E-1 DATE February 6, 2007 CAMERON PARK MASTER PLAN AMENDMENT NO.4 EXTENSION OF EVENING USE OF BALLFIELD LIGHTING RECOMMENDATION: Staff recommends that the City Council adopt the following resolution: �U1 5A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF n �a+ WEST COVINA, CALIFORNIA, APPROVING CAMERON PARK ic- MASTER PLAN AMENDMENT NO.4 DISCUSSION: The installation of sports field lighting for Cameron Park was approved by the City Council on September 19, 1995 per Cameron Park Master Plan Amendment No. 1 with conditions that restricted the use of sports field lighting to Monday, Tuesday, Wednesday, and Thursday evenings of each week. Cameron Park Master Plan Amendment No. 2 was approved on December 12, 2000 allowing sports field lighting on Monday evening through Saturday evening of each week from January through July. Sports field lighting is limited to use on Monday, Tuesday, Wednesday, and Thursday evenings of each week from August through December (for more detailed information refer to the Commission staff report dated January 9, 2007). Based on a request by Arlene Saucedo (West Covina Girls Softball League President), on December 5, 2006, the City Council directed staff to extend the hours of use of the sports field lights at Cameron Park from 9:00 p.m. to 9:30 p.m. on an interim basis and requested that a Park Master Plan amendment be initiated to consider extending the use of the lights on a permanent basis. At that time, the reason cited by Ms. Saucedo was safety concerns. The lights have been allowed to remain on until 9:30 p.m. since January 2, 2007. PLANNING COMMISSION AND COMMUNITY SERVICES COMMISSION DISCUSSION AND RECOMMENDATIONS: A joint meeting of the Planning Commission and Community Services Commission was held on January 9, 2007. At that meeting, the Commissions received testimony from Cameron Park patrons, as well as Ms. Saucedo. The Commissions discussed the proposed extension of the sports field lighting, notification of the residents in the area, the length of time games are played, and the possibility of starting the games earlier. After completing their deliberations, both Commissions made unanimous decisions to recommend approval of the Park Master Plan Amendment to extend the use of the sports field lighting from 9:00 p.m. to 9:30 p.m. with the condition that the "Parks Facility Use Agreement" will state that games will end no later than 9:00 p.m. The Community Services Commission voted 10-0 and the Planning Commission voted 3-0 (Commissioners Rozatti and Thrasher were absent). One of the existing conditions for the ballfield lighting is that "the lighting shall be adjusted and/or shielded to prevent the visibility of direct glare to adjacent homes." One shielding device had been installed on one light standard for this purpose. The Public Works Department is currently in the process of replacing the shielding device. FISCAL IMPACT: It is anticipated that extending the lights would result in a marginal increase in utility costs. The proposed amendment is consistent with the General Plan Environmental Quality Element which adopts, as goals, the provision of "adequate recreational facilities and programs for the citizens of West Covina and "the periodic evaluation of the facilities in parks." 3. The project is'a Categorical Exemption, Class 1 (Section 15332: Existing facilities) pursuant to the requirements of the California Environmental Quality Act of 1970 (CEQA) since the project site involves the use of existing lighting fixtures at Cameron Park. NOW THEREFORE, the City Council of the City of West Covina does resolve as follows: 1. The Pledge of Allegiance was led by Chairman Puchalski, followed by a moment of silence. ROLL CALL Present: Planning Commissioners: Redholtz, Sotelo, Fisher Community Services Commissioners: Puchalski, Barrios, Carrico, Chacon, Stewart, Valles, Vargas, Woods (McIntosh arrived at 6:40 p.m.) Absent: Thrasher, Rozatti City Staff Present: McIsaac, McNeill, Morgan, Anderson, Parinas, Planning Director Doug McIsaac announced that Planning Commission Chairperson Rozatti had recused herself because she lives within 300 feet of the site. A. OTHER MATTERS OR ORAL COMMUNICATIONS This is the time when any member of the public may bring a matter to the attention of the Commission that is within the scope of duties assigned to the Commission. The Ralph M. Brown Act limits the Planning Commission and staffs ability to respond to comments on non-agendized matters at the time such comments are made. Thus, your comments may be agendized for a future meeting or referred to staff. The Commission may discuss or ask questions for clarification, if desired, at this time. Royall Brown addressed the Commissions regarding the need for a graffiti abatement program at Galster Park. He also spoke about the inadequate fence surrounding Galster Park and requested that this matter be placed on the agenda for further discussion. B. JOINT PUBLIC HEARING (1) CAMERON PARK MASTER PLAN AMENDMENT NO. 4 CATEGORICAL EXEMPTION APPLICANT: City of West Covina LOCATION: 1305 East Cameron Avenue, Cameron Park REQUEST: To consider extending the evening use of the sports field lighting at Cameron Park