D-1 Planning Director DATE: December 21, 2004 SUBJECT: ZONE CHANGE NO.04-04 CATEGORICAL EXEMPTION Applicant: Suzanne Dunn, West Covina Chamber of Commerce Location: 1000 West Covina Parkway (West Covina Parkway Plaza) RECOMMENDATION: The Planning Commission and staff recommend that the City Council introduce the following ordinance: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING ZONE CHANGE NO.04-04 DISCUSSION: The applicant is proposing a zone change to add the Outdoor Uses Overlay Zone to the property located at 1000 West Covina Parkway. An administrative use permit to allow a Farmer's Market in the West Covina Parkway Plaza was approved by the Planning Commission on November 9, 2004. The property is zoned "Neighborhood Commercial" (N-C). The property is an irregularly -shaped lot consisting of 227,819 square feet (approximately 5.2 acres) and is located along the southwesterly corner of California Avenue and West Covina Parkway and is accessible from both streets. The shopping center is 86,712 square feet and is developed with inline shops as well as separate pad buildings. The buildings are constructed at an angle to West Covina Parkway, with setbacks of approximately 75 feet. The Farmers Market is located in the parking area adjacent to West Covina Parkway. The Municipal Code allows for the operation of a Farmer's Market only with areas that include the Outdoor Uses Overlay Zone. The Outdoor Uses Overlay Zone was initially developed for The Lakes Entertainment District. Therefore, a Farmer's Market is currently not allowed at any other location in the City. The applicant is requesting a zone change to add the Outdoor Uses Overlay Zone to the existing zoning on the property, "Neighborhood Commercial" (N-C). The N-C development standards and allowed uses would continue to apply on the subject property. The addition of the Overlay would allow outdoor activities, such as the Farmer's Market, outdoor seating, and outdoor entertainment areas. Furthermore, the Overlay also establishes standards for such uses. For a description of the standards for the Farmer's Market, see the Planning Commission staff report dated November 9, 2004. While it may seem that the Farmers Market and Swap Meets are similar, there are definitive differences. A Farmers Market is allowed by the Zoning Code with restrictions to the type of retail and food merchandise that can be sold. In addition, the Farmers Market is regulated by the California Administrative Code, which establishes standards for produce and types of merchandise that can sold at a Certified Farmers Market. FISCAL IMPACT: The proposed rezoning would result in some sales tax revenues to the City due to activities at the Farmers Market. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING ZONE CHANGE NO.04-04 WHEREAS, there was filed with the City a verified application on the forms prescribed in Section 26-153 and 26-199 of the West Covina Municipal Code: a proposal to add the "Outdoor Uses Overlay" Zone to the existing "Neighborhood Commercial" (N-C) Zone on that certain property generally described as follows: Assessor Parcel No. 8475-002-032 & 34 and 8940-368-035, as shown on the latest rolls of the Los Angeles County Tax Assessor; and WHEREAS, the proposed zone change is consistent with the proposed General Plan Designation of "Service and Neighborhood Commercial"; and WHEREAS, the proposed zone change maintains consistency between the General Plan and Zoning Map; and WHEREAS, said zone change application is requested to allow for the rezoning of the above property for a Farmer's Market; and WHEREAS, the Planning Commission, upon giving the required notice, did on the 9`l' day of November, 2004, conduct a duly noticed public hearing to consider the subject application for a Zone Change, at which time the Planning Commission adopted resolution 04-4978 recommending approval to the City Council; and WHEREAS, the City Council did, on the 21" day of December, 2004, conduct a duly advertised public hearing as prescribed by law, and considered evidence presented by the Planning Commission, Planning Department, and other interested parties. - WHEREAS, studies and investigations made by the City Council and in its behalf reveal the following facts: 1. The proposed change of zone will not adversely affect adjoining property as to value or precedent and will not be detrimental to the area. C. A change of zone will be in the interest or furtherance of the public health, safety, and general welfare. d. The approval of such a change of zone will not adversely affect the comprehensive General Plan so adopted by the City. e. The approval of such a .zone change is consistent with the General Plan or applicable specific plans. 4. The applicant is requesting a zone change to add the "Outdoor Uses Overlay" Zone to allow a Farmer's Market in the parking lot of the West Covina Parkway Plaza on Saturdays. Without the requested zone change, the Farmer's Marker would not, be allowed to operate. b. The proposed zone change will not adversely affect adjoining property value and will not be detrimental to the area because the modification will allow for the operation of a Farmer's Market on the subject property on Saturdays. C. The proposed zone change is compatible with the surrounding area will not adversely affect the public health, safety or general welfare of the surrounding neighborhood. d. The proposed zone change will not adversely affect the General Plan as consistency between the General Plan and the Zoning Map will be maintained, since the approval of this zone change is consistent with the General Plan designation of "Service and Neighborhood Commercial". e. . The approval of such zone change is consistent with the General Plan. STAFF RECOMMENDATION Staff recommends that the Planning Commission adopt a resolution recommending to the City Council approval of Zone Change No. 04-04 and adopt a resolution approving Administrative Use Permit No. 04-35. III. ENVIRONMENTAL DETERMINATION Pursuant to Section 15304 of the California Environmental Quality Act (CEQA), the proposed project is considered to be categorically exempt (Class 4, Minor Alteration to Land) in that it consists of minor alterations to an existing shopping centers. IV. HISTORY The Planning Commission approved Precise Plan No. 651 in February 1973, allowing the construction of a neighborhood shopping center of approximately 70,000 square feet at the project site. Since the original approval, four revisions to the Precise Plan have been approved, allowing additions to the commercial center and changes in the architecture. Precise Plan No. 651, Revision 4 was approved in January 1994, and allowed the construction of a 9,000-square foot (approximately) freestanding building in place of a 4,776-square foot building. The center is currently 87,000 square feet in size (approximately) and has a total of 389 parking spaces. A Temporary Use Permit (TUP) was approved in April 2004 to allow for the Farmer's Market use through the summer. At the time of review of the TUP, staff discussed with the applicant the need to submit a zone change and administrative use permit to allow for the Farmer's Market on a permanent basis. The applicant has therefore submitted the necessary applications. The West Covina Chamber of Commerce is operating the Farmer's Market under to a temporary use permit approved by the Planning Department. The proposed administrative use permit would not alter the location or layout of the Farmer's Market. It would continue to operate in the same manner as it has been doing since April. The applicant has submitted an "Operations Plan" as required by the code. The Operations Plan provides information on the management of the Farmer's Market and covers issues such as vendor layout, hours of operation and trash removal. The "Market Area" is located between the two drive approaches on West Covina Parkway and generally takes up the two rows of parking in that location. Barriers are put in place at the end of the drive aisles that intersect with those being used by the market. Key parking spaces are designated "turn -around" spaces so that vehicles do not have to back out of blocked drive aisles. Farmers Market customers are directed to park in the parking area adjacent to the corner of West Covina Parkway and California Avenue. Vendor parking is located in parking spaces adjacent to California Avenue. Vendors are arranged in categories. Produce vendors are located on the northerly portion of the market area, arts and crafts vendors are located on the southerly portion of the market area, and food stands are located on the easterly end of the market or disbursed among the arts and crafts. _ The Farmer's Market operates from 8:00 am to 2:00 pm on Saturdays. Vendors may begin setting up their booths at 6:00 am. The Farmer's Market will be dismantled by 2:30 pm. As part of the. Farmer's Market, the applicant is also proposing entertainment. Entertainers would either be mobile, traveling throughout the market area, or be located at the cement area adjacent to Pier One Imports, if amplified sound is part of the entertainment. Rules for entertainers are included in the Operations Plan and conditions of approval are included in the administrative use permit resolution. The Chamber of Commerce has worked with the ownership of the shopping center as well as the tenants to deal with any issues. The applicant has indicated that when the Farmer's Market began operation at the site, there was some concern about the effect it would have on the businesses. She indicated that the tenants are generally satisfied that the Farmer's Market is not negatively affecting their business. Staff has received no complaints during the time period that the market was allowed under the temporary use permit. As part of the public hearing process, notices were mailed to the "occupants" of the tenant spaces in the center. As of the date of the completion of the staff report, staff had received no complaints from the tenants. Zone Change The Municipal Code allows for the operation of a Farmer's Market only with areas that include the Outdoor Uses Overlay Zone. The Outdoor Uses Overlay Zone was initially developed for The Lakes Entertainment District. Therefore, a Farmer's Market is currently not allowed at any other location in the City. The applicant is requesting a zone change to add the Outdoor Uses Overlay Zone to the existing zoning on the property, "Neighborhood Commercial" (N-C). The N- C development standards and allowed uses would continue to apply on the subject property. The addition of the Overlay would allow outdoor activities, such as the Farmer's Market, outdoor seating, and outdoor entertainment areas. The code (Section 26-735.1 (h)) defines specialty retail items