EXTENSION OF TIME PRECISE PLAN NO.02-17 VARIANCE NO. 02-1.1 ADMINISTRATIVE USE PERMIT NO. 02-17 APPLICANT: Theodore Slaught LOCATION: Northwest corner of South Glendora Avenue and Glendora Square The applicant is requesting the first of three one-year extension of time for the above referenced precise plan, variance and administrative use permit. ZA\ LANCOM\SUMACTS\SumActs 2004\1 27 04 sum act.doc Planning Commission Summary of Action Page 2 — January 27, 2004 CONTINUED PUBLIC HEARINGS (1) CONDITIONAL USE PERMIT NO.03-08 CATEGORICAL EXEMPTION APPLICANT: AT&T Wireless LOCATION: 1305 East Cameron (Cameron Park) REQUEST: The applicant is requesting the approval of a conditional use permit to install a.56-foot 6-inch high cell phone tower that will be constructed as a clock tower. Three sets of four antennas will be located behind the clock fagade and a new equipment building will be constructed on site. COMMENTS: Joanne Wilner addressed the Commission regarding this matter. Planning Director McIsaac reported that on January 20, 2004, the City Council voted to concur with the Commission's direction to move the clock tower closer to the intersection and enhance its design. The Commission was shown an aerial photo of Cameron Park and it was suggested by staff that the most appropriate location for a new location was on the opposite (easterly) side of the sidewalk from the picnic shelter. The Commission concurred. The Commission was also shown photos of other clock towers done in other cities. It was the consensus of the Commission that the clock tower should use materials that were compatible with the new community center. Other ideas mentioned were moving the cell tower closer to the community center and designing it as a flagpole, or if the structure would be too massive for the corner, go back to designing it as a "monopine" located in the vicinity of the restrooms. Staff indicated that they would need to meet with the applicant to develop a revised design. Motion by York, seconded by Lane, to continue the consideration of this matter to the regular meeting scheduled for February 10, 2004. Motion carried 4-0. Item No. C-3 was heard out of order. NEW PUBLIC HEARINGS (3) CONDITIONAL USE PERMIT NO. 510, REVISION 1 DEVELOPMENT PLAN NO. 36, REVISION 2 NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT APPLICANT: Good Steward's Church LOCATION: 2701 South Woodgate Drive REQUEST: The applicant is requesting the approval of a development plan to allow the construction of a 7,545-square foot, two- story education building and an 8,007-square foot, one- story sanctuary to an existing religious facility. The property was approved for a religious facility in 1999. The applicant is also requesting the approval of a conditional use permit to allow a Sunday school use on the property and an expansion of the religious facility use. The project is located in the "Planned Community Development" (PCD-1) Zone. Z:\PLANCOM\SUMACTS\SumActs 2004\1 27 04 sum act.doc Planning Commission Summary of Action Paee 3 — January 27, 2004 COMMENTS: Miyung Chung, project architect, and Pastor James Han spoke in favor of the request. Joslyn Yu and Manuel Estrella, neighboring residents, spoke in opposition, indicating problems with trash enclosures, noise, and privacy The Commission reviewed the neighbors' concerns with representatives of the church and the need to be "good neighbors." The church was reminded of restrictions on hours of indoor and outdoor activities and the representatives said they would do a better job monitoring activity outside and in the parking lot after 10:00 p.m. The Commission requested that staff inspect the existing block wall to make sure that has been constructed at the full 6-foot height as required. The Commission also added a condition requiring a roof to be added to the existing trash enclosure. Motion by York, seconded by Tarozzi, to adopt findings as recommended by staff. Motion carried 4-0. Motion by York, seconded by Tarozzi, to waive further reading of the body of the resolution and adopt Resolution No. 04-4914, certifying the Negative Declaration of Environmental Impact for Conditional Use Permit No. 510, Revision 1 and Development Plan No. 36, Revision 2. Motion by York, seconded by Tarozzi, to waive further reading of the body of the resolution and adopt Resolution No. 04-4915, approving Conditional Use Permit No. 510, Revision 1. Motion carried 4-0. Motion by York, seconded by Tarozzi, to waive further reading of the body of the resolution and adopt Resolution No. 04-4916, approving Development Plan No. 35, Revision 2, as amended. (2) CODE AMENDMENT NO.03-05 GENERAL EXEMPTION APPLICANT: City of West Covina LOCATION: Citywide REQUEST: The proposed code amendment consists of certain amendments to Chapter 26 (Zoning) of the West Covina Municipal Code amending regulations regarding the restriction of the use of a motor home or trailer as living quarters in single-family residential zones. COMMENTS: There was no