from 9:00 p.m. to 9:30 p.m. Community Services Director Michele Mc Neill read a letter in opposition from John Maraio into the record. Chairman Puchalski stated that Mr. Maraio's letter would be considered during the public hearing. Chairman Puchalski opened the public hearing. Planning Director Doug McIsaac presented the staff report. During his presentation he informed the Commissions that the Cameron Park Master Plan currently required that the lights on the softball fields be turned of at 9:00 p.m. In addition, he told the Commissions that staff had discovered that the shields required for the lights had been blown off during a windstorm and would be replaced. She also explained that when the lights go off, it created a dangerous environment in the park for the spectators and staff. Arlene Salcido, Board Member for West Covina Girls Softball, expressed her agreement with the comments made by Ms. Larios. OPPONENTS: No one spoke in opposition. Chairman Puchalski stated that the letter from John Maraio would be entered as testimony in opposition. Chairman Puchalski closed the public hearing. There was a discussion by the Commissions regarding notification of the residents in the - area, the number and length of time games are played on the fields, the possibility of starting the games earlier, the number of months during the year the fields are used, and if this request would affect all the lights in the park, or just the lights on the. softball fields. Planning Commissioner Rob Sotelo added that spectators were no longer allowed to park in the school parking lot, requiring them to park further away from the softball fields. He added that leaving the lights on longer would allow players and spectators to reach their cars safely. It was the consensus of the Commissions to support the request for the extension of time for the lights and recommend approval to the City Council. Community Services Commission Action: Motion by Armbrust, seconded by Stewart, to recommend to the City Council, approval of Cameron Park Master Plan Amendment No. 4. Motion carried 10-0. Planning Commission Action: Motion by Redholtz, seconded by Fisher, to adopt findings as recommended by staff. Motion carried 3-0 (Rozatti, Thrasher absent). Motion by Redholtz, seconded by Fisher, to waive further reading of the body of the resolution and adopt Resolution No. 07-5197, recommending to the City Council, approval of Cameron Park Master Plan Amendment No. 4. HISTORY On 'September 19, 1995, the City Council adopted Resolution No. 9255, approving Cameron Park Specific Plan Amendment No. 1, allowing for the installation of a field lighting system on the existing softball field. Cameron Park Specific Plan Amendment No. 1 included conditions that: (1) restricted the use of sports field lighting to Monday, Tuesday, ' Wednesday, and Thursday evenings of each week; and (2) required the Traffic Committee to review measures aimed at minimizing non-residential traffic and on -street parking on surrounding streets with specific attention given to establishing appropriate conditions to be effective after 7:00 p.m. Cameron Park Master Plan Amendment No. 2 was approved on December 12, 2000. Amendment No. 2 modified the times allowed for the use of lights at the existing sports field, and the parking restrictions. . Amendment No. 2 allows sports field lighting on Monday evening through Saturday evening of each week from January through July. Sports field lighting is limited to use on Monday, Tuesday, Wednesday, and Thursday evenings of each week from August through December. No use is permitted on Sunday evenings at any time during the year. Public hearing notices were also posted at the park site. VI. PROJECT DESCRIPTION AND ANALYSIS At the City Council meeting of December 5, 2006, the Council directed staff to extend the hours of use of the sports field lights at Cameron Park from 9:00 p.m. to 9:30 p.m. on an interim basis. The Council also requested that a Park Master Plan Amendment be initiated to consider extending the use of the lights to 9:30 p.m. on a permanent basis, on the days outlined in the Cameron Park Master Plan. Arlene Saucedo, who is the president of the West Covina Girls Softball League at Cameron Park, submitted a letter in request of extending the sports field lights until 9:30 p.m. Ms. Saucedo's request is due to safety concerns. Currently the sports field lights are scheduled to turn-off at 9:00 p.m., which is also the same time softball games and practices end. Ms. Saucedo requested that the Master Plan be amended to allow the lights to be on until 9:30 p.m. so that parents and players could safely clean the park, exit the bleachers, and return to their vehicles before the lights are turned off. A condition has been included in the amendment resolution requiring that games end by 9:00 p.m. to allow the fields to be cleaned and the participants to leave the field. Notices have been mailed out to residents in the area and staff has received no inquiries regarding the request. As discussed earlier, the lights have been allowed to remain on until 9:30 p.m. since early January 2, 2007. G4 DATE: December 5.2006 FROM: Michele McNeill, Community Services