SUMMARY: After Final Parcel Map 22683 was approved by
Council, an updated preliminary subdivision
report indicated a small cusp of land within the
map boundary was owned by the City. The
Council is being requested to Quitclaim this
small cusp to clear title on the final map.
BACKGROUND
On December 7, 1993, the City Council approved Parcel Map 22683. The normal procedure
after Council. approval is to have the City Engineer, City Clerk and City Treasurer sign the
map. The Civil Engineer who produced the map then requests a Preliminary Subdivision
Report update to verify there are no changes of record, and noting no change then submits
the map to the Los Angeles County Subdivision Section for processing and recordation.
In this case the updated report for Parcel Map 22863- indicated the City of West Covina was
the fee owner of a small cusp of land, approximately 110 square foot in size. The City had
not appeared as a fee owner in prior reports, probably due to the small area size.
ANALYSIS
This cusp of land was part of a former off -ramp and frontage road alignment. The area is
not needed for any public purpose and does not have any value due to its size and location.
Also, the City does not need to be a party to a final map it does not have an interest in. The
City Attorney has approved as to form a Resolution authorizing the Mayor and City Clerk to
execute a Corporation Quitclaim Deed.
FISCAL IMPACT
None.
ALTERNATIVES
Should the City Council not authorize the execution of a Corporation Quitclaim deed, a small
City -owned parcel between two privately owned parcels will be created that has no use.
RECOMMENDATION
It is recommended that the City Council adopt the following Resolution:

AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE
A CORPORATION QUITCLAIM DEED IN FAVOR OF PAUL N.
MOGHADAM AND MITRA ARBAB MOGHADAM.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY COUNCIL OF THE CITY OF WEST COVINA,
CALIFORNIA; AUTHORIZING THE MAYOR AND CITY
CLERK TO EXECUTE A CORPORATION QUITCLAIM
DEED IN FAVOR OF PAUL N. MOGHADAM AND
MITRA ARBAB MOGHADAM:
The City Council of the City of West Covina does resolve as follows:
SECTION 1. The City Council of the City. of West Covina does hereby find
and determine that:
The land conveyed to the City of West Covina and recorded as Instrument No.
3873, in Book D 1991, Page 863, on April 15, 1963, of Official Records, in
the office of the County Recorder of said county. Except therefrom that
portion lying westerly of a line that is parallel with and 50.00 feet easterly of
the, centerline of Vincent Avenue, as existed on April 15, 1963;
is no longer needed for the public purposes for which it was acquired or for any other public
convenience and necessity, require that the same be conveyed to.Paul N. Moghadam and
Mitra Arbab Moghadam.
SECTION 2. The Mayor and City Clerk are hereby authorized and instructed
to execute in the name of the City of West Covina a Corporation Quitclaim Deed conveying
all right, title and interest of'the City of West Covina in and to said real property to Paul N.
Moghadam and Mitra Arbab Moghadam and cause the said Quitclaim Deed and a certified
copy of this resolution to be filed for record in the office of the County Recorder of the
County of Los Angeles.
SECTION 3. That the City Clerk shall certify to the adoption of this
resolution:
