WHEREAS, the Redevelopment Agency of the City of West Covina (the "Agency")
has initiated proceedings to amend and.merge the Eastland and Central Business
District Redevelopment Plans (the "Plan Amendment/Merger") and to amend the
Central Business District Plan (the "CBD Plan Amendment") with respect to the
extension of the power�of eminent domain within Parcel D of the Central Business
District Project Area; and
WHEREAS, the City. Council of the City of West Covina (the "City Council")
desires to establish a Project Area Committee to assist with the process of
reviewing the proposed Plan Amendment/Merger and the CBD Plan Amendment, and
after the adoption of the Amended and Merged P1 an, 'to advi se and consul t with the
Agency and the City Council with respect to those matters pertaining to the
relocation of low- and moderate -income households within the project area; and
WHEREAS, Section 33385 of the California Health and Safety Code requires
the City Council to adopt a procedure, by resolution, for the formation of the
Project Area Committee.
NOW, THEREFORE, KIT RESOLVED, by the City Council of the City of West
Covina as follows:
1. The document entitled "Procedure for the Formation of the Project.
Area Committee," a.copy of which is attached hereto as Exhibit A, is hereby
adopted as the procedure to be followed for the formation of the Project Area
Committee.
2.' The City Clerk shall certify to the adoption of this Resolution.

CENTRAL BUSINESS DISTRICT REDEVELOPMENT PLANS
I. (1001 GENERAL
A. [1011 Purpose
The purpose of this document is to set forth a procedure for
formation of -a Project Area Committee (the -"PAC") for the merger and amendment
of the Eastland and Central Business District Redevelopment Project Areas and the
amendment of the Central Business District (CBD) Redevelopment Plan with respect
to extension of the time frame for the use of eminent domain within Parcel D of
the CBD This document also addresses the creation of a subset (defined under
"CBD PAC") of the larger PAC. The CBD PAC will take action as described under
California Redevelopment Law (California Health and Safety Code 33385.5) with
reference to the amendment of the Central Business District Redevelopment Plan,
Parcel D. The CBD PAC will also share the responsibilities of the larger
committee with respect to the amendment/merger of the Eastland and Central
Business District Redevelopment Plans, and other responsibilities described under
California Redevelopment Law (Health and Safety Code Section 33386). Sections
33385 and 33385.5 of the Community Redevelopment Law (California Health and
Safety Code §33000 et sea.) (the "Act") require formation of a PAC for the
amendment of a redevelopment plan if a substantial number of low- and moderate -
income families are to be displaced by a redevelopment project. Section 33385
requires that the City Council of the City of West Covina adopt a procedure for
formation of the PAC. The procedure established herein shall be used to govern,
formation of the PAC.
B. [1021 Authority
This procedure was approved and adopted on 1993 by
Resolution No. of the City Council of the City of West Covina.
C. (1031 Definitions
For the purposes herein.:
1. "Added Area" means that property proposed to be added to the
Project Area by Resolution No. 12-92-4123 of the Planning Commission, as shown
on the Project Area Map attached hereto as Exhibit "A" and incorporated herein
by this reference.
2. "Agency" means the City of West Covina Redevelopment Agency,
a public body corporate and politic, which exercises powers as a redevelopment
agency under the Act.
3. "Amended Project" means the "Project" as proposed to be amended
pursuant to the Preliminary Plan adopted by the City Planning Commission by
Resolution No.'12-92-4123 on December 8, 1992.
4. "Business" means any lawful activity, whether or not carried
on for profit, which is conducted within the Project Area for (i) the purchase,
sale, lease or rental of tangible or intangible personal property (a "Retail
Business"); (ii) the manufacture, processing or marketing of products,
commodities or any other personal property (a "Manufacturing Business"); or (iii)
the sale of services to the public (a "Service Business").
5. "Business Owner" means a Person who owns a business located
within the Project Area and as defined in paragraph 4 above.
6. "City" means the City of West Covina, California, a municipal
corporation.
7. "City Councilff. means the City Council of the City, exercising
powers as the legislative body under the Act.
8. "Existing Community Organization means any nonprofit
association of Persons organized for religious entrepreneurial, scientific,
educational, literary or other purposes, which conducts its regularly scheduled
meetings within the boundaries of the Project Area and uses an address located
within the Project Area for its office or headquarters.
9. "Existing Area" means that portion of property located within
the existing Project Areas, as shown on the Project Area Map attached hereto as
Exhibit "A."
10. "Person" means, but is not limited to, an individual,
household, family, proprietorship, partnership, business trust, joint venture,
syndicate, corporation or association.
11. "Project Area" means the Existing Area and the Added Area.
12. "Project Area Committee" or "PAC" means the committee formed
and selected in accordance with Section 33385, et seq. of the Act and the
procedure set forth herein.
13. "Larger Project Area Committee or "Larger PAC" means the
fifteen -member committee which has been formed with respect to the
amendment/merger of the Eastland and Central Business District Redevelopment
Plans.

