Yauchzee, Director/City Engineer Public Works Department SUBJECT: QUITCLAIM DEED FOR TRACT MAP NO.53821 LOCATION: NORTHWEST CORNER OF BOLT AND GRAND RECOMMENDATION: It is recommended that the City Council adopt the following resolution: RESOLUTION NO. 2004- fl2 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY , OF WEST COVINA, CALIFORNIA, AUTHORIZING THE EXECUTION OF A CORPORATION QUITCLAIM DEED IN FAVOR OF CREEKSIDE 58 HOMEOWNERS ASSOCIATION DISCUSSION: In 1960, the County of Los Angeles realigned and constructed Grand Avenue. At the completion of the construction, a drainage easement area was created along the west side of Grand Avenue north of Holt Avenue along the Walnut Creek Wash. The County owned the rights to the easement area and claims to have relinquished the rights to the City of West Covina. The drainage easement lies within the planned 58-lot single-family home subdivision being developed by Comstock Homes. As part of their design and the Planning Commission Conditions of Approval, Comstock Homes has requested that the City quitclaim the drainage easement area to the newly formed Homeowner Association (HOA). The HOA will assume all responsibilities in the maintenance and repair the wash and assure that the flow through the wash will be maintained. ALTERNATIVES: The City Council may choose not to approve the transfer of the ownership rights to the drainage easement and have the City's maintenance crew continue to maintain the drainage easement. FISCAL IMPACT: Normally, the City would charge a nominal amount to quitclaim a parcel in which it has ownership interest. However, in this case, the easement is more of a liability to the City than an asset. Also, since the maintenance of the drainage easement will be retained by the HOA, there will be some minor saving in maintenance costs to the City. i Prepared y: Miguel Hernandez Reviewed/Approved by Shannon A.