as: ". . . retail merchandise that has been produced though hand - manufacturing or handcrafted methods, and excludes pre -packaged merchandise that is available in national distribution," The code (Section 26-735.1 (g)) defines specialty food items as: "... food or non-alcoholic drink items that are prepared and/or served on -site, that are not commercially prepackaged, and that would not generally be considered to be a meal item. Examples of permitted items include fresh popcorn, pretzels, pastries, cotton candy, ice-cream cones, and juices. Examples of excluded items include prepackaged candy bars and other prepackaged snack items, hot dogs, hamburgers, pizza, or tacos." Conditions of approval have been included in the resolution requiring that the items sold at the Farmer's Market comply with the standards. Currently, staff is processing a code amendment, initiated by the Planning Commission, to revise some of the standards in the Overlay Zone. Any changes to the code regarding the definition of specialty retail items or specialty food items would also apply to the Farmer's Market. Conclusion Staff believes that the proposed zone change and administrative use permit will be beneficial in that it allows for a unique activity and shopping opportunities that do not exist anywhere else in the City. The Chamber of Commerce has worked with the property owner and the tenants of West Covina Parkway Plaza to minimize negative impacts. VII. STAFF RECOMMENDATION Staff recommends that the Planning Commission adopt a resolution recommending to the City Council approval of Zone Change No. 04-04 and adopt a resolution approving Administrative Use Permit No. 04-35. The project is consistent with the "Outdoor Uses Overlay" Zone as specified in the Municipal Code (Section 26-735). 4. Appropriate findings for approval of an administrative use permit for a outdoor uses are as follows: a. That the proposed use at the particular location is necessary or desirable to provide a service or facility that will contribute to the general well being of the neighborhood or community. b. That such use will not, under, the circumstances of the particular case, be detrimental to the health, safety, peace or general welfare or persons residing or working in the vicinity or injurious to property or improvements in the vicinity. That the site abuts streets and highways adequate in width and improvements to carry traffic generations typical of the proposed uses and the street patterns of such a nature exist as to guarantee that such generation will not be channeled through residential areas on local residential streets. That the granting of such conditional use permit will not adversely affect the General Plan of the City, or any other adopted plan of the City 5. Pursuant to Section 15304 of the California Environmental Quality Act (CEQA), the proposed project is considered to be categorically exempt (Class 4, Minor Alteration to Land) in that it consists of minor alterations to an existing shopping center. NOW, THEREFORE, the Planning Commission of the City of West Covina does resolve as follows: On the basis of the evidence presented, both oral and documentary, the Planning Commission makes the following findings: a. The proposed outdoor activity of a Farmer's Market is appropriate in the Parkway Plaza Shopping Center. The Farmer's Market will provide an "urban" experience in the area and encourage people to shop in the center and neighboring Westfield Shopping Mall. b. The proposed outdoor use will not be detrimental to the health, safety, peace or general welfare or persons working or visiting the area, but will provide additional shopping opportunities in the area. C. The site for the proposed outdoor activity (Farmer's Market) is adequate in size and is so shaped to accommodate the proposed use. The Farmer's Market will be located along the north side of the parking lot adjacent to West Covina Parkway. d. The district is served by streets and highways of adequate width, including West Covina Parkway and California Avenue. The addition of outdoor uses in the area will not cause a significant increase in traffic to the district. The proposed use is consistent with the "Service and Neighborhood Commercial" designation of the General Plan. The proposed use is also consistent with the "Outdoor Uses Overlay" Zone. 2. That pursuant to all of the evidence presented, both oral and documentary, and further based on the findings above, Administrative Use Permit No.04-35 is approved subject to the provisions of the West Covina Municipal Code, provided that the physical development of the herein described property shall conform to said plan and the conditions set forth herein which, except as otherwise expressly indicated, shall be fully performed and completed or shall be secured by bank or cash deposit satisfactory to the Planning Director, before the use or occupancy of the property is commenced and before the Certificate of Occupancy is issued, and the violation of any of which shall be grounds for revocation of said precise plan by the Planning Commission or City Council 3. That the administrative use permit shall not be effective for any purpose until the owner of the property involved (or a duly authorized representative) has filed at the office of the Planning Director, his affidavit stating he is aware of, and accepts, all conditions of this precise plan as set forth below. The costs and expenses of any enforcement activities, including, but not limited to attorneys' fees, caused by the applicant's violation of any condition imposed by this approval or any provision of the West Covina Municipal Code shall be paid by the applicant. 