01-19-1993 - Citywide Lighting & Maint. District & Landscape Maint. District #'s 4, 6, & 7 - Ordering of Engineer's ReportsA . City of West Covina Memorandum TO: City Manager and City Council FROM: SUBJECT: Harry W. Thomas AGENDA ITEM NO. C-10d DATE January 19, 1993 CITYWIDE LIGHTING AND MAINTENANCE DISTRICT AND LANDSCAPE MAINTENANCE DISTRICTS NOS. 49 6, AND 7 - ORDERING OF ENGINEER'S REPORTS SUMMARY: To continue the various Maintenance Districts for the 1993-1994 fiscal year, the City Council should order the Engineer's Reports. This action is the initial item of the annual renewal process. BACKGROUND Since the City formed various Maintenance Districts pursuant to the Landscape and Lighting Act of 1972, a specific procedure must be followed for annually renewing these districts. The first step is for the City Council to adopt resolutions ordering the Engineer's Report for each district. Staff prepares plans and specifications for improvements, an estimate of costs, an assessment diagram and assessment spread for the estimated costs, then files this report with the City Clerk's office. The second step is for the City Council to review the report. If the report is approved, the City Council then adopts a resolution of intention for each district and sets public hearing for a date no later than August 3, 1993. After the public hearings, the City Council may then confirm the report and authorize the Assessor's office of the County of Los Angeles to collect the assessments. Beginning this year State law requires a:greatly expanded public notification process for any increases in assessments, including mailed notices to all property owners, more extensive newspaper publication and review of proposed assessments at two public meetings. ANALYSIS The ordering of these reports is in accordance with. Article 4, Chapter 1, Part 2, "Landscaping and Lighting Act of 1972", being Division 15, Streets and Highways Code of the State of California. The City Attorney has approved as to form the resolutions ordering the Engineer's reports to be prepared and filed with the City Clerk's office. FISCAL IMPACT Maintenance and installation of improvements in these four districts are financed by special assessments rather than general tax revenues. Cost estimates based upon the projected operating and capital budgets for the districts are prepared. Based upon these cost estimates, including incidental expenses and contingencies, assessment rolls are prepared sufficient to recover all costs without General Fund subsidy. ALTERNATIVES There are no alternatives to the procedure of renewing these districts. The Streets and Highways Code specifies the required steps for renewing the districts. citywi&93 City Manager and City C00.1 • Citywide Lighting and Maintenance District - and Landscape Maintenance District Nos. 4, 6, and 7 Ordering of Engineer's Reports January 19, 1993 Page 2 RECOMMENDATION: Staff recommends that the City Council adopt the following resolutions: a) RESOLUTION NO. 9?0 F - A RESOLUTION OF THE CITY COUNCIL OF THE, CITY OF WEST COVINA, CALIFORNIA, ORDERING THE CITY ENGINEER TO PREPARE AND FILE A REPORT IN ACCORDANCE WITH ARTICLE 4, CHAPTER 1, PART 2, "LANDSCAPING AND LIGHTING ACT OF 1972", BEING DIVISION 15, STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA, FOR, THE INSTALLATION OF THE LANDSCAPING AND THE MAINTENANCE THEREOF, IN THE CITY OF WEST COVINA, CALIFORNIA, FOR THE FISCAL YEAR COMMENCING JULY 19 1993 AND ENDING JUNE 30, 1994.
