Garvey, for balloons on December 12-13, 1987. 10) AWARD OF BIDS a) Street Tree Pruning City Project No. RST 87-T-2 This project provides trimming of Sycamore and Chinese Elm street trees citywide. It is recommended that the City Council accept the bid of Johnny's Tree Service of Valinda, California, in the amount of $29,987 and authorize the Mayor and City Clerk to execute an Agreement with Johnny's Tree Service for the work to be done. b) SP-88111 - West Covina Parkway Improvements This project consists of the construction of asphalt overlay to improve the condition of a deteriorated street. The total construction cost of the project is $223,000. It is recommended that the City Council take the following actions: 1) Transfer $191,800 from Project SP-87143 (133-320-3755-7200) and $31,200 (124-320-3755-7200) to Project SP-88111 - $191,800 (133-320-3819-7200) and $31,200 (124-320-3819-7200). Total amount transferred: $223,000. 2) Accept the bid of Vernon Paving Company of Anaheim in the amount of $193,193 as submitted at the bid opening on December 8, 1987, and authorize the Mayor and City Clerk to execute an Agreement .with said Vernon Paving Company for the work to be done, subject to the concurrence of the State of California, Department of Transportation. - 5- City Council Agenda • December 21, 1987 • Page Six C. HEARINGS Continued 4) Appeal of Planning Commission Decision to Deny Precise Plan No. 805 and Variance No. 893 (IVR Workman Limited; 1829 - 1841 East Workman Avenue and 1828 - 1840 East Thelborn Street) The applicant is requesting a modification of a precise plan to add three dwelling units to an existing 138-unit apartment complex, a variance from certain sections of the West Covina Zoning Ordinance to allow less than the minimum required number of parking spaces, and a waiver of certain sections of Planning Commission Resolution No. 2513. Staff recommends that the City Council recognize the applicant's withdrawal of the appeal of the Planning Commission's decision to deny Precise Plan No. 805 and Variance No. 893, and close the public hearing on the appeal, allowing Planning Commission Resolution No. 10-87-3574 to remain in effect. ACTION: Motion by 2nd To Approve Disapprove SD-87114 - ADDrove Plan ld Over - Sunset A Storm This project provides for the construction of a storm drain in Sunset Avenue to relieve a persistent problem with street flooding. Estimated total cost of the project is $850,000. It is recommended that the City Council approve plans and specifications for City Project SD-87114 and authorize the City Engineer to call for bids, subject to the approval of the Los Angeles County Department of Public Works. A consultant has been selected. It is recommended that the City Council accept the proposal of Engineering -Science, Inc. of Pasadena, dated October 23, 1987, in the amount of $15,000 and authorize the Mayor and City Clerk to execute an agreement with said Engineering -Science, Inc. for the work to be done. The initial demand for this claim was $60,000.00; however, plaintiffs have agreed to settle this claim in the amount of $9,000.00. Staff recommends this matter be settled in the amount of $9,000.00 total and that Council authorize payment subject to the standard conditions. ACTION: Motion To Approve Disapprove 4). Approval of Settlement - Frederick Lujan 2nd by Hold Over On July 8, 1987 a summons and complaint was filed with Superior Court for bodily injury and general damages. The initial demand for this claim was $75,000.00; however, the plaintiff has agreed to settle this claim for $7,500.00. Staff recommends this matter be settled in the amount up to $7,500.00 and that Council authorize said payment subject to the standard conditions.
