The subject amendment was prompted by the recent approval
of changes to the zoning code to include provisions for
a Materials Recovery Facility and Solid Waste Transfer or
Processing Station in the City's industrial and
manufacturing zones. Consistent with this action,
Amendment No. 250 is intended to establish a
corresponding business license category for these uses.
In order to coordinate the specific language of Amendment
No. 250 with interested parties, it is recommended that
this item be continued to the July 21, 1992 City Council
meeting. This will allow staff time to obtain any
additional input and address potential issues prior to
bringing a final draft to City Council.

This agreement provides for daily janitorial
services for the City Yard Administration Building,
Cameron Youth Center, Palmview Center and the
Senior Citizens' Center from Valley Light
Industries. Services rendered under the terms of
this agreement will cost $5,062.22 per month. The
contract has not had a cost increase in the last
two years, and the contractor is requesting. a 6%
increase (3% per year). Additional costs are
included for the Senior Center Expansion area. It
is recommended that the City retain the services of
Valley Light Industries and that the increase in
fees be incorporated in the Agreement Renewal.
Park Properties Annual Landscape Contract Renewal
This contract provides for the landscape
maintenance of city parks which include Woodgrove,
Shadow Oak, Gingrich and Friendship Parks,
respectively, in addition to landscaping north of
Valley Boulevard at Morganfield Avenue. Azteca
Landscape Maintenance Company, I c. is requesting
renewal of the contract for the fMrth year with an
increase of 3.6%, this will increase the. annual
cost from $117,923.16 to $122,168.39. It is
recommended that the City Council grant renewal of
the Azteca Landscape Maintenance Company contract
for the coming twelve month period, and approve the
3.6% increase in annual cost.
Pump Station No. 4 Settlement Agreement and
Release (WP-87109)
This proposed Agreement settles the litigation
which has been taking place between the Contractor
for Pump Station B-4, the Electrical Sub-
contractor, Suburban Water Systems and the City at
a cost to the City of $58,300 plus our Attorney's
fees of approximately.$11,000. It is recommended
that the City Council approve the Settlement
Agreement and Release in an amount not to exceed
$58,300 and authorize the Mayor and City Clerk to
execute this agreement.

7) Ordinance(s) for Adoption (Waive reading and adopt)
a) Amendment to the City's PERS Retirement Contract
for Safety Employees
b)
Council has introduced an ordinance authorizing an
amendment to the contract between the Board of
Administration of the Public Employees' Retirement
System and the City Council of the City of West
Covina which allows safety employees to purchase,
at their expense, prior military service time to be
applied towards retirement credit. It is
recommended that the City Council adopt the
following ordinance:

AUTHORIZING AN AMENDMENT TO THE CONTRACT BETWEEN

OF THE CITY OF WEST COVINA.
At the June 2, 1992 City Council meeting, an
ordinance was introduced which would clarify the
West Covina Municipal Code Section 21-90 as it
relates to the intent of the City's Construction
Tax. It is recommended that the City Council adopt
the following ordinance:

8) Award of Bids
a) City Project SP-92120 - Street Rehabilitation,
Phase II
Seven (7) bids were received on Wednesday, June 3,
1992 for this project, which consists of asphaltic
concrete overlay and slurry seal. work for various
locations, Citywide. The lowest responsible bid is
$144,634.50 from Paladin Construction Co., Inc. of
Rancho Cucamonga, CA. It is recommended that the
City Council transfer $166,000 from Project. SP-
92102 to Project SP-92120 as outlined in the staff
report, and accept the bid of Paladin Construction,
Inc. of Rancho Cucamonga, Ca. in the amount of
$144,634.50 as submitted at the bid opening on
Wednesday, June 3, 1992 and authorize the Mayor and
City Clerk to execute an agreement with same for
the work to be done.

b) Award of Bid for Office Supplies
In order to maintain discount prices, quality
merchandise and service, staff is proposing to
contact with Eastman, Inc., of Los Angeles for
office supplies. It is recommended that the City
Council take the following actions:
i) Find that the use of. Eastman, Inc. Is Bid No.
SB-38-92 with the City of Fontana eliminates
the need for the use of a formal bid process;
and
ii) Authorize staff to contract with Eastman,
Inc., of Los Angeles for office supplies on a
one (1) year contract with the option of the
three (3) one-year renewable terms.
c) Computer Software Purchase (MDT Project)
The Police Department has 'chosen a vendor who will
provide the computer software necessary for the
Mobile Data Terminal project to be implemented and
completed. It is recommended that the City Council
authorize staff to expend funds, not exceeding
$45,000, including contingencies, with Public
Safety Technologies for the purchase of MDT project
software from Drug Enforcement Rebate.
9) Miscellaneous
Appropriations Limit for Fiscal Year 1992-1993
Article XIIIB of the California Constitution imposes an
appropriations limit on units of State and local
government. This report requests adoption of the 1992-93
appropriations limit for the City of West Covina. It is
recommended that the City Council adopt the following
resolution: •

1) Approval of Sole Source Purchase of Computer Network
System Software
In an effort to expand both the access and performance of
the Work Management System, the City Council has
appropriated sufficient funds to purchase a computer
network system. The Maintenance Department is seeking
Council approval to pursue the procurement of the multi-
user software through a sole source purchase. The sole
source vendor has the only software that is compatible
with our present system. It is recommended that City
Council waive the formal bid procedures and approve the
purchase of the multi-user software from ITX Technologies
through a sole source process in an amount not to exceed
$21,700.

