Yauchzee, Director/City Engineer Public Works Department AGENDA ITEM NO. D-2 DATE February 1, 2005 SUBJECT: FIVE-YEAR EXTENSION OF THE MEDIAN LANDSCAPE MAINTENANCE CONTRACT PROJECT NO. CWM-99-11 RECOMMENDATION: It is recommended that the City Council waive the formal bidding process per Section 2.333 (i) (2) of the West Covina Municipal Code and extend the existing contract with Mariposa Horticultural Enterprises, Inc. for an additional five years at no increase in the contract amount, and authorize the Public Works Director/City Engineer and City Clerk to execute such contract. DISCUSSION: On November 2, 1999, the City Council awarded Mariposa Horticultural Enterprises, Inc. of Irwindale a five-year contract for the maintenance of landscaping, hardscaping, and sprinkler systems of City medians and right-of-ways. Mariposa has since offered a five-year contract extension at the current service level with no increase in the contract amount. Mariposa has performed landscape maintenance for the City since 1996. The City may terminate this new contract without cause upon 30 days written notice. ALTERNATIVES: An alternative to staff recommendation is to reject Mariposa Horticultural Enterprises, Inc. offer to extend the five-year contract and allow the work to be put out for public bid. As it is highly unlikely that putting the work out for public bid would reduce the current costs and would likely increase costs. Staff does not recommend this time consuming and costly alternative. FISCAL IMPACT: The annual contract amount of $117,600.00 has been budgeted. into the 2004-2005 Citywide Landscape District Budget (110.41.4141.6135) to cover the cost of this contract. Staff will be investigating if any non -General funds are available to be used for this work as part of the mid- year or fiscal year budget process.