Director SUBJECT: MOTION BY THE COMMUNITY SERVICES COMMISSION TO AUTHORIZE A LIGHTING EXTENSION REQUEST AT CAMERON FIELD. RECOMMENDATION: The Community Services Commission recommends that the City Council: Authorize the extension of Cameron field lighting from 9:00 p.m. to 9:30 p.m., Tuesday, January 2, 2007 through Tuesday, February 6, 2007 for the West Covina Girls Softball Team, until a Park Master Plan amendment process can be initiated to consider extending the use of lights on a permanent basis. DISCUSSION: On Tuesday, November 14, 2006, the Community Services Commission voted unanimously, (8-0; 2 absent) on a motion to recommend that Council authorize a request from the West Covina Girls Softball Team, to extend field lighting from 9:00 p.m. to 9:30 p.m. Fast -tracking the motion would allow the softball team the authority to begin using the lights for an extra 30- minutes as needed, until a Park Master Plan amendment process can be initiated, at which time the public would have the opportunity to comment on the decision. The Planning Commission and Community Services Commission can agendize a public hearing for the Girls Softball lighting request on January 16, 2007. The request would have its second and final hearing during the February 6 h Council meeting, at which time a final decision regarding the request may be reached. The request by Arlene R. Saucedo (president of West Covina Girls Softball League) was based on safety concerns for parents and players cleaning the park, exiting the bleachers, and returning to their vehicles once the field lights have turned off. If the Community Services Commission motion is approved, the West Covina Girls Softball team would extend their lighting usage as early as 1-2-07 and continue usage through 02-06-07. The public's first opportunity to comment on the decision would be 01-16-07, during the public hearing. Currently the Cameron Park field lights are not permitted for usage beyond 9:00 p.m., as set by the Park Master Plan. ALTERNATIVES: 1. Support the concept to provide additional field lighting for the West Covina Girls Softball team, but require that a public hearing to solicit feedback be completed first. 2. Deny the recommendation to extend field lights beyond 9:00 p.m. at Cameron Park, in correlation with the Park Master Plan. • FISCAL IMPACT: • The fiscal impact to extend lights an additional 30 minutes (based on the field lighting fee schedule) is $5.88 for every 30 minutes of use. Prepared by: McNeill city Services Director r ATTACHMENT 6 Facility Use Agreement Between the City of West Covina, and Said Organizations/Leagues This Agreement, made and entered into this 3d day of January, 2007 by and between the City of West Covina, a municipal corporation duly organized and existing under the laws of the State of California, hereinafter referred to as City and West Covina Girls Softball, hereinafter referred to as Organization. WITNESSTH: WHEREAS, it is the City's desire to serve the public interest of the community by providing a program of organized youth sports; and WHEREAS, the goal and purpose of the Organization is to provide a sports program to the youth of the community; In consideration of the mutual covenants and conditions contained herein, the parties do. hereby agree as follows: - 1. TERMS OF AGREEMENT. The City of West Covina grants West Covina Girls Softball the right to use Cameron Park, for a period of time, commencing January 3, 2007, and terminating July 1, 2007. This agreement may be terminated at any time by either party giving to the other party at least fifteen (15) days written notice of termination. The City may renew this Agreement annually; if the Organization operates, the facility designated below in conformance with all laws and regulations applicable thereto. Usage is as follows: 4 Monday -Friday: 4pm-9:30pm* *Usage is for 30 days beginning 1/02/07 until final change to Park Master Plan from City Council. if change not approved contract will be amended to 9:00pm. Saturday: 7am-5pm 2. USE OF FACILITY. The Organization shall have the right to Subject Facility as described in the Facility Use Form at hereinafter Subject Facility. All documents and appropriate fees must be submitted at least two weeks in advance to use. If documents and/or fees are not submitted, the City may withhold use of fields, or grant other usage. 3. RESPONSIBILITY FOR ACTIVITES. The Organization shall provide the personnel necessary to supervise and conduct the activities as set forth in this Agreement at the subject facility, and shall furnish and supply all equipment and materials, which may be necessary for such activities conducted at the subject facility. Athletic field lining and marking - all lining and marking of athletic fields must be done with prior approval of the Community Services Department. Any use failing to comply with established guidelines and notification is subject to invoicing for all damages occurring to fields and termination of facility use permit. 