14. "CBD Project Area Committee" or "CBD PAC" means the five -member
committee which is a subset of the Larger Pac and has been formed with respect
to the amendment of the CBD Redevelopment Plan relating to the extension of the
time frame for the use of eminent domain within Parcel D of the Central Business
District.
15. "Resident "means a Residential Owner -Occupant or Residential
Tenant.
16. "Residential Owner -Occupant" means a Person who owns a dwelling
unit in the Project Area and occupies such dwelling unit as the Person's
permanent residence and usual place of abode.
17. "Residential Tenant" means a Person who rents a dwelling unit
in the Project Area pursuant to a rental agreement and has occupied such dwelling
unit as a permanent residence and usual place of abode for not less than ninety
(90) days prior to the submittal of a completed PAC application as described in
Section 501 herein.

II. [200]
PUBLIC MEETINGS
A. (201] Informational Meetings
'The Agency staff shall conduct at least one public meeting to explain
the establishment and function of the PAC, and the opportunity to serve on the
PAC. At such meetings the Agency staff shall distribute and make available to
each attendee: (i) a copy of this procedure, (ii) the pertinent portions of the
existing Redevelopment Plan and a project description of the proposed amendment
to -such Redevelopment Plan, (iii) applications for PAC membership, and (iv) any
other materials the Agency staff determines would be useful, including, but not
limited to Health and Safety Code § 33385 and 33385.5.
B. [202] PAC Election Meeting
Within seventy-five (75) days following the date of adoption of
Resolution 'No. 12-92-4123 of the Planning Commission, the Agency staff .shall
conduct a meeting to complete the formation and selection of the PAC. At such
meeting an election for seats on the PAC (the "PAC Election") shall be held in
accordance with Section 500 herein.
C. [203] Presentation of PAC to City Council
The Agency staff shall 'present the results of the PAC Election to the
City Council at the first regular meeting of the City Council following the PAC
Election, which date shall be announced -at the PAC Election meeting. The City -
Council shall make the determination as to whether the PAC is "representative,"
and if determined to be representative, approve the results of the PAC Election
within ninety (90) days following the date of adoption of Resolution No. 12-92-
4123 of the Planning Commission.
III. [300] NOTICE OF MEETINGS, HEARINGS AND PLEBISCITES
.The Agency shall publish notice of all meetings, hearings, or plebiscites
conducted by the Agency or the City Council relative to the formation and
selection of the PAC, and the opportunity to serve on the PAC.
A. (301] Publication of Notice
The Agency shall, publish notice of each meeting, hearing, or
plebiscite at least one time in a newspaper of general circulation in. the City
at least ten (.10) days prior to the date for each meeting, hearing or plebiscite.
The notice shall include: (1) the date, time, and place of each meeting, hearing
or plebiscite, (12) the identity of the body conducting such meeting, hearing or
plebiscite, (3) a general explanation of the matters to be considered, (4) a
general description of the Project Area, in text or by diagram, (5) a statement
that a PAC will be formed for the Project Area, (6) a general description of the
duties of PAC members, and (7) a general statement of the criteria for
eligibility to vote for PAC members and serve on the PAC.
B. [302] Notice by Mail
The Agency staff shall mail written notice to all Residents,
Businesses and Existing Community Organizations in the Project Area of all
meetings, hearings or plebiscites conducted by, or on behalf of, the Agency or

the City Council relative.to the formation and selection of the PAC. This mailed
notice requirement shall only apply if mailing addresses of all Residents,
Businesses, Existing Community Organizations, or of all occupants, are obtainable.
by the Agency at a reasonable cost. The notice shall be mailed by first-class
mail, but may be addressed to "occupant. ° In lieu of providing separate notice
for each meeting, hearing or plebiscite, the Agency may provide a single -notice
pursuant to this section stating all dates, times, and locations of any meetings,
hearings and plebiscites relative to the formation and selection of the PAC..
If the Agency has acted in good faith .to comply with the notice
requirements of this Section 302, the failure of the Agency to provide the
required notice to Residents or Businesses unknown. to the Agency or whose
addresses could not be obtained at .a reasonable cost, shall not, in and of
itself, invalidate the formation or actions of the PAC.
C. [303] Other Forms of Notice
In addition to the notice required by Sections 361 and 302, the
Agency may post notices, distribute flyers, purchase radio or newspaper display
advertisements or undertake such other actions as it deems necessary or desirable
to further inform Residents, Businesses, and Existing Community Organizations of
the formation of the PAC.
D. . [304] Foreign Languages
Any of the notices or announcements required herein maybe translated
into another language if the Agency determines that such translation is necessary
to effectively publicize the opportunity to serve on the PAC and participate in
the formation and selection of the PAC.
IV. [400] COMPOSITION OF PAC MEMBERSHIP

