SUBJECT: Amendment to the Agreement with Arakelian Enterprises, Inc., to
change the doing business as (dba) from West Covina Disposal to
Athens Services.
SUMMARY: In December of 1997, Dennis Chiapetta of West Covina Disposal
Company requested an amendment to the agreement for solid waste
collection between the City and Arakelian Enterprises, Inc., dba West
Covina Disposal Company to allow the dba to be changed to Athens
Services. This amendment would change the identification on the
trash, trucks and the company's name for payments to Athens
Services.
BACKGROUND
On March 3, 1992, the City Council entered into an agreement with Arakelian Enterprises,
Inc. dba West Covina Disposal (Contractor) to provide waste and recyclable collection in
the City. Since that time, there have been nine amendments to that agreement covering
areas such as automated collection, curbside recycling, the Integrated Waste
Management Program, office location, office hours, payment center, and rate increases.
Arakelian Enterprises, Inc., which currently operates under ten different dba's including
West Covina Disposal, is interested in consolidating their operations under the name,
Athens Services. This name change will necessitate an amendment to the current
Agreement with Arakelian Enterprises to address the requirement that the waste trucks
be identified with the contractor's name which is listed as West Covina Disposal. In
addition to the name change on the trucks, the community will now make their
payments to Athens Services instead of West Covina Disposal.
ANALYSIS
Over the years the community has developed a strong identity with "West Covina
Disposal". Because of this identity, Arakelian Enterprises: has agreed to provide a
public education effort' to acquaint the customers with the new name of Athens
Services. The effort will include a Notice in the waste collection bills to each residential
and commercial customer as well as a newspaper announcement. Because of the
three month billing cycle, the name change will not occur until May 1, 1998. This
effective date will also allow time for Arakalian Enterprises to revise the dba on their
insurance certificates and bonds, which are on file with the City.
Since the trucks will not be readily identifiable as waste collectors for West Covina,
specific trucks will be assigned to West Covina and the operators will have. truck ID
cards. These cards are then electronically. scanned each time they enter a landfill
facility. Therefore, when the waste is dumped, the landfill operators will be able to track
the waste stream as originating in West Covina in accordance with the requirements of
State Integrated Waste Management (AB939).
FISCAL IMPACT
There is no fiscal impact on the City.
RECOMMENDATION
It is recommended that the City Council approve Amendment No. 10 to the Agreement
with Arakelian Enterprises, Inc., to reflect changing the dba from West Covina Disposal to
Athens Services.
