SUMMARY_: To extend the various Maintenance Districts for
the .1994-1995 fiscal year in accordance with
State law, the City Council should order the
Engineer's Reports. This action is the first
step of the annual renewal process.
BACKGROUND
Since the City formed various Maintenance Districts pursuant to the Landscape and Lighting
Act of 1972, a specific procedure must be followed for annually renewing these districts.
The first step is for the. City Council to adopt resolutions ordering the Engineer's Report for
each district. Staff prepares plans .and specifications for improvements, an estimate of costs,
an assessment diagram and assessment spread for the estimated costs, then files this report
with the City Clerk's office. The second step is for the City Council to review the report.
If the report is approved, the City Council then adopts a resolution of intention for each
district and sets public hearing for a date no later than August 2, 1994. After the public
hearings, the City Council may then confirm the report and authorize the Assessor's office of
the County of Los Angeles to collect the assessments. Since 1993, State law requires a
greatly expanded public notification process for any increases in assessments, including
mailed notices to all property owners, more extensive newspaper publication and review of
proposed assessments at two public meetings.
ANALYSIS
The ordering of these reports is in accordance with Article 4, Chapter 1, Part 2,
"Landscaping and Lighting Act of 1972", being Division 15, Streets and Highways Code of
the State of California.
The City Attorney has approved as to form the resolutions ordering the Engineer's reports to
be prepared and filed with the City Clerk's office.
FISCAL IMPACT
These four districts are not financed by the General Fund. There has historically been a
General Fund subsidy ("contribution") to the Citywide District. Cost estimates based upon
the projected operating and capital budgets for the districts are prepared. Based upon these
cost estimates, including incidental expenses, and contingencies, assessments are
recommended sufficient to recover all eligible costs.
ALTERNATIVES
There are no. alternatives to the procedure for renewing these districts. The Streets and
Highways Code specifies the required steps for renewing the districts.

Staff recommends that the City Council adopt the following resolutions:
