The procedures used for testimony are hearing those in favor speaking first, then those in opposition speaking second, followed by those in favor speaking in rebuttal. However, the rebuttal may only address those items discussed in opposition. When recognized, please come forward to the podium and state your name and address for the record. 1) Zone Change No. 623 Negative Declaration of Environmental Impact Applicant: Lewis Homes of California Location: 621 South Azusa Avenue (Former E1 Dorado School Site) The applicant has requested approval of a Zone Change to the "Specific Plan" Zone, and a Precise Plan and a Tentative Tract map for a 63-unit patio home development. As proposed, the Specific Plan Zone includes a zoning text and site plan which will serve as the site's zoning. The Planning Commission conducted a public hearing on the subject requests on March 1, 1989, and adopted resolutions recommending that City Council approve Zone Change No. 623 and certify the Negative Declaration of Environmental Impact. Walnut Creek Parkway, listing hazards on their street and a request to ban motor homes, cars and campers from parking on residential streets. 2) COMMISSION SUMMARY OF ACTIONS (Receive and file) The following Commissions have met on the dates specified below, and now report to the City Council the items on which they have taken action. a) Personnel Commission . . . . . . . . . . . . .March 13, 1989 b) Waste Mgt. & Environmental Quality Commission .March 16, 1989 3) CLAIMS FOR ACTION aT SCS Engineers vs City of West Covina On January 31, 1989, a claim for indemnification from civil liability relating to a cross complaint for personal injuries was received by the City Clerk's Office. It is recommended that the City Council deny the claim and the claimant's attorney be so notified. b) Sara Sandoval vs City of West Covina c) On February 21, 1989, a claim for property damage amounting to $671.15 was received by the City Clerk's Office. It is recommended that the City Council deny the claim and the claimant's attorney be so notified. vs Citv of or Settlement On July 7, 1987, a claim for property damage and personal injuries amounting to $506,000.00 was received by the City Clerk's Office. It is recommended that the City Council authorize $16,810.90 settlement authority to settle the claim of Thomas Perez filed on July 7, 1987. 4) TEMPORARY USE PERMITS (Receive and file) Temporary Use Permit No. 1868-89 was issued to West Covina Mitsubishi, 2000 E. Garvey, for balloons on March 17-19, 1989. Temporary Use Permit No. 1869-89 was issued to Bozzani Motor Car Company, 1800 E. Garvey for balloons on March 18-19, 1989. CONSENT CALENDAR Continued 5) MISCELLANEOUS PUBLIC WORKS Woodside Village Maintenance District No. 4 Landscape Contract Renewal This contract provides for Maintenance of Landscape, Natural Areas, Hardscape and Sprinkler Systems, including but not limited to Woodside Village Maintenance District No. 4. Staff recommends that the City Council grant renewal of J & R Landscape Maintenance Company's contract for the coming twelve month period at a 4.8% increase. 6) TRAFFIC COMMITTEE MINUTES FOR THE MEETING OF MARCH 14, 1989 Accept and file I. The City initiated request for a Five-year Renewal Speed Study of California Avenue resulted in a recommendation that a 40 MPH limit be established on California between West Covina Parkway and Merced and that the current 35 MPH limit be retained between Merced and Francisquito. II. The City initiated request for a Five-year Renewal Speed Study of Vine Avenue resulted in a recommendation that a 40 MPH limit be retained between Azusa and Citrus and and that a 35 MPH limit be established between Glendora and Azusa. III. The City initiated request for a Five-year Renewal Speed study of Merced Avenue resulted in a recommendation that the current 40 MPH limit between Sunset and Azusa be retained and that a 40 MPH limit be established between the western City limit and Sunset and between Azusa and Hollenbeck. IV. The City initiated request for allowing buses to proceed straight in the "Right -turn Only" lane on Vincent Avenue at Garvey Avenue South was denied. V. The City initiated request for removal of school warning signs, 25 MPH signs, school crossing signs and marked school crosswalks on Sunset Avenue and Azusa Avenue in front of Tonopah and E1 Dorado was approved. VI. The City initiated request for a Five-year Renewal Speed Study of Virginia Avenue was held over for additional information. VII. The City initiated request for installation of north/south protected left -turn phase at Grand and Holt was denied. VIII. The City initiated request for parking restrictions on the west side of Vincent Avenue between Garvey Avenue South and West Covina Parkway was held over for additional information. IX. The City initiated request for signs prohibiting sales, possession or discharged of fire works within the City was held over for additional information. - 5 - City Council Agenda C. CONSENT CALENDAR Continued 7) ORDINANCE FOR ADOPTION (Waive reading and adopt) March 27, 1989 Page Six At the •larch 20th meeting of the City Council, an ordinance propsing revisions to Article VII, Signs, of Chapter 26 (Zoning) of the West Covina Municipal Code as it relates to signage was introduced. ORDINANCE NO. -AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING THE WEST COVINA MUNICIPAL CODE BY AMENDING CHAPTER 26, ARTICLE VII, AS THEY RELATE TO SIGNAGE REGULATIONS FOR USES HAVING DESIGNATED OUTDOOR DISPLAY AREAS ON APPROVED PRECISE PLANS. (Amendment No. 211) 8) CITY TREASURER'S REPORT FOR THE MONTH OF FEBRUARY, 1989 Treasurer's Report of cash balances and investments. (Receive and file) ACTION OF THE FOREGOING CONSENT CALENDAR ITEMS 1 THROUGH 8: Motion by 2nd by To Waive further reading of the ordinance and adopt, and to APPROVE all other items, EXCEPT ROLL CALL: END OF CONSENT CALENDAR -6- City Council Agenda • • March 27, 1989 Page Seven PUBLIC WORKS DIVISION 1) Parcel Map 11039 - Call -Up of Improvement Security - Reg Thaibault The developer of Parcel Map 11039 is required to construct sidewalk along Pass & Covina Road and install two sewer laterals. The improvements have not been done and the Statute of Limitations expires in May, 1989. Therefore, it is necessary to call up the Improvement Security for the contraction of the improvements. It is recommended that the City Council authorize call-up of Home Savings of America passbook No. 026-064328-3 in the amount of $4,900. ACTION Motion by 2nd by To Approve Disapprove Hold Over. 2) Grand Avenue Pipeline Reimbursement Agreement This Agreement is a subsidiary agreement to the Grand Avenue Pipeline Participation Agreement and outlines the reimbursement payments to Walnut Valley Water District for their out-of-pocket expenses incurred for performing their duties as lead agency in the Grand Avenue pipeline design activities. It is recommended that the City Council approve the Grand Avenue Pipeline Reimbursement Agreement and authorize the Mayor and City Clerk to execute said Agreement. PUBLIC SAFETY DIVISION 1) Mobile Digital Terminal (MDT) Consultant This report describes the need for, and recommends the retention of, the City's current Computer Consultant to assist with the development of the Mobile Digital Terminal/Vehicle Locating System (MDT/VLS) project. It is recommended that the City Council authorize the Mayor and City Clerk, upon execution of the Agreement by Mr. Savitz, to execute the attached Consultant Services Agreement with Rapid Action Associates, for a total fee not to exceed $43,560, for consulting services pertaining to the MDT/VLS project.