4. RESPONSIBILITY FOR SAID LEAGUES/ORGANIZATIONS. ■ League agrees to observe all rules and regulations as set forth in this Agreement. ■ Modifications to Park Fields and Facilities — The removal, alteration, painting or addition to any facility or grounds, and construction of any kind to existing structures must be approved by the City of West Covina. This includes any proposed changes altering design or appearance of the existing landscape of demised premises. No trees, shrubs, or ground covers shall be planted, trimmed or removed without written consent from the City of West Covina. Any requests to modify or improve park fields and West Covina facilities shall be submitted for approval to the Community Services Department;, at least sixty (60) days prior to the date for any proposed changes. • League agrees to erect no fences or advertising matter of any kind on School District property. • Closure of Fields — Fields may be scheduled for closure and rehabilitation to allow for recovery due to heavy usage. The dates and times of closure are to be determined by the Community Services Department and Public Works Department. • There will be no use of City athletic fields when facilities are unplayable due to rain or other conditions. Any user failing to comply with a decision to postpone use is subject to invoicing for all damages occurring to the field and termination of facility use permit. • No altering of sprinklers without authorization from City of West Covina Maintenance Division. • Any damages to Field areas or Facilities caused by Leagues, will be the Lcugues responsibility to replace or repair. • All locks must be standard City of West Covina Locks and must not be replaced by any other lock. ■ All leagues are responsible for cleaning areas used, including daily trash produce by league. • Leagues are responsible for controlling their players and parents while using the facility. • Leagues may not burn lines into grass. Use of any chemicals must be 8pproved by the property owner (City/School District). • Any violation of this Agreement by a league using said Facility, shall lose their privilege and use of said Facility. Z ■ League/Organization shall comply with all applicable federal, state and local laws, rules, regulations, and the directives issued by City relating to the operations permitted herein. Failure to do so may result in the in-unediate suspension of the Agreement. 5. LEGAL RESPONSIBILITES. The. Organization shall keep itself informed of City, State and Federal Laws, ordinances and regulations, which in any manner affect the performance of its activities pursuant to this Agreement. The Organization shall at all times observe and comply with all laws, ordinances and regulations. Neither the City or its officers, volunteers, attorney's, agents or employees shall be liable at law or in equity as a result of the Organization 's failure to comply with this section. 6. USE OF PREMISES. The Organization shall not permit the subject Facility or any part 'thereof to be used for: ■ The conduct of any offensive, noisy or dangerous activity. ■ The creation or maintenance of a public nuisance. ■ Anything, which fails to comply with public regulations or rules of any public authority at any time applicable to the subject facility; or ■ Any purpose or in any manner which will obstruct, interfere with or infringe upon the rights of the residents of adjoining properties. 7. EXCLUSIVE RIGHT. This Agreement does not give the Organization any right to the exclusive use of the subject facility, restrooms, or any other public facility. The League agrees that the rights herein granted shall not be assigned to or transferred to any persons, teams, or other leagues. 8. MAINTENANCE. The Organization shall at all times during the term of this Agreement or any extensions of renewals thereof, at its own cost and sole expense, maintain the subject facility and all portions thereof, and all surrounding areas in good order, repair, and safe and clean conditions as they are in- the date of commencement of the Agreement, reasonable wear and tear expected. The subject facility shall be maintained in the same or better condition as found before the Organization's use, i.e. free of all trash, rubbish and debris. The Organization shall be responsible for all damages or injury to property or equipment caused by the Organisation, its agents, employees and/or participants. All maintenance such as field preparation, lining of the fields, marking of the fields and set.up of temporary equipment will be performed by user assigned to the facility with prior approval of the Community Services Department. Each user is responsible for the facility being free of trash or debris caused by group usage upon conclusion of each days use. Users are required to report any damage or acts of vandalism to the Community Services Department immediately. 9. INSPECTION. The; City shall have the right to enter the subject facility utilized hereunder as needed. 