It is recommended that the City Council authorize fund transfers as indicated on Exhibit "A". b) Lot Line Adjustment No. 60 - Louis Brutocao Louis Brutocao has requested a lot line adjustment involving his property and two other adjacent properties. It is recommended that the City Council adopt the following resolution: RESOLUTION NO. 8035 - A RESOLUTION OF THE CITY ,COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING LOT LINE ADJUSTMENT NO. 60 AND DIRECTING THE RECORDATION THEREOF. c) SP-87165 - Sidewalk/Barrier Removal Project - Transfi Due to unanticipated irrigation system and driveway changes for sidewalk project SP-87165, an additional $18,000 is required to be transferred from other projects so that final payments can be made. It is recommended that the City Council authorize the transfer of $10,000 from SP-87122 (110-320-3727-7900) and $8,000 from SP-87144 (131-320-3756-7200) to SP-87165 (131-320-3785-7200). - 3- AGENDA Page Four June 8, 1987 B. It is recommended that the City Council waive further reading and adopt the following ordinances: ORDINANCE NO. 1742 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING THE WEST COVINA MUNICIPAL CODE BY AMENDING THE OFFICIAL ZONING MAP. (Zone Change No. 606 Brian Barbuto Corporation) ORDINANCE NO. 1743 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING THE WEST COVINA MUNICIPAL CODE BY AMENDING THE OFFICIAL ZONING MAP. (Zone Change No. 605 City initiated) 8) MISCELLANEOUS a) Financial Report Award Annually the City prepares a Budget Document and a Comprehensive Financial Report, to be used as management and communication tools ,as well as to meet state and federal requirements, Additionally, the City has received awards on both a state and, national level for these documents. It is recommended that the City council receive and file this report. When recognized, please come forward to the podium and state your name and address for the record. 1) EAST HILLS SPECIFIC PLAN AMENDMENT NO. 4 ADDENDUM TO THE ENVIRONMENTAL IMPACT REPORT AMENDMENT REGARDING CUL-DE-SACS EAST HILLS SPECIFIC PLAN AMENDMENT NO. 3 TENTATIVE TRACT MAP NO. 44564 ENVIRONMENTAL IMPACT REPORT Burr Baldwin Jr. Incorporated The first matter set for public hearing is Amendment No. 4 to the East Hills Specific Plan (Circulation) and the Addendum to the Environmental Impact Report for Tentative Tract No. 44564 which has been recommended for approval by Planning Commission Resolution No. 4-87-3515. After the City Council action on this amendment, we must consider the Planning Commission's recommendation of the change in the Municipal Code regarding cul-de-sacs and Planning Commission recommended conditions for Tentative Tract No. 44564. • Verification of publication • Open Hearing • Presentation of staff report • Public testimony • Close hearing • Council discussion a) East Hills Specific Plan Amendment No. 4 Addendum to the EIR The City Council requested the Planning Commission consider an amendment to the East Hills Specific Plan to modify the circulation and provide for the cul-de-sacing of Los Cerrillos Drive. The Planning Commission considered that request and is recommending approval of this amendment. It is staff's recommendation that the City Council deny the East Hi.11s Specific Plan Amendment No. 4 by the adoption of the following resolution: RESOLUTION NO. - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, DENYING THE EAST HILLS SPECIFIC PLAN AMENDMENT NO. 4 AND CERTIFYING THE ADDENDUM TO THE ENVIRONMENTAL IMPACT REPORT. HEARINGS Continued 1) b) Amendments to Municipal Code Section 19-194(e) - Cul-De-Sac Streets It is being proposed that the City Council take action to amend the Municipal Code so that there no longer is an absolute maximum length for cul-de-sac streets and so that "Private Streets" are unamabiguously included in the definition of "Streets". It is recommended that the City Council introduce the following ordinance: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING THE WEST COVINA MUNICIPAL CODE SECTION 19-194 (e) DEALING WITH CUL-DE-SAC STREETS AND SECTION 20-22(a) DEALING WITH STREETS. PUBLIC WORKS DIVISION 1) MP-87139 - Shadow Oak Drive