ZAPLANCOM\SUMACTS\SumActs 2003\1 28 03 sum act.doc Planning Commission Summary of Action Page 2 - January 28, 2003 CONTINUED PUBLIC HEARING (1) VARIANCE NO 02-10 CATEGORICAL EXEMPTION APPLICANT: Julius Friedman LOCATION: 1128 Promontory Place REQUEST: The project consists of a request to vary from required development standards to allow encroachments into the side yard setbacks for an addition to an existing single- family residence. COMMENTS: There was no public testimony. The Commission received a letter from the neighboring property ownermremoving his objections after meeting with staff to review the proposal. The Commission concluded that the granting of the variance was appropriate. Motion by Scheuplein, seconded by Tarozzi, to adopt findings as recommended by staff. Motion carried 4-0. Motion by Scheuplein, seconded by Tarozzi, to waive further reading of the body of the resolution and adopt Resolution No. 03-4812, approving Variance No. 02- 10. Motion carried 4-0. NEW PUBLIC HEARINGS (2) PRECISE PLAN NO.02-18 VARIANCE NO.02-12 CATEGORICAL EXEMPTION APPLICANT: Judy Chan — Sakura of Tokyo LOCATION: 533 South Glendora Avenue REQUEST: The project consists of a precise plan to allow for two carports with solar generation equipment. The carports are located along the northerly and westerly property lines and are 3,300 square feet and 1,315 square feet, respectively. A variance is also requested to deviate from required development standards, including rear yard setback. The project is located in the "Neighborhood Commercial" (N- C) Zone. COMMENTS: Judy Chan and Tricia Lui, representing the applicant, and Royall Brown spoke in favor of the proposal. There was no testimony in opposition. The Commission was very , concerned with the aesthetic appearance of the proposed carport structure. Commissioners Scheuplein and Warshaw felt the project may be acceptable if the design were modified to make it more architecturally compatible with the building as recommended by staff. Chairperson Lane and Commissioner Tarozzi were concerned that it may not be appropriate at all unless contained to the rear of the property and/or the roof of the building. In response, the applicant was adamant that they did not wish to make any changes. The Commission therefore did not feel they could support the project as proposed. (3) ADMINISTRATIVE USE PERMIT NO.02-21 CATEGORICAL EXEMPTION APPLICANT: Rene Ortiz, MPA Design Group LOCATION: 2719 East Cortez Street REQUEST: The applicant is requesting the' approval of an administrative use . permit to allow the construction of a two-story 7,419-square foot single-family house. The existing house will be demolished. The project site is located in the "R-l" (Single -Family Residential) Zone. COMMENTS: Man Pham, representing the applicant, spoke in favor of the proposal, Kevin McCann and Chris Graham, spoke in opposition, stating that they felt that the proposed home was too large and out of character with the neighborhood as proposed. The consensus of the Commission was that the design of the proposed home needed to be modified in order to make it compatible with the neighborhood. Individual Commissioners expressed their ideas of what they felt needed to be done, including moving the home further back from the street, reducing the size of the home, modifying the architecture from Mediterranean to a style with more Ranch style elements, breaking of the mass andreducing the size of the second floor compared to the first, and ensuring that no second -story windows or balconies would infringe on the privacy of neighboring lots. Motion by Lane, seconded by Scheuplein, to table this matter indefinitely and direct the applicant to redesign pursuant to Commission direction. Motion carried 4-0. (4) GENERAL PLAN AMENDMENT NO. 02-06 ZONE CHANGE NO.02-05 TENTATIVE TRACT MAP NO. 5399 PRECISE PLAN NO.02-22 NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT APPLICANT: David Cook, D.C. Corporation LOCATION: 1807-1837 East Badillo Street (Northwest Corner of Orange Avenue and Badillo Street) Z:\PLANCOM\SUNIACTS\SumActs.2003\1 28 03 sum act.doc Planning Commission Summary of Action Page 4 — January 28, 2003 REQUEST: The project consists of the development of a 2.9-acre site with a 39-unit, single-family residential, detached housing project. The following entitlements are required to facilitate the project: (1) General Plan Amendment No. 02-06 proposes to change the site's General Plan Designation from "Service 'and Neighborhood Commercial" to "Medium High Residential" (15.1 to 20.0 Dwelling Units per Acre). (2) Zone Change No. 02-05, proposes to change the site's zoning classification from "Neighborhood Commercial" to "Specific Plan." No. 20. (3) Tentative Tract Map No. 53995 proposes to subdivide the 2.9-acre site into 39 single-family lots and the dedication of two public streets. Precise Plan No. 02-22 for the site, design and architecture of the proposed dwellings. COMMENTS: Don Cook and David Cook (applicants), and Ann Kaplan, testified in favor of the project. Maunual Mesa, Eric Rodriguez, Lloyd Johnson, Royall Brown, Rosalind Rodriguez, and Carol Farcas testified in opposition. The Commission discussed the proposed density of the project, parking and circulation, and the impacts to the surrounding neighborhood. Commissioners Scheuplein and Tarozzi noted that the existing shopping center was blighted and deteriorated and that this project would serve to get rid of the existing development. In attempting to address the concerns of the neighbors, the Commission proposed to delete two lots in the area nearest adjacent homes and change the design of three homes in that area from two-story to single -story. In consulting with the applicant, the Commission also recommended that park in -lieu fees be waived in order to keep the project economically viable. Commissioner Warshaw stated that he did not feel that the proposed changes were sufficient to make the project compatible with the neighborhood. Motion by Scheuplein, seconded by Tarozzi, to adopt findings as recommended by staff. Motion carried 3-1 (Warshaw). Motion by Scheuplein, seconded by Tarozzi, to waive further reading of the body of the resolution and adopt Resolution No. 03-4815, recommending to the City Council, certification of the Negative Declaration of Environmental Impact for General Plan Amendment No. 02-06, Zone Change No. 02-05, Tentative Tract No. 53995 and Precise Plan No. 02-22.