This is a report on the negotiation of a monthly
rate for West Covina Disposal to implement an
automated residential waste collection service. It

The proposal is to contract with Kleinf elder of
Diamond Bar to assist in the technical and
financial review of the Athens Disposal materials
recovery facility proposal. It is recommended that
the City Council approve the contract with
Kleinfelder to provide MRF review services to the
City at a cost not to exceed $6,000.

d) San Gabriel Valley Waste Reduction Marketing Plan
The East San Gabriel Valley Integrated Waste
Management Joint Powers Authority is requesting
that the City of West Covina file an application
for grant funds from the California Department of
Conservation, Division of Recycling. The funds
would be used to develop a regional marketing
program for the member agencies of the Authority to
promote recycling and waste reduction activities in
the San Gabriel Valley. Any share of funding from
the City will be from the Integrated Waste
Management Fund. It is recommended that the City
Council approve the submission of a grant
application on behalf of the East San Gabriel
Valley Integrated Waste Management Joint Powers
Authority by adopting the following resolution:

Federal regulations implementing the Americans with
Disabilities Act require that cities participate in
a coordinated paratransit plan and adopt a final

final plan which fulfills our City's obligation to

The Senior Citizens, Commission is recommending
extending the Dial -A -Ride service to weekends for
elderly and disabled residents. Weekend service
would be available between 10 a.m. and 6 p.m. on a
one year pilot program commencing July 1, 1992. It
is recommended that the City Council:
i) Approve Amendment #3 to the Westpark Dial -A -
Ride Agreement (June 25, 1990); and
ii) Authorize the allocation of-$20,000 to the
Dial -A -Ride program from the Prop A
unobligated funds account to provide weekend
service.

a) Workers' Compensation Claims Administration Contract
Renewal
On June 30, 1992 the City's Workers' Compensation
Administration Service Agreement with Colen and Lee
expires. For Fiscal Year 1992-93, Colen and Lee
has proposed an increase of $30.00 from $620.00 to
$650.00 per claim based on an average number of 93
claims per year. It is recommended that the City
Council execute the Service Renewal Agreement with
Colen and Lee, establishing monthly service fees of
$5,040.00 beginning July 1, 1992 and extending the
effective date of the contract through June 30,
1993.

b) General and Auto Liability Claims Administration
Contract Renewal
On June 30, 1992 the City's General and Auto
Liability Administration Service Agreement with
Colen and Lee expires. For Fiscal Year 1992-93,
Colen and Lee has proposed an increase of $20.00
from $400.00 to $420.00 per claim based on an
average number of 74 claims per year. It is
recommended that the City Council execute the
Service Renewal Agreement with Colen and Lee,
establishing monthly service fees of $2,590.00
beginning July 1, 1992 and extending the effective
date of the contract through June 30, 1993.

Jail Telephone Agreement with Pay -Tel of America
to
Pay -Tel of America, Incorporated, has offered to install
and maintain, at no cost to the City, coinless pay
telephones inside the City's jail cells. In return for
this exclusive right, the City will receive 28.2% of the
revenues collected, and more importantly, reduce the time
consuming task of moving prisoners within the jail area.
This report recommends approval of a written agreement
with Pay -Tel of America. It is recommended that the City
Council authorize staff to execute an agreement with Pay -
Tel of America, Incorporated, for the installation of
coinless pay telephones in the City's jail cells..

In June, 1991, the City Council and Redevelopment
Agency Board approved the sale by the City to the
Redevelopment Agency of a 1.29 acre parcel on
Barranca Avenue for development of affordable
senior citizen housing, subject to the completion
of a Phase I environmental assessment and other

b) Status Report on WCCT Channel 56
The existing agreement between the City of West
Covina, CENCOM Communications, and Mount San
Antonio College, which is the foundation for West
Covina's municipal and public access channel WCCT,
is due to expire on August 3, 1992. Under current
budgetary and operational conditions at Mount San
Antonio College, it is likely that WCCT may
experience significant changes or potentially cease
to exist after that date. Staff has prepared a
status report on this situation. It is recommended
that the City Council receive and file this report.

STATE BUDGET CRISIS
The City Manager will present a status report on the
State Legislature's efforts to resolve the current
State budget crisis and the impacts that a loss of
up to $4.5 million will have on the City of West Covina.
