Glover City Engineer/Public Works Director city of West caw Memorandum N AGEDA ITEM NO. 0-11a DATE Februa''ry 7, 1995 ® PRINTED ON RECYCLED PAPER SUBJECT: CITYWIDE LIGHTING AND MAINTENANCE DISTRICT AND LANDSCAPE MAINTENANCE DISTRICTS NOS. 4, 6, AND 7 - 1995-1996 RENEWAL - ORDERING OF ENGINEER'S REPORTS SUMMARY: To extend the various Maintenance Districts for the 1995- 1996 fiscal year in accordance with State law, the City Council l,s initial step in the annual renewal process is the ordering of the Engineer's report. BACKGROUND Since the City formed various Maintenance Districts pursuant to the Landscape and Lighting Act of 1972, a specific, procedure must be followed for annually renewing these districts. The first step is for the City Council to adopt resolutions ordering the Engineer's Report for each district. Staff, utilizing the services of BSI Consultants, prepares plans and specifications for improvements, an .estimate of costs, an assessment diagram and assessment spread for the estimated costs, then files these reports with the City Clerk's office. The second step is for the City Council to review the reports. If the reports are approved, 'the City Council then adopts a resolution of intention for each district and sets public hearings for a date no later than] August 1, .1995. After the public hearings, the City Council may then confirm the reports and authorize the Assessor's office of the County of Los Angeles to collect the assessmentsi Since 1993, State law requires a greatly expanded public notification process for any increases in assessments, including mailed notices to all property owners, more extensive newspaper publication and review of proposed assessments at two public meetings. ANALYSIS The ordering of these reports is in accordance with Article 4, Chapter 1, Part 2, "Landscaping and Lighting Act of 1972", being Division 15, Streets and Highways Code of the State of California. The City Attorney has approved as to form the resolutions ordering the Engineer's reports to be prepared and filed with the City Clerk's office. FISCAL IMPACT , These four districts are not financed by the General Fund. There has historically, been" a General Fund subsidy ("contribution") to the Citywide District. Cost estimates based upon the projected operating and capital budgets for the districts are prepared. Based upon these cost estimates, including incidental expenses and contingencies, assessments are recommended that are sufficient to recover all eligible costs. ALTERNATIVES The Streets and Highw City Council does not Code specifies the required steps for renewing the districts. If the t to continue the districts, the resolutions are not needed. cirywide95 City Manager and City Cool Citywide Lighting and Maintenance District - and Landscape Maintenance District Nos. 4, 6, and 7 Ordering of Engineer's Reports February 7, 1995 Page 2 RECOMMENDATION: 0 Staff recommends that the City Council adopt the following resolutions: a) RESOLUTION NO./7% - A RESOLUTION OF THE CITY COUNCIL OF THE'CITY OF WEST COVINA, CALIFORNIA, ORDERING THE CITY ENGINEER TO PREPARE AND FILE A REPORT IN ACCORDANCE WITH ARTICLE 4, CHAPTER 1 i PART 2, "LANDSCAPING AND LIGHTING ACT OF 1972, , BEING DIVISION 15, STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA, ORDERING CERTAIN LIGHTING FIXTURES, TRAFFIC SIGNALS AND APPURTENANCES TO BE INSTALLED, ELECTRICAL ENERGY AND MAINTENANCE TO BE FURNISHED FOR ALL LIGHTS AND TRAFFIC SIGNALS; THROUGHOUT THE CITY, AND FOR THE FURNISHING OF LANDSCAPING AND PARK MAINTENANCE APPURTENANCES AND APPURTENANT WORK, AND FOR GRAFFITI PREVENTION AND REMOVAL IN THE CITY OF WEST COVINA, CALIFORNIA, FOR THE 'FISCAL YEAR COMMENCING JULY 1, 1995 AND ENDING JUNE. 30, 1996. - WEST COVINA LIGHTING AND MAINTENANCE DISTRICT NO. 1995-1996 b) RESOLUTION NO. / %'8 ' - A RESOLUTION OF THE CITY COUNCIL OF THE!
