A. OTHER MATTERS OR ORAL COMMUNICATIONS Phil Moreno — regarding his belief that mobile food vendors should not be allowed in the City. B. CONSENT CALENDAR 1. FORTHCOMING PLANNING COMMISSION MEETINGS AND PUBLIC HEARING SCHEDULE 2. EXTENSION OF TIME CONDITIONAL USE PERMIT NO.07-12 ADMINISTRATIVE USE PERMIT NO.07-27 PLANNING DIRECTOR'S MODIFICATION NO. 07-18 APPLICANT: Juan Corona LOCATION: 232 South Glendora Avenue The applicant is requesting the first one-year extension of time for the above -referenced items. Motion by Sotelo, seconded by Carrico, to approve the items listed. Motion carried 5-0. NEW PUBLIC HEARINGS (Item heard out of order) (3) CONDITIONAL USE PERMIT NO. 09-14 CATEGORICAL EXEMPTION APPLICANT: Core Communications Group for T-Mobile West Corporation LOCATION: 2650 Shadow Oak Drive (West Covina Fire Station No. 5) REQUEST: The applicant is requesting the approval of a conditional use permit to allow the installation of an unmanned wireless telecommunications facility on an existing 101- foot tall tower structure. He also said a new public hearing notice will be sent when this matter is scheduled for hearing. Motion by Carrico, seconded by Redholtz, to. continue this matter indefinitely. Motion carried 5-0. C. CONTINUED PUBLIC HEARINGS (1) CONDITIONAL USE PERMIT NO.09-10 CATEGORICAL EXEMPTION APPLICANT: B.P. Hanrath for Crown Castle Communications, Inc., for AT&T. LOCATION: 3508 Temple Way REQUEST: The applicant is requesting approval of a conditional use permit to allow the installation of a 72-foot tall wireless. communications tower that will be constructed as a monopine (mock pine tree). This item was continued from December 8, 2009. COMMENTS: B.P. Hanrath, applicant, and George Ogden spoke in favor of the application. Alfred Williams and Maria Botello spoke in opposition. There was a discussion by the Commission regarding possible health concerns raised by the opponents. In addition, the Commission considered whether the cell towers pose a danger of falling, collocation of other carriers on the tower and whether the monopine would blend in with the surrounding natural trees and vegetation. It was the consensus of the Commission that the proposed cell tower would not have a negative impact on the surrounding area. Motion by Redholtz, seconded by Sotelo, to adopt Resolution No. 10-5355, approving Conditional Use Permit No. 09-10. Motion carried 4-1 (Sykes opposed). NEW PUBLIC HEARINGS (2) CONDITIONAL USE PERMIT NO.09-11 CATEGORICAL EXEMPTION APPLICANT: Wendy Lee for Happy Art Gallery LOCATION: 2707 East Valley Boulevard, Suite 300 REQUEST: The applicant is requesting a conditional use permit to allow the operation of a 1,609-square foot art school within an existing three-story office building. COMMENTS: Paul Cheng, representing the applicant, and Robert Chiang spoke in favor of the application. Henry Hsieh, Ker-Chow Chang, Kevin Lim and Phil Moreno spoke in opposition. There was a discussion by the Commission regarding appropriate uses for the building. The Commission also considered whether the art school/gallery was an appropriate use for a professional building. There was also a lengthy discussion regarding possible vandalism in the building and the safety of the children, as well as the patrons of the other businesses, due to the art school remaining open after the building is locked. Motion by Redholtz, seconded by Carrico, to deny Conditional Use Permit No. 09-11, and adopt a resolution of denial at the February 23, 2010 meeting. Motion carried 5-0. D. NON -HEARING ITEMS (1) STUDY SESSION CODE AMENDMENT NO.09-05 WATER EFFICIENT LANDSCAPING STANDARDS A study session to review California state requirements to adopt standards requiring water efficient landscaping and irrigation. COMMENTS: Acting City Planner Jeff Anderson told the Commission that the state of California was requiring cities to adopt standards for water efficient landscaping. There was a discussion by the Commission regarding the standards adopted by the state, and standards adopted by Orange County. Staff informed the Commission that a proposed code amendment adopting the required standards would be scheduled for a public hearing on February 23, 2010. E. OTHER MATTERS OR ORAL COMMUNICATIONS Phil Moreno — regarding mobile food vendors. F.
