Collier, Director Public Services Department SUBJECT: ADOPTION OF STANDARD SPECIFICATIONS FOR PUBLIC WORKS CONSTRUCTION, 2000 EDITION - PUBLIC HEARING SUMMA.RY: -On January 18, 2000,, the City introduced an ordinance regarding the adoption of the 2000 Edition of the Standard Specifications for Public Works Construction to amend Section 19-1 of the West Covina Municipal Code and set February 15, 2000 as the date for the required public hearing. BACKGROUND: The Standard Specifications for Public Works Construction, popularly known as the Greenbook" was originallypublished in 1967. The 2000 Edition is the 12th edition of this book which. is updated and republished every three years. The City of West Covina, like most cities in Southern California, has utilized these -specifications by reference within all its Public Works -contracts since the first edition in 1967. The first edition of the Greenbook was the product of a Joint Cooperative Committee. of.the Southern California Chapter of the ­American Public Works Association and the Southern California Districts of the Associated General Contractors of California. Since then,.a. permanent Joint Committee, comprised of representatives . from cities, counties, utility compamies, and contractors throughout Southern California was established to carry on the work. The function of this committee was to study and update the provisions of these specifications to'reflect the constantly changing- technology and advanced thinking of the construction industry. . This committee convened regularly each month to consider new changes. In December 1995, the Joint Committee ceased 'operations. In January 1996, Public Works Standards, Inc., a mutual benefit corporation, began producing the breenbook. The Corporation's Board of Directors is comprised of nine members — five representing the American Public Works Association, and the other four"from the Associated General Contractors of California, the Engineering Contractors Association, the Southern California Contractors Association, and Building News Incorporated (BNI) Publications, Inc. The Board appoints a 25-member Greenbook Committee which carries on the tradition and finiction of the previous Joint Committee. This committee' convenes monthly to consider new changes. In each of the two' years between publication of a new - Greenbook edition, the changes which have been researched and approved, by the committee during. the preceding year, are published in pamphlet form as amendments to the current edition. The original edition of the' Gieenbook consisted of three parts General Provisions, Construction Materials and Construction Methods. In 1970, 1991, and 1994, Parts 4, 5, and 6 were added to provide specifications for -alternate aggregate. -materials, pipeline system rehabilitation, and modified asphalt- products' Furthermore, in 1997 the units of measurement used I in the Greenbook were changed from the U.S. Standard measures to the Metric International System. DISCUSSION: The Standard specifications.for Public Works Construction are updated every three years and it is necessary to re -adopt them for the City to use the current version. The specifications are extremely helpful to staff in implementing good professional practice for public works projects. Since, the recommended action is the adoption of a code by reference within the m unicipal code, it is necessary to conduct a Public Hearing prior to final adoption., The City Attorney has -reviewed, and, approved the Ordinance. as to form. City Manager and City Council Page 2 — February 15, 2000 FISCAL IMPACT: There is no fiscal impact. OPTIONS: The City can prepare its own Standard Specifications. This option. is unduly cumbersome and could involve significant field work and information gathering along with the substantial fimding to support these activities. AN ORDINANCE OF THE CITY COUNCIL OF THE -CITY OF WEST COVINA, CALIFORNIA, ADOPTING THE. 2000 EDITION OF THE STANDARD SPECIFICATIONS FOR PUBLIC WORKS CONSTRUCTION BY REPEALING AND ADOPTING SECTION 19-1 OF THE WEST COVINA MUNICIPAL CODE. WHEREAS, the publisher of the Standard Specifications for Public Works Construction has released the 2000 Edition of said Specifications; and WHEREAS, the current West Covina Municipal Code Section 19-1 adopts the 1997 Edition of said Specifications; and WHEREAS, the City Council desire that the said Standard Specifications utilized by the City'be the current edition. NOW, THEREFORE, the City Council of the City of West Covina does hereby ordain as follows: SECTION 1. Section 19-1 of the West Covina Municipal Code is repealed in its entirety and is re -adopted to read as follows:' Sec. 19-1 Standard Specifications for public 'works construction adopted. Subject to the condition hereinafter set forth in this, section, that certain code entitled "Standard Specifications for Public Works Construction", 2000 Edition, written and promulgated by the Public Works Standard, Inc., a mutual benefit corporation, consisting of a published compilation of A uniform sefof specifications, updated and embracing the most modem materials and construction tdchni ques for public works construction, adopted by the County of Los Angeles, an agency for the State, one full printed copy of which, printed as a code in book form, was by the City Council ordered filed and which has been filed in the office of the City Clerk, and which, as so on file, is hereby referred to and by this reference expressly incorporated therein and made a part hereof as fully and for all intents and purposes as though set forth herein at length, shall be and the same is hereby adopted and established as the specifications, rules, regulations, standards, contracts, permits and provisions which shall govem and apply to, and be observed in the construction, alternation; installation, repair, removal and demolition of public works within the City or by the City as to all matters therein set forth; subject, however, to the condition that whenever any provision of such standard specifications hereby adopted conflicts with any other provision or requirement of the Municipal Code and City's Standard Plans, such other provision or requirement shall apply. SECTION 2. That the City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published as required by law.
