SUBJECT: SUMMARY VACATION OF EXCESS RIGHT-OF-WAY
ON VANDERHOOF DRIVE
SUMMARY: A 27.00 foot strip of Vanderhoof Drive, northerly of the
improved cul-de-sac constructed by Tract No. 45098 in
1988, has not been utilized for street and highway
purposes since 1988 and can be summarily - vacated
under provisions of Sections to 8300 to 8340 of the State
of California Street and Highways Code.
BACKGROUND
Vanderhoof Drive was originally planned to connect to Virginia Avenue from Citrus Street.
In 1987 a condominium project was constructed at the southwest quadrant of Vanderhoof
Drive and Virginia Avenue. This project incorporated the northerly 80 of the westerly half
of the future Vanderhoof Drive. Then in 1988 another condominium project was
constructed on the southeasterly quadrant 'of Vanderhoof Drive and Virginia Avenue.
This project created the cul-de-sac that now exists southerly of Virginia Avenue, and
incorporated the northerly 150 feet of the easterly half of the future Vanderhoof Drive.
These actions left a 27 foot wide strip of the westerly half of Vanderhoof Drive between
the abandoned portion of the future Vanderhoof Drive and the newly created cul-de-sac.
This strip of Vanderhoof Drive was rendered useless for street and highway purposes due
to the realignment of the cul-de-sac. The attached map indicates the condition as it
presently exists.
ANALYSIS
The strip of Vanderhoof being proposed for street vacation was originally dedicated in
1960 by the adjacent property owner, Erwin K. Kauper, who is now requesting the
vacation. To the best of our knowledge, Mr. Kauper is the present, owner of the land over
which the street easement currently exists. With the vacation, Mr. Kauper's land will no
longer be encumbered with the street easement.
Since this section of Vanderhoof Drive is no, longer used for street purposes and is not
intended to ever be used for street purposes, a summary vacation is in order. Since there
are several utilities including a sewer and a storm drain within the area proposed for
vacation, a general purpose utility easement will be reserved as part of the street
vacation. This reservation is a routine procedure when streets or portions of streets
which contain utilities are vacated. Separate utility easements are not required in street
right-of-ways since street easements by their very nature automatically include the right to
have utilities located in them. When street easements are vacated, utility easements are
needed.
FISCAL IMPACT
There is no fiscal impact.
ALTERNATIVES
The alternative is for the City to retain the excess. land as street right-of-way. There is no
reason to retain the easement.

RECOMMENDATION
It is recommended that the City Council adopt the following resolution:
RESOLUTION NO.%2 - A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF WEST COVINA, CALIFORNIA VACATING AND
ABANDONING A PORTION OF A STREET WHICH IS EXCESS RIGHT -
OF -WADY (VANDERHOOF DRIVE).