5. B. Vendor Spacing Stalls will be in 10' x 10' increments (10' x 10', 10' x 20', 10' x 30', etc.) C. Vendor Locations — Stalls are arranged from west to east as far as space or demand, allows within the limits of the site. 1. Farmers/Produce vendors will be located on the north portion of the site. 2. Arts & Craft vendors will be arranged along the south portion of -the site. 3. Food stands will be at the east end of the market or disbursed among the Arts and crafts booths. 4. Information booths will be distributed among the arts and crafts booths. D. Vendor Parking Vendor parking is designated on the plot map (east side of Plaza along California Ave.) E. Display Type Stalls, booths and stands of the designed sizes stated in item B. Signage will vary from vendor to vendor and has purposely not been regulated or standardized. The Chamber of Commerce must approve all signs prior to the date they are used at the Street Festival. F. Display Appearance/Design The appearance and design of structures (signs, booths, stands, and tables) for stalls must be tasteful in the choice of color, material, and style. Final approval is at the discretion of the Chamber of Commerce. No structure associated with a display shall exceed a maximum height of 8 feet nor exceed a maximum covered area of 400 square feet (without prior Fire Department authorization). Structures shall not exceed the width of the vendor space nor cover the display or signage of another vendor. The Chamber of Commerce must approve all designs prior to the date they are used at the Street Festival. C� G. Trash Storage/Removal • During the event trash receptacles will be placed along the center aisle between the produces vendors and the arts & crafts booths. • The property owners, Ophir Management, have given permission for the'trash to be deposited in the commercial trash bins located behind the building currently occupied by Pier One Imports. • Chamber/Street Festival personnel will be responsible for the maintenance of the trash receptacles and the removal and disposal of all trash after the event. • Vendors are responsible for their own trash storage and disposal during and after event. H. Hours of Operation The event will be open year round from 8:00 a.m. to 2:00 p.m. Set up will begin as early as 6:00 a.m. Take down will be completed by 3:00 p.m. I. Set Up/Tear Down Set up will begin no earlier than 6:00 a.m. Vendors will check -in and receive space assignments from Festival Manager. Business Licensing The Chamber of Commerce will maintain a City Business License for the Street Festival. N. Signage Other than the restriction of stall/booth/stand size, based on type of vendor, signage has not been regulated or standardized to provide an interesting and eclectic collection of displays. The Chamber must approve all signage prior to it's' use at the Festival. All signage must meet local guidelines and restrictions. O. Traffic Management To prevent traffic moving through the area, during the event, cones and barricades will be placed at all areas of entrance to the site. P. Electrical Power Supply Electrical power will be supplied by an outlet located on the building currently occupied by Pier One Imports. U.L. approved protective power cord(s) in contrasting colors will be used, when necessary, for safe pedestrian traffic over the cords. Whenever necessary the Chamber will rent a generator to supplement or replace the source of electricity. Individual vendors may supply their own generators as needed. r� • WEST COVINA CHAMBER OF COMMERCE STREET FESTIVAL/CERTIFIED FARMERS MARKET RULES TYPE AND PURPOSE OF MARKET: This is a Street Festival which includes a Certified Farmers' Market operating in accordance with regulations published in California Administrative Code, Title 3, Chapter 3, Group 4, Article 6.5 on Direct Marketing. The purpose of the Festival is to provide an outlet for vendors at which they may sell at prices normally higher than wholesale and to provide an opportunity for consumers to purchase products and produce at prices normally lower than retail, thus benefiting both producers and consumers. HOURS OF SALE: The Festival will be open every Saturday from 8:00 a.m. to 2:00 p.m. All sellers should be in place and ready to sell by 8:00 a.m. and may not begin selling prior to that time (exceptions may be made, at the discretion of the Festival Manager, in cases of inclement weather). Examples of permitted items include fresh popcorn, pretzels, breads and pastries, specialty drinks, etc. Examples of excluded items include pre -packaged candy bars and other snack items, commercially prepared breads & pastries, etc. Specialty retail items shall mean retail merchandise that has been produced through hand -manufactured or hand-crafted methods, and excludes pre -packaged merchandise that is available in commercial distribution. WHO MAY SELL: • Arts & Crafts Vendors must have applied for and received a permit from the West Covina Chamber of Commerce. • Produce Vendors must hold a Certified Producer Certificate issued by the Agricultural Commissioner in the county of origin of their produce.