public- testimony. The Commission concurred with staff that the proposed code amendment adequately addressed their concerns regarding people living in motor homes or trailers. It was therefore the consensus of the Commission to recommend approval of the code amendment to the City Council. Motion by Lane, seconded by York, to adopt findings as recommended by staff. Motion carried 4-0. D. NON -HEARING ITEMS (1) PLANNING COMMISSION AUTHORIZED PLANNING DIRECTOR'S MODIFICATION NO. 04-02 TO PRECISE PLAN NO.02-22 APPLICANT: Don Cook, D. C. Corporation LOCATION: 1807-1837 West Badillo Street This project consists of a proposal to modify the approved size of the houses in the 35-unit subdivision at 1807 to 1837 East Badillo Street (on the northwest corner of Badillo Street and Orange Avenue). COMMENTS: Craig Cook, representing the applicant, spoke in favor of the request. Joanne Wilner spoke in opposition. Chairman Warshaw expressed the opinion that the City Council had reduced the density of the project to help make for more open space and that the proposed increase in floor area of the homes worked against this. Commissioners Lane, Tarozzi, and York stated that they felt that the revised designed improved the desirability of the homes and the increase in square footage was not that substantial. Motion by Lane, seconded by Tarozzi, to approve Planning Commission authorized Planning Director's Modification No. 04-02 to Precise Plan No. 02-22. Motion carried 3-1 (Warshaw). (2) .STUDY SESSION CODE AMENDMENT NO.03-03 APPLICANT: City of West Covina LOCATION: Citywide The review of a code amendment initiated by City Council regarding the parking of utility trailers and accessory recreation vehicles (RVs) in driveways in single-family residential zones. Staff recommends that the Planning Commission provide direction as appropriate. COMMENTS: Joanne Wilner, Sue Augino and Jeremy Salinas addressed the Commission in opposition to allowing trailers and recreational vehicles to be parked in driveways in single-family residential zones. Mary Hernandez and Arthur Reyna spoke in favor of allowing recreational vehicle parking. It was the consensus of the Commission that steps needed to be taken toward instituting tighter restrictions on the parking of recreational vehicles and utility trailers in the front yard of single-family homes. Commissioner York suggested that utility trailers and smaller accessory recreational vehicles (such as Seadoo's and ATV's) should not be permitted to park in the front yard area, and that recreational vehicles that are "too large" for the lot should also be prohibited. Commissioner York suggested, and the Commission concurred, that some kind of grandfathering Z:\PLANCOM\SUMACTS\SumActs 2004\1 27 04 sum act.doc Planning Commission Summary of Action Page 5 — January 27, 2004 provision should be adopted to allow homeowners who currently have recreational vehicles to continue to able to park them in the front yard: It was agreed that staff would develop some possible options to consider based on the Commission's direction and that another study session would be scheduled in 4-6 weeks. E. OTHER MATTERS OR ORAL COMMUNICATIONS None F. COMMISSION REPORTS/COMMENTS AND MISCELLANEOUS ITEMS a. South Azusa Avenue Capacity Enhancement Study. Planning Commission discussion of City Council action on January 20, 2004. Commissioner Tarozzi expressed concern that the Commission's action regarding this matter was properly communicated to the City Council. The Commission asked several questions regarding what would happen if the report and/or EIR was not. completed or adopted. Commissioner Tarozzi reiterated his concern that he would like to have it established that the City would not widen Azusa Avenue to six lanes. Chairman Warshaw wanted more information regarding the true costs to widen Azusa Avenue. Commissioner Lane asked if it could be made a requirement that Azusa Avenue could only be widened if 90 percent of the residents along the street were in favor of it. The Commission requested that staff seek the opinion of the City Attorney regarding what it must do to satisfy its contractual obligations with MTA and to communicate its concerns to the City Council. (1) CITY COUNCIL ACTION: February 3, 2004 meeting: -Appeal of Planning Commission to deny Variance No. 03-10 and Tree Removal Permit No. 03-04 -Zone Change No. 03-03, Abell Helou, Southeast Corner of Hollenbeck Street and Garvey Avenue North -Galster Park Master Plan, Amendment No. 1 (2) PLANNING DIRECTOR'S REPORT: a. Status on Quail Ridge Shopping Center Planning Director McIsaac stated that the developer was only waiting on corporate approval from Sav-On regarding changes to the truck loading area. They will, however, need to apply for another short extension past the current expiration date of February 4, 2004. The extension request would likely be considered by the Commission at its next meeting on February 10. Herb Redholtz also stated his concerns regarding the lack of progress. G.
