SUBJECT: REQUEST FROM COUNCILMEMBER MICHAEL TOUHEY SEEKING
THE CITY COUNCIL'S CONSENSUS TO CONSIDER THE INITIATION
OF A CODE AMENDMENT TO ALLOW THE SALE OF ALCOHOLIC
r BEVERAGES IN CONJUNCTION WITH GASOLINE
RECOMMENDATION:
It is recommended that the City Council direct staff accordingly.
DISCUSSION:
Per the City Council Standing Rules, Councilmember Michael Touhey is seeking the City Council's
consensus to instruct City Staff to prepare a staff report to consider the initiation of a code
amendment that would allow the sale of alcoholic beverages and gasoline by the same business.
In 1977, the City adopted an ordinance that prohibited the sale of alcoholic beverages from
businesses that also sold gasoline. (service stations). A large number of current -day service stations
provide various types of ancillary services, including the operation of mini -marts.
Councilmember Touhey is seeking the consideration of a code amendment that would eliminate the
current prohibition and allow service stations to sell alcoholic beverages along with other types of
food and beverages. All service stations are required to have a conditional use permit, and any
service station seeking to sell alcoholic beverages would need to have a revision to their conditional
use permit approved by the Planning Commission.
FISCAL IMPACT:
Allowing service stations to sell alcoholic beverages in addition to other types of food and
beverages would likely result in a nominal increase in sales tax revenue.