Subdrain Systems - Selection of Consultant It is proposed to select a consultant to design subdrain systems in vicinity of Shadow Oak Drive and Gemini Street to alleviate the water seepage problems. It is recommended that the City Council accept the proposal of Norris-Repke, Inc. in an amount not to exceed $6,600 and authorize the Mayor and City Clerk to execute an agreement with Norris-Repke, Inc. for the work to be done. ACTION: Motion by 2nd by To Approve Disapprove Hold Over 2) SD-87117 - APPROVE PLANS AND SPECIFICATIONS - STORM DRAIN REPAIRS This project consists of the repair of the storm drain in Citrus Street between Montezuma Way and Larkhill Drive. Repairs are required to be able to transfer the storm drain to the Los Angeles County Flood Control District for operation and maintenance. Estimated construction cost is $15,000. It is recommended that the City Council take the following actions: a. Transfer $15,000 from City Project SD-87114 (161-320-3716-7600) to City Project SD-87117 (110-320-3719-7400). b. Approve plans and specifications for City Project SD-87117 and authorize the City Engineer to call for bids. ACTION: Motion by 2nd by To Approve Disapprove Hold Over E. COMMUNITY SERVICES DIVISION .1) HUMAN SERVICES DEPARTMENT a) Amendments to the Facility Use Riders. Inc.. and Mt. San Antoni Staff proposes that certain amendments be made to the Facility Use Agreement between the City, Ridge Riders, Inc., and Mount San Antonio College District. It is recommended that the City Council authorize the Mayor and City Clerk to execute the amended Agreement with the Ridge Riders,.Inc. and Mount San Antonio College District. ACTION: Motion To Approve Disapprove 2nd by Hold Over M AGENDA June 8, 1987 Page Ten OPERATIONAL SERVICES DIVISION 1) FINANCE DEPARTMENT a) Resolution Declaring Certain City Property as Surplus Council periodically declares as surplus City property which can no longer be used by the City. It is recommended that the City Council adopt the.following resolution: RESOLUTION NO. - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, DECLARING CERTAIN CITY PROPERTY AS SURPLUS. ACTION: Motion by 2nd by To WAIVE further reading of the Resolution, and Adopt Disapprove Hold Over PUBLIC SAFETY DIVISION 1) POLICE DEPARTMENT a) Repeal and Adopt Ordinance In the 1960's the City Council adopted Chapter 14, Article VII, of the West Covina Municipal Code regulating motels and hotels. Subsequently State law was enacted which pre-empted local authority in this area and/or the courts have held various sections of our ordinance(s) invalid. The City Council will be asked to repeal the invalid sections and adopt a new ordinance to regulate motels and hotels. It is recommended the City Council introduce the following ordinance. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, REPEALING CHAPTER 14, ARTICLE VII OF THE WEST COVINA MUNICIPAL CODE, RELATING TO PUBLIC LODGINGS, AND AMENDING CHAPTER 21, ARTICLE III, RELATING TO TRANSIENT OCCUPANCY TAXES. CITY ATTORNEY 1) City Attorney Services The City Attorney is requesting an increase in retainer rate and hourly rates to the City for Attorney services. These proposed rates are in line with those of other reputable Municipal Attorneys serving cities who contract for City Attorney services. It is recommended that the City Council approve the June 1987 proposal by Colin Lennard of the firm of Burke, Williams & Sorensen for City Attorney Services and adopt the following resolution: RESOLUTION NO. - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING RESOLUTION NO. 6855 RELATIVE TO THE COMPENSATION FOR SERVICES OF THE CITY ATTORNEY. CITY MANAGER 1) Legislation Legislation is pending in the State Legislature which requires Council attention. SB 1265 would place a bond issue on the ballot for the development of law enforcement regional training centers. Legislation is also being advanced which would return the positive system of purging voter registration rolls. It is recommended that the City Council support SB 1265 and formally go on record in support of a return to the positive purge method of removing excess names from voter registration rolls.
