A. OTHER MATTERS OR ORAL COMMUNICATIONS Joanne Wilner — regarding the mapping of cell phone towers. Royall Brown — regarding the City Council consideration of the development of the lower plateau at Shadow Oak Park. B. CONSENT CALENDAR 1. CONTINUED PUBLIC HEARINGS (1) ADMINISTRATIVE USE PERMIT NO. 06-53 CATEGORICAL EXEMPTION APPLICANT: Don C. Quinine LOCATION: 3577 East Hillhaven Drive REQUEST: The applicant is requesting an administrative use permit for an addition to an existing 1,809-square foot single-family home (including a 441-square foot attached garage). The addition consists of a 397-square foot first -story addition and a 944-square foot second -story addition, for a total 'of 1,341 square feet. The house with the proposed addition would be 3,150 square feet. The project is located in the "Single - Family Residential" (R-1) Zone, Area District I. This matter was continued from the meeting of December 12, 2006 to allow for the size of the addition to be reduced. COMMENTS: Dori C.. Quinine, applicant, and Jaime Jasso, property owner, spoke in favor of the application. Joanne Wilner spoke in opposition. The Commission also considered the efforts made by Mr. Quinine to work with staff to make this home more compatible with the surrounding area. It was the consensus of the Commission that the proposed addition to the home would not be detrimental to the surrounding neighborhood. Motion by Redholtz, seconded by Fisher, to adopt findings as recommended by staff. Motion carried 5-0. Motion by Redholtz, seconded by Fisher, to waive further reading of the body of the resolution and adopt Resolution No. 07-5198, approving Administrative Use Permit No. 06-53. Motion carried 5-0. NEW PUBLIC HEARINGS (2) GENERAL PLAN AMENDMENT NO. 06-04 ZONE CHANGE NO. 06-04 PRECISE PLAN NO.06-18 TENTATIVE TRACT MAP NO. 67864 VARIANCE NO. 06-21 NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT APPLICANT: Charles Mautz LOCATION: 850-856 South Sunset Avenue REQUEST: The project consists of a request for a General Plan amendment to change the land use designation from "Low Medium Residential" (4.1 to 8.0 units per acre) to "Medium High Residential' (15.1 to 20 units per acre) and a zone change application to change the designation from "Residential Agricultural' (R-A) to "Multiple -Family Residential' (MF-20). A precise plan is proposed to construct 20 condominium units and a tentative tract map to subdivide the property. In addition, a , variance has been requested to deviate from code requirements, including ground coverage, lot width, recreational leisure space with a minimum dimension of 50 feet, and building separation. The site is 1.07 acres and is currently occupied by two single- family homes, which will be demolished to construct the condominiums. COMMENTS: Andrew McIntyre, .representing the applicant, spoke in favor of the project. Jeremy Infrance, William B. Schafer and Edelia Fernandez spoke in opposition. Staff informed the Commission that the applicant was requesting that this matter be continued to allow them time to holda community meeting for the residents. Mr. Infrance, Mr. Schafer and Mrs. Fernandez all indicated that they wished to address the Commission in opposition. It was the consensus of the Commission to continue this matter to the February 13, 2007 regular meeting. Motion by Sotelo, seconded by Fisher, to continue this matter until February 13, 2007. Z:\PLANCOM\SUMACTS\SUmActs 2007\1.9.07 sum.act.doc Planning Commission Summary of Action Page 3 — January 9, 2007 (3) PRECISE PLAN NO. 06-14 NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT APPLICANT: Cadet Partners LOCATION: 1200-1314 West Francisquito Avenue REQUEST: The applicant is requesting a precise plan to allow for a 29,696-square foot addition to an existing retail center (Sunset Square Shopping Center) on a 12.8-acre site. The applicant is also proposing to remodel the facade of the existing retail buildings on the easterly portion of the shopping center. COMMENTS: Eddy Sutiono and Jack Nourafshan, representing the applicant, Lloyd Johnson and Royall Brown spoke in favor of the request. No one spoke in opposition. There was a discussion by the Commission regarding the proposed improvements to the property. During the discussion, the Commission considered the ingress and egress to the property, the accessibility to the parking at the rear of the property, the removal of the temporary banners currently located on the property and the types of new tenants the property owner hoped to attract to the center. The Commission expressed their support of the renovation of the center and agreed that this improvement would be beneficial to the City and immediate area. Motion by Thrasher, seconded by Redholtz, to adopt findings as recommended by staff. ' Motion carried 5-0. Motion by Thrasher, seconded by Redholtz, to waive further reading of the body of the resolution and adopt Resolution No. 07-5199, certifying the Negative Declaration of Environmental Impact for Precise Plan No. 06-14. Motion carried 5-0. Motion by Thrasher, seconded by Redholtz, to adopt findings as recommended by staff. Motion carried 5-0. Motion by Thrasher, seconded by Redholtz, to waive further reading of the body of the resolution and adopt Resolution No. 07-5200, approving Precise Plan No. 06-14. Motion carried 5-0. (4) CONDITIONAL USE PERMIT NO. 06-24 CATEGORICAL EXEMPTION APPLICANT: Lelizabeth Crisostomo LOCATION: 535 South California Avenue, Pondahan Restaurant Cafe & Bar REQUEST: The project consists of a request for a conditional use permit to allow the on -sale service of beer and wine within a new 1,950-square foot restaurant. The project is located in the "Neighborhood Commercial" (N-C) Zone. COMMENTS: Pochie Crisostomo and Lelizabeth Crisostomo, applicants, Joanne Wilner and Bernie Wilner spoke in favor of the application. No one spoke in opposition. The Commission expressed their support of the project. Motion by Redholtz, seconded by Sotelo, to adopt findings as recommended by staff. Motion carried 5-0. Motion by Redholtz, seconded by Sotelo, to waive further reading of the body of the resolution and adopt Resolution No. 07-5201, approving Conditional Use Permit No. 06-24. Motion carried 5-0. D. NON -HEARING ITEM (1) • STUDY SESSION CODE AMENDMENT NO. 06-04 STORAGE CONTAINER The proposed code amendment consists of certain amendments to Chapter 26 (Zoning) of the West Covina Municipal Code related to regulating storage containers in Single -Family Residential zones. Staff recommends that the Planning Commission initiate a code amendment regarding storage containers and provide comment and direction as appropriate. COMMENTS: Joanne Wilner, Bernie Wilner, Lloyd Johnson and Royall Brown commented on this matter. There was a discussion by the Commission regarding the increased use of temporary storage containers in residential zones. During the discussion, the Commission indicated that they were in favor of regulating the use of the containers in residential zones. It was suggested by the Commission that the use of the containers should be allowed when the property owner has an active building permit, or on a limited basis for residents who are relocating. Staff was directed to draft a code amendment regulating temporary storage containers in single-family residential zones for review by the Planning Commission. Motion by Thrasher, seconded by Sotelo, to waive further reading of the body of the resolution and adopt Resolution No. 07-5202, initiating a code amendment regarding storage containers in single-family residential zones.