A. [401] Categories
The PAC shall be composed of fifteen (15) members which shall
comprise the Larger Project Area Committee for the amendment/merger of the
Eastland and Central Business District Redevelopment Plans. Five members of.the
Larger Project Area Committee (Larger PAC) shall also meet as a separate Project
Area Committee (CBD PAC) which shall take. action on matters relevant to the
separate amendment of the Central Business District Redevelopment Plan. The
representatives. of the CBD PAC shall be separately eligible for membership in the
CBD PAC in accordance with Section 502 hereof. The Larger Project Area Committee
and the CBD PAC shall include the number of representatives listed in each of the
following categories:

B. [402] Vacancies in Membership Categories --
Adjustments of Composition of PAC
If an insufficient number of candidates are elected to represent each
category of membership on the PAC, such seats -may remain vacant until qualified
and eligible candidates are selected by the City Council. The existence of 'any
vacancies shall not prevent formation of the PAC.
V. [500] ELECTION PROCESS
A. [501] PAC Applications
A candidate for PAC membership must submit a completed PAC
Application to the Agency office, which application must be received by the
Agency by Friday, February 5, 1993. A copy of the "PAC Application." is attached
hereto as Exhibit "B" and incorporated herein by this reference. All PAC
Applications submitted shall be available to the general public for review
beginning on the business day following submittal. All PAC Applications shall
be available at the first PAC informational meeting described in Section 201
above, and thereafter at the Agency office until the date when PAC Applications
are due. The -Agency office is located at 1444 West Garvey Avenue South, Room
218, West Covina, CA 91790, (818) 814-8417.
B. [502] Eligibility Requirements for PAC Membership
Upon submittal of a PAC Application candidates for PAC membership
must present evidence that they are eighteen (18) years of age or older..
Candidates are advised that the Fair Political Practices Commission requires
elected PAC Members to complete Statements of Economic Interest which disclose
certain personal financial information concerning such PAC Member. Candidates
may only run for one.category of PAC membership and must present a valid
California identification card, driver's license, military identification, or
similar identification and the following evidence as eligibility for the
applicable category:
1. Residential Owner -Occupant: Recorded grant deed or property
tax bill
2. Residential Tenant: Executed rental agreement or rent receipt.
3. Business Property Owner: Recorded grant deed, property tax
bill, or business license issued by State of California or City..
4. Existinct Community Organization: Each of the following: (i)
proof of existence of the organization at the time the Added Area boundaries were
selected by the Planning .Commission of the City, (ii) proof of existence and
operation within the Project Area, such as articles of incorporation, bylaws or
business license, and (iii) a resolution of the.Board of Directors or Chairman
of such organization authorizing a Person to act on its behalf.

C. [503] Voter Registration
Anyone desiring to vote at the PAC Election must register prior to
voting by providing satisfactory evidence to the Agency staff that he or she is
(1) at least eighteen (18) years of age or older and (2) is a Resident in the
Project Area, or is the authorized representative of a Business or Existing
Community Organization. Any of the following documents, where appropriate to the
category of the'.voter, may be provided as evidence of eligibility to vote:
1. California Driver's License
2. California Identification Card or Military Identification
3. Rental agreement.

8. Utility bill ,

D. [504] Candidate Speeches
All candidates for each PAC membership category (i) Resident, (ii)
Business, (iii) Existing Community Organization shall be given an opportunity to
make a speech at the PAC Election meeting. The Agency staff shall establish a
time limit for each speech and reasonable rules of order, consideringthe number
of candidates running in the PAC Election.
E. [505] Voting Categories
Each voter may cast ballots for representatives of that voter's PAC
membership category only-
F.- [506] Balloting
Ballots shall be provided to registered voters. for each PAC
membership category, i.e., a Residents .ballot, a Businesses ballot, and an
Existing Community Organizations ballot. Voting shall be.conducted by secret
ballot. The Agency staff shall appoint authorized election assistants to collect
and tally the ballots. The Agency staff shall -ensure secrecy of the ballot by
requiring each ballot to be folded and passed to an authorized election
assistant. The.election assistants shall tally the ballots at the PAC Election
meeting. A representative from the Ci_ly Clerk'.s office shall be present when the

ballots are tallied to provide official verification of the results of the PAC
Election.
G. [507] Results/Runoffs
1 The Agency staff shall announce the results of the PAC Election at
the PAC Election meeting when the ballots are tallied. If a runoff is necessary
it shall be announced immediately. At the PAC Election meeting, the Agency staff
shall announce that the results and ballots shall be maintained by the Agency
staff for presentation to the City Council.
VI. [600] SPECIAL PROVISIONS
A. [601] Compensation of PAC Members
The members of the PAC shall serve without compensation.,
B. [602] Amendment of Procedure
The procedure -established herein may be amended from time to time by
resolution of the City Council.