10. i\IIPROVEMENTS. The removal, alteration, or addition to any facility or grounds and construction of any kind to existing structures must be approved and performed by the Cite. This shell include any proposed changes that would alter the design or appearance of the existing landscape of said facilities. Assistance by the Organization, its agents, employees, or its participants with any such removal, alteration, addition, painting or construction shall be solely at the discretion and with prior written consent of the City. Nothing in this section shall be interpreted as prohibiting the normal maintenance of the facility by the Organization as specified in Section 8. All alterations and additions to any facility or grounds and all construction of any kind to existing structures shall become the property of the City. 11. TITLE TO IMPROVEMENTS. All alterations and additions to the subject facility or surrounding grounds and all constructions of any kind to existing structure of the subject facility shall become the property of the City upon expiration of this Agreement. Nothing contained in this paragraph shall authorize the Organization to make or place any alterations, changes or improvements on the subject facility without the prior written consent of the City. 12. SIGNS. No signs shall be erected or displayed on the subject facility described herein unless written approval is obtained from the City. Such a request for approval shall be directed to the Community Services Manager. No sponsor advertising sign shall be installed on buildings or grounds without the prior written consent of the City. 13. NOTICE. GOVERNING LAW. This agreement will be governed by and constructed in accordance with the laws of the State of California. 16. ASSIGNMENT. Neither this Agreement nor any duties, rights or .obligations under this Agreement may be assigned by Organization, either voluntarily or by operation of law. 17. LIABILITY INSURANCE. Throughout the term of the facility use agreement, and at the user's own cost and expense, user must separately maintain policies of insurance affording general comprehensive liability coverage with a combined single limit of one million dollars ($1,000,000.00) for personal injury to any one person, or multiple injuries arising out of any one occurrence. In addition, user shall separately provide property damage liability insurance with a combined single limit of one million dollars ($1,000,000.00). Before commencement of Agreement, user shall separately to City of West Covina a Certificate of Evidence of said insurance, which shall contain an endorsement. Without limiting the Organization's indemnification, the Organization shall secure from a good and responsible company doing insurance business in the State of California, pay for, and maintain in force and effect for the duration of this Agreement a policy of comprehensive General Liability Insurance with the Organization. In addition, the Organization shall furnish a copy of the policy to the Community Services Department before execution of this Agreement by the City. Notwithstanding any inconsistent statement in the policy or any subsequent endorsement attached thereto, the protection offered by the policy shall: ■ Include the City and School Districts (as applicable), as the insured or named as -additional insured. ■ Insure the City and its officers, attorneys, employees and. agents while acting within the scope of their duties under this Agreement against all claims arising out of, or in connection with, the Agreement. • Bear an endorsement or shall have a rider attached providing that, in the event of expiration or proposed cancellation of such policy for any reason whatsoever, the City shall be notified by registered mail, postage prepaid, return receipt requested, not less than thirty (30) days before such expiration or cancellation is effective. INDEPENDENT CONTRACTOR. The employees' contractors or volunteers of the Organization shall not be deemed employees of the City because of the perforn-rance of this Agreement. 20. ENTIRE AGREEMENT OF THE PARTIES. This Agreement supercedes all agreements, either- oral or written, between the parties hereto with respect to the use of the subject facility by the Organization and contains all of the covenants and conditions between the parties with respect to the use of the subject facility. Each party to this Agreement acknowledges that no representations, inducements, promises or agreement, orally or otherwise, have been made by any party, or an acting on behalf of any party, which are not embodied herein, and that no other agreement, statement, or promise not contained -in this Agreement will be effective only if it is in writing signed by the party to be charges. League games and practices end at 9:00 p.m. when the lights usually turn off, leaving our players, coaches, and family members in the dark to retrieve equipment, pick up trash and also get to their cars. Our league has always complied with the set time but we have had the lights shut. off on us during our games (due to lights shutting off too early because the timer is off) leaving us in darkness with minimal light. Our elderly family members now have to climb down from the bleachers in bad lighting. Our parents have to clean up under the bleachers where insects (black widow's nest) and who knows what can easily sicken or injure them. In such cases, all other conditions and mitigation measures shall continue to apply. The dates for the tournament shall be specified by the league as part of their request for a Facility Use Permit.
